PROJECT I MAIN STREET SIDEWALK CONSTRUCTION
PROJECT II - PROSPECT AVENUE SIDEWALK CONSTRUCTION
Project I provides for construction ora pedestrian walkway along the north side
of Main Street from Williams Street through the freeway underpass and terminating
at the entrance to St. Jeanne de Lestonnac School. To accomplish this requires
construction of 300'± of retaining wall and 520'± of 5' high chain link fence
within the freeway underpass. The fence is necessary to protect children and
pedestrians due to the fact only a 3.0' wide sidewalk is possible within the
underpass.
Project II provides for construction of sidewalk along the west side of Prospect
Avenue from 100'± north of First Street to Lockwood Park Place.
These projects were bLab?ted separately, but have been combined for construction
purpos~s~ There is presently $26,000. budgeted for Project I and $2,000.00
budgeted for Project ~. The Engineer's estimate is $18,800 for Project I and
$2,70{~,C~ for Project Z!,
The atzached Resolution is for the City Council's approval of Plans and Specifi-
cations for the construction of Project I Main Street Sidewalk Construction and
Project II Prospect Avenue Sidewalk Construction and directing the City Clerk to
advertise For bids.

RECOMi,IENDATION:
It is recommended that the Tustin City Council at their meeting of March 17, 1980
pass and adopt the attached Resolution approving Plans and Specifications for
Project I Main Street Sidewalk Construction and Project II Prospect Avenue Side-
walk Construction and directing the City Clerk to advertise for bids.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
APPROVING PLANS AND SPECIFICATIONS FOR (PROJECT I) MAIN STREET
SIDEWALK CONSTRUCTION AND (PROJECT II) PROSPECT AVENUE SIDEWALK
CONSTRUCTION AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS.
WHEREAS, it is the intention of the City Council of the City of Tustin,
California, to construct certain sidewalk and street improvements and appurtenant
~orK designated as (Project I) Main Street Sidewalk Construction al~d (Project II)
Prospect Avenue Sidewalk Construction;
WHEREAS, the City Engineer has presented plans and specifications for the
construction of said work;
NOW, THEREFORE~ BE IT RESOLVED that the plans and specifications presented
by the City Engineer be and are hereby approved as the plans and specifications
for the construction of (Project I) Main Street Sidewalk Construction and (Project
II) Prospect Avenue Sidewalk Construction;
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and di-
rected to advertise as required by law for the receipt of sealed bids or proposals
for the doing of the wer!~ specified in the aforesaid plans and specifications
which s~i~ advertisemeFt shall be substantially in the following works and figures,
to-wi t:

SEALED PROPOSALS will be received at the office of the
City Clerk, Tustin City Hall, 300 Centennial Way, Tustin,
California, until ll:O0 A.M. on the llth day of April, 1980,
at which time they will be publicly opened and read, for
performing work as follows:

Construction and (Project It) Prospect Avenue
Sidewalk Construction.

The foregoing quantities are approximate only, being given as a basis for
the comparison of bids, and the City of Tustin does not, expressly or by implica-
tion~ agree that the actual amount of work ~ill correspond therewith, but reserves
the right to increase or decrease the amount of any class or portion of the work,
or to omit portions of the work as may be deemed necessary or advisable by the
Engineer.
Plans, specifications and proposal forms to be used for bidding on this
project can only be obtained by prospective bidders at the office of the City
Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, 92680, upon pay-
ment of $5.00 per set, which amount shall be non-refundable.
Plans and specifications will only be n!ailed out upon payment of $10.00 per
set, which amount shall be non-refundable.
In conformance with Section 37931 of the Government Code, all bids shall be
presented under sealed cover on the proposal form provided and accompanied by one
of the following forms of bidder's security:
a. Cash.
b. Cashier's check made payable to the City of Tustin.
c. Certified check made payable to the City of Tustin.
d. Bidder's bond executed by an accredited surety insurer, made payable
to the City o'? Tustin.

The security s~ii be in an amount equal to at least ten percent (10%) of
:mt of the bi~. A 5id shall not be considered unless one of the forms of
s security is enclosed therewith.
A Surety Bond for' payment of labor and materials will be required in the
amot~nt of fifty percent ~u,,~} of the estimated total contract price and a Faithful
Perfo?-s~nce Bond in the amount of one hundred percent (100%) of the estimated 'total
contract price in the ferm attached to the contract documents. Said bonds shall be
issued by a Sure~y Co~:pany rated grade A or better and Class IX or better by the
latest edition of Best's Key Rating Guide.
City of Tustin reserves the right 'to reject any and all bids, and/or waive
any informality on a bid. No bidder may withdraw his bid for a period of thirty
(30) days after the date set for the opening thereof.
The contract will be awarded to the lowest qualified bidder.
Provisions of the State Contract Act are not applicable, and prospective bid-
ders will not be required to be prequalified.
All work to be done under the direct supervision of the City Engineer, City
of Tustin.
All work to be paid for at the unit prices bid from appropriated monies.
Said City of Tustin, pursuant to the Labor Code of the State of California,
has ascertained and determined that the general prevailing rate of hourly and
perdiem wages in the locality in which the said work he.rei~, described is to be
performed, for each craft or type of workman or mechanic needed to execute the
contract and also the general prevailing rate for legal holidays, and overtime
work for each craft or type of workman or mechanic, to be as indicated in Reso-
lution 77-52 as previously published in a newspaper of general circulation, and
on file in the office of the City Clerk.
Employer payments other than those itemized therein, as defined in Section
1773.1 of the Labor Code, are to be paid in accordance with the terms of the col-
lective bargaining agreei~nt applicable to the type of classification of the work-
men or mechanics employed on the project.
Copies of all collective bargaining agreements relating to the work as set
forth in the aforementioned Labor Code are on file and available for inspection
in the office of tile Department of Industrial Relations, Division of Labor StaLis-
tics and Research.
