PUBLIC HEARING - SALE OF SURPLUS PROPERTY ON NEWPORT AVENUE
The City presently has two (2) surplus parcels of land to offer'for sale along
the westerly side of Newport Avenue between Holt Avenue and Irvine Boulevard.
These parcels are described by a legal description and map attached to each
resolution.
These parcels are more commonly described as follows:
The most southerly parcel lies between and adjacent to the Don Jose
Restaurant development and Newport Avenue between Holt Avenue and
the Orange County Flood Control District Channel and contains
5581.44 square feet.
The most northerly parcel lies adjacent to and westerly of Newport
Avenue be=ween ~h~ Orange County Flood Control District Channel and
irvine Seu!evard and contains 6866.42 square feet.

These ~=r~:els were _~q~. em from the Southern Pacific Railroad Company at the
time sw C~e widening of Newport Avenue and the construction of the off-street
bike mr~il. These parcels were a part of the overall right-of-way acquisition,
but ace mo longer needed for public purposes. Each parcel has only 30' of depth
and no access to Newport Avenue, therefore, it is not considered developable
property under the existing zoning code.
On January 21, 1980, the Tustin City Council passed and adopted Resolutions No.
80-7 and 80-8 declaring their intention to sell the subject property. These
Resolutions established February 19, 1980 at 7:30 p.m. as the time for a public
hearing to determine that public interest and convenience require the sale of
the two subject parcels of land adjacent to Newport Avenue.
The attached Resolutions No. 80-12 and 80-13 provides for the finding and deter-
mining that the public interest and convenience require the sale of the real
properties adjacent to Newport Avenue. Details concerning these properties are
as follows:

These minimum bid prices have been set from the original acquisition cost plus
any administrative cost incurred to date, which results in a cost of approxi-
mately $3.17 per square foot.

RECOMMENDATIONS:
It is recommended that the Tustin City Council! at their meeting of February 19,
1980, pass and adopt Resolutions No. 80-12 and 80-13 which finds and determines
that the public interest and convenience require the sale of real properties
adjacen~ to Newport Avenue.

RESOLUTION NO. 80-12
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA¥ FINDING AND DETERMINING
THAT PUBLIC INTEREST AND CONVENIENCE REQUIRE
THE SALE OF REAL PROPERTY ADJACENT TO NEWPORT
AVENUE HAVING AN AREA OF APPROXIMATELY 6,866
SQUARE FEET.
The City Council of the City of Tustin, California does hereby resolve
as follows:
1. The City Council hereby finds and determines as follows:
a. That the property is not needed for any present or prospective
public use, and is therefore excess and surplus land.
b. That the public interest and convenience require the sale of
said real property.
c. That the proposed sale of s~id real property was declared and
qualified as a negative declaration under the California Environ-
mental Quality Act by Resolution of the City Council passed and
a~opted at a regular meeting held on January 21, 1980.
d. That the real property proposed for sale is described in
Exhibit "A" and as shown on a map referred to as Exhibit "B"
both which are attached and made a part hereof and more commonly
described as a 30' wide parcel of land on the westerly side of
Newport Avenue between the Orange County Flood Control District
Channel and Irvine Boulevard.
2. That any person who wishes to make an offer to purchase the said
real property may do so by submitting to City an offer in writing on the form
attached as Exhibit "C", accompanied by a cashier's check in the sum of
$5,000.00, payable to the City of Tustin, at or before the time of said
hearing, and any and all persons are hereby solicited for offers.
3. That minimum bid shall be $ 21,800.00. Final sale shall be sub-
ject to the normal real estate sales provisions as prepared by the City
Attorney.
4. That the City shall reserve the right to refuse all bids.

5. That proposals shall be submitted not later than 3:00 o'clock p.m.
on March 6 , 1980, to the City Clerk's office, at which time
the staff shall open and review the bid and proposals prior to March 17 ·
1980.
6. That a hearing is set for March 17 , 1980, at 7:30 o'clock
p.m. in the Council Chambers of the City Of Tustin at Tustin City Center,
300 Centennial Way, Tustin, California, at which time and place any and all
persons interested in said proposed sale may appear, make or increase offers,
protest the proposed sale, and/or otherwise be heard. The City Council shall
pass on any and all offers and protests at said time and place.
7. That a copy of this resolution shall be published once a week for
two weeks in the Tustin News, a newspaper of general circulation published
in the City of Tustin, not less than fifteen (15) days before said hearing,
and notice of said hearing shall be posted conspicuously along the line of
the portion of said property proposed to be sold not less than ten (10) days
before said hearing and not less than three (3) copies shall be posted.
PASSED AND ADOPTED at a regular meeting of the City Council held on
