AHFP PROJECT 938 and 939 AND EL MODENA-IRVINE FO7 CHANNEL
IMPROVEMENTS AT THE INTERSECTION OF BRYAN AVE. AND BROWNING AVE.
The AHFP (Arterial Highway Financing Program) procedural manual requires that on
all AHFP projects where right-of-way acquisition is involved the City adopt a
certification that all right-of-way has been acquired. This certification must
be submitted to the County before they will issue authorization to advertise for
bids.
On this project the Irvine Company has dedicated the necessary right-of-way, and
we have obtained a right-of-entry from the Edison Company until such time that
purchasing negotiations can be completed.
For the Council's information, following is the timetable for this project:
May 12, 1980
Final Plans & Specifications submitted to
Orange County EMA for final approval.
*May 19, 1980
City Council adopts R/W certification and
R/W certification transmitted to CoUnty.
May 30, 1980
Orange County EMA approves Plans and Specs &
issues authorization to adverti'se for bids.
*June 2, 1980 - City Council authorization to advertise.
June 30, 1980 - Open bids.
*July 7, 1980 - City Council awards bid.
July 18, 1980 - Pre-job conference.
July 28, 1980 - Begin construction.
Nov. 1, 1980
RCB construction and storm drain work completed
for rainy season.
Feb. l, 1981 - Project Completed.

The tight time frame as indicated is necessary in order to allow the County
time for plan checking and to complete the storm drain portion of the project
before the rainy season.
RECOMMENDATION
It is recommended that the City Council at its meeting of May 19, 1980, adopt
a Minute Order authorizing the Mayor to sign and the City Clerk to attest to
the attached Right-of-Way Certification for AHFP Project No. 938 and 939.

~RIGHT-OF-WAY CERTIFICATION
THE CITY OF TUSTIN HEREBY CERTIFIES IN CONNECTION WITH. THE RIGHT-OF-WAY
FOR AHFP PROJECT NO. 938 AND 939 THAT:
All right-of-way has been acquired or condemnation suit
has been filed and order of immediate possession has been
taken on all parcels not acquired by negotiation or right-
of-entry has been obtained.
No building improvements exist in the right-of-way area.
The following utility improvements exist within the right-
of-way area but will not interfere with the proposed con-
struction or are to be relocated as part of this project:
(a) Gas Main (no interference)
(b) Water Main (to be relocated)
I~l Sanitary Sewer Main (to be relocated)
Jet Fuel Line (no interference)
(e) Telephone Conduit.(no interference)
(f) Irrigation Line (to be relocated)
The following utility improvements are to be relocated by
respective utility companies:
(a) 3 telephone poles
(b) 1 Edison Co. guy pole
(c) 1 Edison Co. transmission line pole.
No delay will be occasioned to the contractor by the obstructions
named herein.
In making this certification, the City of Tustin agrees to hold the County of
Orange harmless from any liability which may arise by reason of the County's
reliance upon this certificate and its use of said rights-of-way.
