"B" STREET IMPROVEMENTS FROM 2ND STREET TO 3RD STREET
(H.C.D.A. PROJECT)
Subject project has been completed by Hardy & Harper, Inc. and the Engineering
Department is well satisfied with the quality of the work. The project has also
been accepted by the Housing and Community Development Department of the County
of Orange.
The preliminary.contract amount.based on estimated quantities was $20,844.00.
The final contract amount based on "as constructed" quantities is $21,988.25,
for an over run on the contract of $1,144.25 or 5.5%.
Attached is the resolution for the City Council's acceptance of the work and
authorization for recordation of the Notice of Completion.
RECOMMENDATION:
It is recommended that the City Council at its meeting of APril 7, 1980, adopt
the attached resolution accepting said work and authorizing the filing of the
Notice of Completion.
Assuming that no claims or stop payment notices are filed within 30 days of the
date of recordation of the Notice of Completion, it is further recommended that
the City Council authorize payment of the final 10% retention ($2,198.83) at
that time. This amount, together with previous payment of $19,789.42, represents
100% of the final contract amount.

Please delete subject item from the City Council Agenda of April 7, 1980 and re-
schedule for the meeting of April 21, 1980.
This is because the Contractor was unable to complete some of the required paper-
work.

RESOLUTION NO. 80-34
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION.
WHEREAS, Hardy & Harper Inc., having a contract with the City of
Tustin to construct the hereinafter described public work and improve-
ment; and
WHEREAS, the City Engineer has duly certified to the construction
and completion of said public improvement hereinafter mentioned in a
manner satisfactory to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed
said public improvement hereinafter more particularly described in ac-
cordance with the provisions of the contract documents, and the notice
of completion and acceptance of said public work and improvement should
be filed and payment of the balance due said contract authorized in ac-
cordance with t~e contract documents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said public work and improvement be, and the same is hereby
accepted. Said public work and improvement is more particularly des-
cribed as follows:
"B" Street Improvements from 2nd Street to 3rd Street
AND BE IT FURTHER RESOLVED that the City Engineer of the City of
Tustin be, and is hereby authorized to execute and file a Notice of
Completion and acceptance of said public work and improvement described
herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Tustin on , 1980.
