WRITTEN POLICY REGARDING POLITICAL USE OF PUBLIC BUILDINGS
Attached is a proposed Council Policy which reflects the most recent pol~cy
on public buildings with the addition of paragraph C-8 on page 3 relating to
political use.
We hope this accomplishes Council intent as requested at the February 4, 1980,
Council meeting, to record the previous unwritten policy on the same subject.

PURPOSE
TO ensure proper use and fair scheduling of the Clifton C. Miller Community
Center, Council Chambers, and other public buildings, with preference given
to City residents, businesses, and local programs, and to charge the user his/
her appropriate share of the operational costs.
POLICY
A. Frequency of Use
As a general rule, no organization or person may reserve this
facility more than once per month on a regular basis.

Exception: A group may be allowed, on a temporary
basis, more frequent uses. Such times must be at
periods not regularly requested by others. Any such
additional use wilt be subject to cancellation for a
specific da:e upon a minimum of a 30-day advance notice.

Special functions involving more than one day will be limited to
a period of time not to exceed 50 consecutive hours and no more
than once per year, per organization, except by City Council auth-
orization.
B. Advance Reservation
City-conducted or sponsored programs may be scheduled up to 12 months in
advance. All local organizations, businesses, or City residents may re-
serve a facility up to 9 months in advance by submitting a fully-completed
application with the appropriate deposit. All non-resident requests will
be restricted to a 3-month advance reservation, with the exception of area-
wide charitable organization affairs or wedding reception requests, which
will have a 5-month restriction.

C. Classifications
City-Conducted or Sponsored Programs and Functions. This includes
all programs of the Parks and Recreation Department and functions
sanctioned by City Council. A list of sponsored programs will be
reviewed annually by the City Council. Examples:
a. Ongoing Programs-Tustin Senior Citizen Club
b. Special Functions-Miss Tustin Pageant
Local Non-Profit. This includes all local groups that are non-profit
in nature with over 50% membership being City residents, or those non-
profit organizations having City of Tustin addresses. This would include
such groups as youth activity groups, service clubs, school support or-
ganizations, etc. Examples are: Bobby Sox Association, Tustin High
School Booster Club, and the Chamber of Commerce.
City-endorsed Charitable and Service Organizations. This classification
will include City-endorsed charitable and City recognized non-local,non-
profit organizations that are known to provide special services to City
residents. Those in this classification must have prior City Council
approval. Examples:
City-endorsed Charitable Organizations: Cancer Society, Heart
Association, and others that are registered with the State as
a charitable organization.
b. Tustin Service Organizations (non-local, non-profit):
Boy Scouts, Girl Scouts, etc.
YMCA, YWCA,
Non-Local, Non-Profit. Same as number 2 except that these are organi-
zations with less than 50% of participants being City residents. Exam-
ples are: Sierra Singles, Tustana African Violets, Parents Without
Partners, Orange County Republican or Democratic Central Committee (in-
ternal business meetings only), the Ballet Montmartre, Southern California
Aquatics Club, Children's Hospital of Orange County, Garden Grove Community
Church Singles, Sigma Tau Psi, and Sons of Italy.

5. Local Residents and Businesses.

Social or Recreational Functions~. This classification is open
to any City resident for scheduling private social or recreational
functions; and to any local business owner or operator for a busi-
ness, social, or recreational function.

Training Programs. Training programs of local businesses and resi-
dents may be scheduled in the Council Chambers provided their
activities are compatible with the facility. The Clifton C. Miller
Community Center may NOT be used for such training programs.
Definition of Local Business. To be eligible as a local business,
an applicant must have an established place of business within the
City of Tustin and a City of Tustin business license.
NOTE:
In case of a wedding reception, either the bride, groom,
or their parents must be. a City resident.
6. Private Non-residents, Similar to above except for persons or firms
not within the City.
Commercial. This classification is for commercial firms that use
the facility for directly business-related functions, such as exhibits
or sales. Such functions will not be scheduled without prior approval
by City Council. Fees will be recommended by staff.
Political Use. No City facilities are to be used for any partisan
or non-partisan political purpose which promotes selected candidates
or issues, nor to raise funds for such candidates or issues. Not
prohibited are community service programs of a politically-related
purpose, such as candidate nights sponsored by neutral civic organi-
zations wherein all candidates are given equal opportunity to be
present and be heard.
D. Application Procedure and Deposit.
All requests must by made on the BUILDING USE APPLICATION form. Appli-
cations received prior to the advance registration date will be held until
eligible for consideration. Priority will be given to City residents on
a first-come, first-serve basis. No application will be considered until
deposit is made and the application officially approved. The amount of
the deposit is noted on the following chart.

E. Payment of Fees.
The remainder of the fee MUST be paid in full a minimum of 30 days
in advance of the function.
F. Refunds.
Full refund will be made if given 30 days or more notice. Cancellations
within 30 days of the scheduled date will forfeit the deposit payment.
G. Clean-up Fee.
This will be required of all groups serving food or refreshments, or
decorating. The exact amount will be based on the size and type of the
function and will be determined by staff. The cost of extra maintenance
by City staff and/or the repair cost of any damage to City property will
be subtracted from this deposit.
H. Waiver and Use Restrictions.
Any organization requesting waiver of fees must petition the City Council.
I. Security Guards.
Certain programs or uses which invite or attract large numbers of people
may be required to obtain security guards through the Tustin Police
Department, such as a dance or an evening wedding reception with dancing
as its main program. 'The number of guards needed will be determined by
the Police Department. All costs involved will be the responsibility of
the applicant.
Exception(s).
Any other use request not covered by the above will be submitted to
City Council with a staff recommendation.
