HomeMy WebLinkAboutCLASS, COMPENSATION 07-08-80RESOLUTION NO. 80- 71 1 2 4 6 ? 8 9 10 11 12 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 $2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO THE CLASSIFICATION, COMPENSATION, AND TERMS OF EMPLOYMENT OF ADMINISTRATIVE AND MANAGEMENT OFFICERS, AND CONFIDENTIAL EMPLOYEES. WHEREAS, City now desires to provide increases and benefits to its employees as a result of conferences with the respective department heads, and the management officers, and confidential employees under their super- vision and subsequent recommendations to the City Administrator. NOW, THEREFORE~ the City Council of the City of Tustin does hereby RESOLVE as follows: Section l: The classification, compensation and terms of employment for non-administrative and nonpmanagement employees of City are set forth by separate Resolutions of the City Council and the provisions herein set forth shall ;not apply to those employees. Section 2: Administration Officers. Those employees holding the following positions are hereby designated as administrative officers. CLASSIFICATION: City Administrator Director of Public Works/City Engineer Police Chief Finance Director Community Development Director Director of Recreation and Community Services Personnel Director Chief Deputy City Clerk The members of the City Council are elected Officials an~ along with the City Attorney, are deemed to be administrative officers of the City. As such officers, they are employees of the City, but are not employed on a full-time bases as are the regular permanent employees. The provisions of the personnel ordinance and employee resolutions have no application to the members of the City Council and City Attorney, except that the pro- visions of Section 9 of the City Council and City Attorney, except that the provisions of Section 9 shall apply to members of the City Council and to the City Attorney. Section 3: Management Officers. Those employees holding the following positions are hereby designated as management officers: Assistant City Engineer Police Captain Police Lieutenant Traffic Engineer Building Official Police Sergeant Assistant Planner Maintenance Superintendent Assistant Maintenance Superintendent Finance Coordinator Maintenance Foreman Recreation Supervisor Records Supervisor Section 4: Confidential Employees. The salary ranges and rates established herein for administrative and management officers and confidential employees shall be effective for the pay period beginning June 30, 1980. Each employee assigned to such classifications shall receive the increased flat monthly salary or the salary for the range and step in which he/she is serving. B. The salary ranges and rates established herein shall be auto- matically increased by six percent (6%) effective pay period beginning December 29, 1980, for the following classification groups: RESOLUTION NO. 80-71 PAGE 3 1 2 4 6 $ 9 '~0 13 14 16 17 18 19 2O 21 26 30 $2 1. Administrative Officers 2. Police Management Officers, hereinafter defined as all employees serving in the following classifications: (a) Police Captain (b) Police Lieutenant (c) Police Sergeant (d) Records Supervisor 3. Confidential Employees Each employee assigned to said classifications shall receive upon that date the increased flat monthly salary or the salary for the range and step in which he/she is serving. Section 6: Exempt Positions. All Administrative and Management Officers included in the provisions of this Resolution, except Police Sergeants, are exempt positions and are not entitled to]receive additional compensation for overtime hours worked unless specifically approved by City Council for a specific project. The monthly salary shall be consi- dered full compensation for all hours worked and no overtime shall be con- sidered for payment for said employees; however, Administrative Leave may be granted when approved by the City Administrator for good and sufficient cause. The City Administrator shall have the authority to delegate this authority to the Administrative Officers. Section 7: Overtime Compehsation. All confidential employees shall be entitled to receive straight-time pay for all approved overtime hours worked in excess of eight (8) hours per shift and forty hours per week. General Leave and Holiday hours shall be included within the above hours for eligibility. If approved overtime hours for confidential employees and police sergeants are opted to be taken as compensatory time off with pay by said employees, such compensatory time off shall be computed on a straight- time formula. Section 8: Employee Life Insurance, The City shall provide life insurance on the ~ife of each employee enumerated in this Resolution, and pay the full annual premium thereof. The death benefit of said policy shall be one hundred percent (100%) of the employee's base annual salary to the nearest multiple of one thousand dollars ($1,000.00). Section 9: Medical/Health Benefits. The City shall provide a medical health benefit program for the benefit of regular permanent employees and their dependents, if applicable. The City shall contribute to the funding of said program in the following manner: Ao 100% of the employee's annual premium for coverage of each Administrative and Management Officer and Confi- dential Employee. Bo 100% of the employee's annual premium for coverage of dependents of each Administrative and Management Officer, if applicable. C. 90% of the employee's annual premium for coverage of dependents of each Confidential Employee, if applicable. Section 10: General Leave. The City shall increase the General Leave accrual rates for all Administrative Officers, Police Management Officers, and Confidential Employees to the following formula, effective June 30, 1980: O- 5 Years of Service 5-10 Years of Service Over l0 Years of Service 19 General Leave days per year 24 General Leave days per year 29 General Leave days per year RESOLUTION NO. 80-71 PAGE 4 1 2 6 ? 