The meeting was called to order by Chairman Saltarelli at 8:01 P.M. 2. Present: Members: Saltarelli, Sharp, Kennedy, Welsh Absent: Members: None 3. APPROVAL OF MINUTES of January 7, 1980 meeting. It was moved by Kennedy, seconded by Welsh, that the minutes of the January 7,.1980 meeting be approved. Carried 4-0. 4. FINAL ACCEPTANCE OF SIXTH STREET EXTENSION TO NEWPORT AVENUE RESOLUTION NO. RDA 80-1 A Resolution of the Con~munity Redevelopment Agency of the City of Tustin ACCEPTING WORKS OF IMPROVEMENT AND AU~{ORIZING RECORDATION OF NOTICE OF COMPLETION It was moved by Sharp, seconded by Kennedy, that Resolution No. RDA 80-1 be passed and adopted. Carried. /8ATRMAN PuECO~D lNG ~ETING OF TUSTIN CITY COUNCIL RECONVENED AT 8:04 P.M. January 21, 1980 RESOLUTION REGARDING PRICE MARKING OF GROCERIES Helen Edgar, 13622 Loretta Drive, called the attention o~ the Council to an article in the paper regarding a resolution that was passed by the City of Garden Grove that all grocery stores would mark the price on their gro- ceries. She asked that the Council investigate what other cities are doing regarding this to help determine if Tustin should adopt such a resolution. CAllS "FOR SALE" PARKED IN A "NO PARKING" AREA ON 17th STREET Mrs. Edgar reported 7 cars with "For Sale" signs on them parked in a "No Parking" area east on 17th St. just west of Skaggs Drug Store. Chief Thayer said he would investigate and take appropriate action. TRUCKS AND MOVING VANS PARKED IN AN ABANDONED SHELL STATION ON SYCAMORE AND NEWPORT Mrs. Edgar reported that 6 to 10 trucks and moving vans park in the Shell Station next to the hospital and she asked if fences could be put up to keep the trucks out of the station as was done at the Arco Station. Counciln~%n Welsh responded that the entire station had been torn down prior to last Sunday. STUDY ON ODORS AT DYNACHEM FACILITY Ronald Hoesterey, 2251 Caper Tree, asked when the report on the Dynachem Facility would be released to the public as he had had several residents inquiring about it. CONSENT CALENDAR COUNCIL MINUTES Page 3, 1-21~80 Mayor Schuster pointed out that the Council had .just received the report at the beginning of this meeting and they had not had a chance to review it. Attorney Rourke clarified that it would be up to the City Council as to when it would be released. PROPOSED JAMBOt~EE ROUTE Mr. Hoesterey asked if there had been any progress made to move the proposed Jamboree Route to the eastern side of the industrial park. Mayor Schuster responded that we have met with the City of Irvine, the Irvine Company and the Marine Corps. Mr. Schuster, Mr. Blankenship and Mr. Brotemarkle, together with several other representatives from Irvine, Irvine Company and Marine Corps, took a flight on Friday through the Marine Corps' patterns. There are some problems and alternatives have to be explored before any further decisions can be made. UNDERGROUNDING OF CABLES ON CENTENNIAL WAY Richard B. Edgar, 13622 Loretta Drive, asked what was the time frame for undergrounding the cables on Centennial Way joining Larwin Square. Bob Ledendecker, City Engineer, reported that the Edison Company is cabling now and will be able to provide energy to the signal light this week and their cut over conversion to the underground system for Larwin Square will be one night this week. The Telephone Company will be doing their transfer about the middle of February. 1. APPROVAL OF MINUTES - January 7, 1980. 2. APPROVAL OF DEMANDS in the amount of $139,969.10. SALE OF SURPLUS PROPERTY - NEWPORT AVENUE RESOLUTION NO. 80-7 A Resolution of the City Council of the City of Tustin, California, DECLARING ITS INTENTION TO SELL PROPERTY ADJACENT TO NEWPORT AVENUE BETWEEN HOLT AVENUE AND THE ORANGE COUNTY FLOOD CONTROL DISTRICT CHANNEL AND FIXING A TIME AND PLACE FOR PUBLIC HEARING THEREON RESOLUTION NO. 80-8 A Resolution of the City Council of the City of Tustin, California, DECLARING ITS INTENTION TO SELL PROPERTY ADJACENT TO NEWPORT AVENUE BETWEEN THE ORANGE COUNTY FLOOD CONTROL DISTRICT CHANNEL AND IRVINE BOULEVARD Adoption of Resolution No. 80-7 ~nd Resolution No. 80-8 as recommended by the City Engineer. COUNTY CONTRACT FOR ANIMAL CONTROL SERVICES Authorize Mayor and City Clerk to execute contract extension agreement as recommended by the City Administrator. CONTRACT TIME EXTENSION - SYCAMORE AVENUE PEDESTRIAN CROSSING Authorize time extension of 39 calendar days as recommended by the City Engineer. YORBA STREET WIDENING PROJECT Bob