RESOLUTION NO. 80-70
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, RELATING TO THE CLASSIFICATION, COMPENSATION,
AND TE~4S OF EMPLOYMENT OF NON-ADMINISTRATIVE AND NON-
MANAGEMENT SWORN POLICE EMPLOYEES OF THE CITY OF TUSTIN.
WHEREAS, the City management representatives have met and conferred
with the representatives of the Tustin Police Employees Association on
behalf of the non-management and non-administrative sworn police personnel;
and,
WHEREAS, the Meet and Confer sessions have resulted in an agreement
and understanding pertaining to the subject of wages, benefits and condi-
tions of employment for the non-administrative and non-management police
employees of the City; and,
WHEREAS, the City now desires to provide salary increases and changes
in benefits to said police employees of the City of Tustin;
NOW, THEREFORE, the City Council of the City of Tustin, California,
does herebe resolve as follows:
Section l: .Compensation and Benefits Provisions.
A. The City shall increase the existing salary range and rates of
all non-administrative and non-management sworn police employees by six
percent (6%) to the monthly salary levels enumerated by employee position
below, effective the pay period beginning June 30, 1980:

Each employee assigned to such classifications shall receive upon that
date the salary for the range and step in which he/she is serving.
B. The salary ranges and rates established herein shall be auto-
matically increased by six percent (6%) effective the pay period beginning
December 29, 1980, for all non-administrative and non-management sworn
police employees enumerated in this Resolution. Each employee assigned
to said classifications upon the abovementioned date shall receive the
salary for the range and step in which he/she is serving.
Section 2: Employee Life Insurance. The City shall provide life
insurance on the.life of each employee classified in this Resolution, and
pay the full annual premium thereof. The death benefits of said policy
shall be one hundred percent (100%) of the employee's base annual salary
to the nearest multiple of one thousand dollars (Sl,O00. O0).
Section 3: Medical/Health Benefits~ The City shall provide a medi-
cal/health benefit program for the benefit of regular, permanent employees
and their dependents, if applicable. The City shall contribute to the
funding of said program in the following manner:
100% of the employee's annual premium for coverage
of each non-administrative and non-management police
employee.
90% of the employee's annual premium for coverage
of dependents of each non-administrative and non-
management sworn police employee, if applicable.

Section 4: General Leave. The City shall increase the General Leave
accrual rates for all non-administrative and non-management sworn police
employees to the following formula, effective June 30, 1980:
0-5 Years of Service
5-10 Years of Service
Over l0 Years of Service
19 General Leave days per year
24 General Leave days per year
29 General Leave days per year
Section 5: Bereavement Leave. The City shall allow up to 3 days
with pay, no accumulation, for the purpose of bereavement leave for all
non-administrative and non,management sworn police employees in the event
of a death in their immediate family. "Immediate family" shall be defined
as husband, wife, mother, father, brother, sister, child, grandparent and
grandchild of such employee or of the employee's spouse.
Section 6: Payoff of Existing Sick Leave. The City shall pay all
non-administrative and non-management sworn police employees the existing
accrued but unexpended sick leave balances remaining to the credit of and
at the rate of pay of such employees as of the pay period ending June 29,
1980, according to the following formula. Upon payment by the City, such
accrued but unexpended sick leave credits shall cease to exist, shall be
removed from the employee's record, and shall no longer represent a finan-
cial liability for the City.
FORMULA:
The first 100 hours of such credits, or any fraction thereof,
shall be paid at the rate of sixty percent (60%) of the credits
times the employee's hourly rate.
The second lO0 hours of such credits, or any fraction thereof,
shall be paid at the rate of twenty-five percent (25%) of the
credits times the employee's hourly rate.

The hours of such credits in excess of 200 hours shall be paid
at the rate of ten percent (10%) of the credits times the em-
ployee's hourly rate.
Section 7: Bi-lingual Pay. The City shall pay seventy-five dollars
($75.00) per month in addition to regular compensation to all non-admini-
strative and non-management sworn police personnel who can demonstrate a
skill in Spanish at the conversational level, or another language which the
Chief of Police and City Administrator have approved as being vital in
police work within the City. In order to receive such bilingual compen-
sation, the employee shall make application to the Personnel Department
and shall satisfactorily complete a conversational fluency test in such
language administered by a qualified person. The bilingual compensation
shall commence effective the start of the next pay period following certi-
fication of the test results and notification of the Finance Department
by the Personnel Department.
Section 8: Uniform Allowance. The City shall increase the uniform
allowance from $150.00 semi-annually to $162.50 semi-annually for all
non-administrative and non-management sworn police employees, effective
pay period starting nearest July l, 1981, as well as continuing to pay for
special motor officer gear and officer public safety leather gear.
Section 9: Retirement Survivors Benefit. The City shall take the
necessary action to implement the 1959 Survivors Benefit option of the
Public Employees Retirement System for all non-administrative and non-
management sworn police employees, effective pay period beginning December
29, 1980.

Section 10: Miscellaneous Provisions.
A. Avoidance of Inequities. The City Administrator may authorize
special adjustments to avoid or--eliminate inequities resulting from the
strict application of any provision of this Resolution.
B. Administrative Regulations. The City Administrator is authorized
to issue written administrative personnel regulations designed to augment
or clarify the provisions of this Resolution.
Section ll: Effective Date. Unless otherwise specified to the ·
contrary in this Resolution all provisions shall be effective as of June
30, 1980.
PASSED AND APPROVED AND ADOPTED at a regula~ meeting of the City
Council of the City of Tustin, California, held on the 8th day of July, 1980.