8 9 10 1l 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 3O 31 32 Regular, permanent Administrative Officers shall have two (2) additional days of general leave per year upon determination by the Cit~. Administrator of their satisfactory performance. Full-time regular Management Officers shall be entitled to one(l) additional day of general leave per year upon determination by the department head of their satis- factory performance. Section lt: Bereavement Leave. The City shall allow up to 3 days w~th pay, no accumulation, for the purpose of bereavement leave for all Administrative Officers, Police Management Officers and Confidential Employees in the event of a death in their immediate family. "Immediate family" shall be defined as husband, wife, mother, father, brother, sister, child, grandparent, and grandchild of such employee or of the employee's spouse. Section 12: Payoff of Existing Sick Leave. The City shall pay all Police Management Officers the existing accrued but unexpended sick leave balances remaining to the credit of and at the rate of pay of such employees as of pay period ending June 29, 1980, according to the following formula. Upon payment by the City, such accrued but unexpended sick leave credits shall cease to exist, shall be removed from the employees record, and shall no longer represent a financial liability for the City. FORMULA: The first 100 hours of such credi~ts, or any fraction thereof, shall be paid at the rate of sixty percent (60%) of the credits times the employee's hourly rate. The second 100 hours of such credits, or any fraction thereof, shall be paid at the rate of twenty-five percent (25%) of the credits times the employee's hourly rate. The hours of such credits in excess of 200 hours shall be paid at the rate of ten percent (10%) of the credits times the em- ployee's hourly rate. Section 13: Bi-lingual Pa__y_. The City shall pay seventy-five dollars ($75.00) per month in addition to regular compensation to all Police Management Officers who can demonstrate skill in Spanish at the conversa- tional level, or another language which the Chief of Police and City Administrator have approved as being vital in police work within the City. In order to receive such bilingual compensation, the employee shall make application to the Personnel Department and shall satisfactorily complete a conversational fluency test in such language administered by a qualified person. The bilingual compensation shall commence effective the start of the next pay period following certification of the test results and noti- fication of the Finance Department by the Personnel Department. Section 14: Uniform Allowance. The City shall increase the uniform allowance from $150.00 semi-annually to $162.50 semi-annually for all Police Management Officers, effective the pay period starting nearest July 1, 1981, as well as continuing to pay for special motor officer gear and officer public safety leather gear. Section 15: Retirement Survivors Benefit. The City shall take the necessary action to implement the 195g Survivors Benefit option of the Public Employees Retirement System for all sworn Police Administrative and Management Officers, effective the pay period beginning December 29, 1980. The following Administrative Officers shall receive an amount per month as an expense reimbursement allowance for their personally-owned and maintained automobile used in the regular course of performance of the duties of the employee's job within a~radius of sixty (60) miles of City Hall and in the amount hereinafter specified: 1. O0 For required travel beyond sixty (60) miles radius, the Officer shall be entitled to a commercial transportation allowance, or may claim a mileage reimbursement of a flat rate of twenty cents (.20~) per mile. If such persons prefer the use of their private vehicle, or when commercial transportation is not'available, economical or practical, they may be re- imbursed the amount of the cost for equivalent commercial transportation only, unless the flat rate per mile set forth above is less. Section 17: Miscellaneous Provisions A. Avoidance of Inequities. The City Administrator may authorize special adjustments to avoid or eleminate inequities resulting from the strict application of any provision of this Resolution. B. Administrative Regulations. The City Administrator is authorized to issue written administrative personnel regulations designed to augment or clarify the provisions of this Resolution. Section 18: Effective Date. Unless othe~,~ise specified to the contrary in this Resolution, all provisions shall be effective as of June 30, 1980.
