HomeMy WebLinkAboutPH 1 VARIANCE 80-2 04-07-80PUBLIC HEARING No. 1 4r7 -B Q DATE: April 7, 1980 ��♦, `Rl Inter -Com TO: Honorable Mayor & City Council FROM: Community Development Department SUBJECT: Appeal for Tuneup Masters Signs (Variance 80-2) APPLICANT: Tuneup Masters (Floyd Wheeler) LOCATION: 695 E1 Camino Real BACKGROUND & DISCUSSION On March 3, 1980, the City of Tustin Planning Agency adopted Resolution No. 1870 which denied three additional signs for Tuneup Masters at 695 E1 Camino Real. On March 7, 1980, Tuneup Masters appealed the decision of the Planning Agency and consequently this appeal was noticed for the April 7, 1980, City Council meeting. On March 25, 1980, we received an additional request from Tuneup Masters for a pole sign inlieu of their existing monument sign. They have since been informed that the pole sign will require a conditional use permit which will be advertised for a future meeting. Enclosed for your information are all the corresponding letters and resolution. RECOMMENDED ACTION: Staff recommends that the City Council by M.O. deny the appeal as submitted and uphold the findings of Resolution No. 1870. The Planning Agency of the City of Tustin does hereby resolve as follows: I. The Planning Agency of the City of Tustin finds and determines as follows: A. That a proper application, Variance No. 80-2, was filed on behalf of Larry H. Selditz to request authority to vary with Section 9493c of the City Code and display three (3) additional wall signs at the Tune—Up Masters facility, 695 EI Camino Real. B. That a public hearing was duly called, noticed, and held on said application. C. That because there are no special circumstances applicable to the subject property, relative to size, shape, topography, lo— cation or surroundings, and approval of this application would grant the subject property privileges not enjoyed by other properties in the vicinity and under identical zone classifi— cation, evidenced by the following findings: 1. The site does enjoy visibility of a "Y" shaped intersection which is a benefit, not a hardship. 2. That the business has sufficient approved signing area to incorporate descriptions of the services offered. D. That the granting of the variance as herein provided :could be contrary to the intent of the Sign Ordinance and should not be granted. It. The Planning Commission, therefore,•herebv denies Variance No. EJ0-2 as applied for. In addition, I have added a small 1'-4" panel across the bottom which reads, "TUNE LUBE." The total height of this sign will not exceed 15 feet and the `- bottom would therefore be about 10 feet above grade. I would also like to have, if possible, two (2) small, painted auxiliary signs attached to the pole which will state, respectively, our -- shop opening time and the fact that we accept Master Charge and Visa credit cards. I have enclosed a colored version of this freestanding sign and two (2) Xerox copies which you may need. I am very hopeful this material is sufficient for our needs and that you and I can achieve an agreement which will be acceptable to the City Council (Planning Commission). Unfortunately, — tnis proposal cannot be con�ydered formally at the appeai hearing. The particulars of the initial request are that which ma., be considered. A different he-- ing, Use Permit, is required for all polo signs within Tustin. Enclosed is a use permit application. Since we have the -isplays to notice property owners, those items in the application reed not be resubmitted. In addition, comment has been received concerning campaign signs nailed to trees in public parkways in non—compliance with City Council Resolution 80-2 (copy enclosed). Community Development recognizes the transitory nature of the problems the extensive nature of violations in state or national elections, and the fact that violations on private property would involve enforcement action involving homeowners or residential asso:iations rather than candidates We further recog— nize that individual candidates may be unaware of such problems which may be the result of exuberant supporters. We ask all candidates to join in a spirit of cooperation to correct signage problems of location or size in the general public interest. MWB: mm enclosures
