Fleagle San Juan-Green Valley Annexation No. 110 (Revised) Several property owners within the San Juan-Green Valley.County Island have ex- pressed a desire for annexation fo the city of Tusfin. By letter, dated January 15, 1980, the property owners were given an opportunity to express any objections they may have to the proposed annexation. No objections have been received by this office. This annexation was processed as an island annexation in March, 1978, including the apartments and condominiums on the easterly side of Red Hill Avenue, and was not approved by the Board of Supervisors as an island annexation. If is now proposed fo process this revised annexation as an "inhabited annexation." Upon approval by LAFCO, the City Council would conduct an advertised protest hear- ing. If less than 25% of the registered voters and less than 25% of the owners o¢ land who own less than 255 of the total assessed value o¢ land wlfhin the territory file a written protest, the Council may order the annexation without an election. WHEREAS, if is the desire of the City of Tustin to annex into ifs boundaries certain inhabited properties within its Sphere of ln¢luence and contiguous to ifs existing boundaries; and WHEREAS, the City Council has determined that the proposed annexation is categorically exempt from the CEQA requirements for environmental impact review; and WHEREAS, it is the desire of the City of Tusfin to extend the full range of municipal services to the residents of these unincorporated properties in the interest of the welfare of the total community; and WHEREAS, certain property owners within the area have expressed a desire to be within the incorporated limits o¢ the city and all other property owners were invited to express their desires, with the results indicating that a majority of the residents and property owners have no objection fo the annexation; NOW, THEREFORE, BE IT RESOLVED by the City Council, City of Tustin, California: Tha, the City of Tusfin requests the commencement of annexation prO-- ceedings in connection wlfh said inhabited territory pursuant fo Chapter 2, Article 4, Section 35140 and Chapter 3, Article 2, Section 35220 of the Municipal Organization Ac, of 1977. That said uaincorporated territory be, and hereby is, designated as the "Sa~ Juan-Green Valley Annexation No. 110 tRevised)" fo the City of Tustin and is as shown on Exhibit "A" attached hereto and incorporated herein by this reference, and as legally described in Exhibit "B" atfache~ hereto and incorporated herein by this reference. That the subject area is a ,orally developed urbanized area of 12 acres consisting of apartment houses, single family residences, and duplex units. That an 8.7 acre apartment house and condominium project will remain as a county island within the immediate vicinity until such t-ime as the residents and owners express a desire for annexation. The re- maining portion cannot reasonably be annexed to another city or in- corporated as a new city, thereby qualifying for a waiver of the restrictions of Section 35010. That the justification for the proposed change of organization is to provide full municipal services to an urbanized county area that is remote from county service facilities and thereby increase the economy and efficiency of urban services.
