Reid, Building Official Improve HVAC Systems, City Hall The bid opening was attended and witnessed by a representative of each bidder and the "Green Sheet." Payne ..................................... no bid Far West ....................................... no bid Baird .......................................... no bid Blake .......................................... no bid ACS ............................................ 62,465 The Iow bidder did not submit his bid on the required form. On the advice of the city attorney, I initiated action recommending the City Council reject all bids and the City Clerk advertise for new bids. Had the Iow bidder submitted his bid on the proper form it would be in the City's interest fo assure the bid was complete and free of errors. That question be- came academic, therefore, I did not investigate. The Graham Brothers' representa- tive did volunteer by phone fo sign on the required form for the same price, $36,336. The $36,336 bid appears to be in line. The fwd next higher bids are excessive. Inquiry indicates HVAC bids are surprisingly high lately. I recommend Council approval of Resolution No. 80-56. WHEREAS, if is the intention of the City Council Of the City of Tustin, California, fo improve heating, air conditionin9 and ventilation systems, Police and City Administrative buildings; WHEREAS, the Building Official has presented plans and specifications for the construction of said work; NOW, THEREFORE, BE IT RESOLVED THAT the plans and specifications pre- senfed by the Building Official be and are hereby approved as the plans and specifications fo improve heating, air condifionin9 and ventilation systems, Police and City Administrative buildings. BE IT FURTHER RESOLVED THAT the City Clerk is hereby authomized and directed fo reject all bids received June 4, 1980 for this project, Resolution No. 80-38, and fo re-advertise as required by law for the receipt of sealed bids or proposals for the doin9 of the work specified in the aforesaid plans and specifications which said advertisement shall be substantially in the followin9 words and figures, to wit: "NOTICE TO CONTRACTORS" SEALED PROPOSALS will be received at the office of the City Clerk, Tustin, City Hall, 300 Centennial Way, Tustin, California, until on the ~rd day of July, 1980, at which time they will be publicly opened and read, for performin9 work as follows: To improve heating, air conditioning and ventilation systems, Police and City Administrative buildings. Bids are required for the entire work described herein: SCHEDULE OF WORK ITEMS Item No. Unit Quantity 1~ ea. 1 2. ea. 1 Improve HVAC building Description Improve HVAC system, Police building system, City Administrative Plans, specifications and proposal forms fo be used for bidding on this project can only be obtained by prospective bidders at the office of the City Clerk, Tusfin City Hall, 300 Centennial Way, Tusfin, California, 92680, upon payment of $2.50 per set, which amount shall be non-refundable. The work is fo be performed with the Police building having preference over the City Administrative building. The contractor shall commence work on each HVAC system only when he has all materials and equipment af hand. Once work commences on a system, work shall be continuous until work on fhaf system is complete. Each system shall be placed in oper- ation for testing, balancing, adjusfin9, and fine tuning upon completion of work on that system. In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and ac- companied by one of the following forms of bidder's security: a. Cash b. Cashier's check made payable to the City of Tustin c. Certified check made payable fo the City of Tustin d. Bidder's bond executed by an accredited surety insurer, made payable fo the City of Tusfin The security shall be in an amount equal to af least fenpercent (10%) of ~he amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. A Surety Bond for payment of labor and materials w|ll be required in the amount of fifty percent (50~) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the contract documents. Said bonds shall be issued by a Surety Company rated Grade A or better and Class IX or better by the latest edition of Best's Key Rating Guide. City of Tusfin reserves the right fo re]ecl any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. The contract will be awarded to the lowest qualified bidder. Provisions of the State Contract Act are not applicable, and prospective bidders will not be required fo be prequaliFied. All work fo be done under the direct supervision of the City Engineer, City of Tustin, All work to be paid for at the unit prices bid from appropriated monies. Said City of Tusfin, pursuant to the Labor Code of the State of California, has ascertained and determined that the general prevailing rate o¢ hourly and per diem wages in the locality in which the said work herein described is fo be performed, for each craft or type of workman or mechanic needed fo execute the contract and also the general prevailing rate for legal holidays, and overtime work for each craft or type of workman or mechanic, to be as indicated in Resolution 77-52 as previously published in a news- paper of general circulation, and on file in the office of the City Clerk. Employer payments other than those itemized therein, as defined in Section 1773.1 of the Labor Code, are fo be paid in accordance with the terms of the collective bargaining agreement applicable to the type or classification of the workmen or mechanics employed on the project. Copies of all collective bargaining agreements relating fo the work as set forth in the aforementioned Labor Code are on file and available for inspection in the office of the Department of Industrial Relations, Division of Labor Statistics and Research.
