THIOKOL/DYNACHEM, ALLEGED BUILDING CODE VIOLATIONS
The Building Department has set a hearing in March on the appeal of
Thiokol/Dynachem on the determination by Building Official George Reid that the
building has a number of violations of the Uniform Building Code.
From what we have seen to date we see a likelihood that Thiokol/
Dynachem will attempt to block the enforcement of these alleged building code
violations, either seeking to permanently prevent the City from enforcing the code
upon them, or delaying it for a long time in order that the company may avoid
making any building a/terations prior to the tirne that it may intend to leave the
building.
If the City is to be in the strongest possible posture in reference to this
matter, assuming that it is likely that litigation will arise out of it, then we feel
there should be a court reporter present at Lhe hearing to make a full and complete
transcript of the proceedings. This would be an additional effort, expense and
procedure we generally do not follow. As you know, we generally tape record such
proceedings, however the transcript that results is typically far less than perfect.
We have no idea how many witnesses Thiokol/Dynachem may intend to call and
therefore no idea of how long the hearing may go and therefore no idea of what the
cost of a reporter would be. An all-day heatlog by a court reporter might typically
involve a cost of as much as $1,000.00.
The purpose of this memo is to advise you and the City Council of this
matter and if you and/or the City Council prefer that this expense not be incurred,
then we will not have a court reporter present.. Otherwise, we would intend to
follow such a procedure.