Ledendecker, City Engineer, gave the staff report and said that the residents of Yorba Street would like to make a presentation tonight. Georgia Holmstrom, 143 Yorba St., spoke for ten of the thirteen residents, stating that having received information regarding the proposed widening of Yorba Street between First Street and Irvine Blvd., they have deter- mined they do not want this done to their residences and find all aspects and alternatives to the proposal unacceptable. She asked that the Council take their feelings into consideration and decide against widening Yorba Street. Because of the many adverse results to the property on Yorba Street, it was moved by Welsh, seconded by Kennedy, that the Yorba Street Widening project (AHFP Projects 1012 and 1013) be delayed to a future date, and that the $61,700 budgeted for this project be transferred to a street maintenance program and perhaps supplemented with additional funds, so that another maintenance program can be completed this fiscal year. Carried 4-1, Saltarelli opposed. Dan Blankenship asked for an Executive Session for legal matters at 8:40 P.M. It was moved by Saltarelli, seconded by Sharp, to recess to an Executive Session at 8:40 P.M. Carried 5-0. MEETING OF TUSTIN CITY COUNCIL RECONVENED AT 9:16 P.M. January 21, 1980 i. ORDINn~,~ NO. 819 An Ordinance of the City Council of the City of Tustin, California, AMENDING ~HE TUSTIN CITY CODE TO PROVIDE FOR THE REGUI~ATION OF ADULT it was moved by Saltarelli, seconded by Sharp, that Ordinance No. 819 be continued to the next meeting of February 4, 1980. Carried 5-0. None 1. APPROVAL OF ARGUMENT REGARDING SALES TAX PROPOSITION It was moved by Saltarelli, seconded by Schuster, to eliminate the re- mainder of the Draft Argument in Favor of Proposition "B" starting with the third sentence of paragraph 4, and to substitute the following: Proposition "B", if passed, would be further evidence to the State Legislature that the people would prefer to have more of their tax money returned to local government where they will have more control over how it is spent. If enough cities in California make this desire known to our State Legislators, perhaps they will act and change the law. Vote for local control and for Proposition "B". Carried 5-0. APPROVAL OF LETTER TO JIM FRAZIER REGARDING "COM~40N MAN AND SURVIVAL" It was moved by Welsh, seconded by Saltarelli, that the City Council reject the "Common Man and Survival" film as proposed by Mr. Jim Frazier and give no support, moral, financial or otherwise. Carried 5-0. 3. YORBA STREET WIDENING PROJECT This item was heard earlier in the evening and is recorded on page 4 of these minutes. 1. CITIZEN REQUEST FOR TREE REMOVAL - 153 N. "C" Street It was moved by Saltarelli, seconded by Welsh, to remove the two parkway trees in front of 153 N. "C" Street as requested and to replace by the City, choosing a tree from the City approved list. Carried 5-0. A~POINTMENT TO BOARD OF APPEALS Dan Blankenship, City Administrator, advised that the Council had received a memo from George F. Reid, Building Official, recor~mending that Delbert D. Boyer be appointed to the Board of Appeals. It was moved by Saltarelli, seconded by Kennedy, that Delbert D. Boye~, registered civil engineer, office at 108 E. Main St., Tustin, be appointed to the Board of Appeals. Carried 5-0. ORANGE COUNTY LEAGUE OF CITIES MEETING Dan Blankenship asked the Council for confirmation that no one would be able to attend the conference in Garden Grove on Feb. 2 to discuss a number of issues ~ffecting th~ County. Council concurred that no one would be able to attend. LABOR P~LATEONS SEMINAR Councilman Welsh pointed out that he would like to attend the League's Labor Relations Seminar at the Marriott LAX Hotal on Feb. 23rd & 24th. CHA~ER OF CO~ERCE SIX MONTHS REPORT The City Administrator noted that he had received the Chamber of Commerce's first 6 months report today and that copies had been made and distributed to the Council. A report is required every 6 months under our agreement with them to keep us informed of their activities. Mayor Schuster asked staff to prepare a letter for his signature acknow- ledging receipt of the report. EXECUTIVE SESSION Mr. Blankenship requested an Executive Session for legal matters following the meeting. Council concurred. TRAFFIC PATTERNS AT NEWPORT AND FIRST Councilman Welsh asked Bob Ledendecker, City Engineer, what progress was being made on the traffic patterns at Newport and First. Mr. Ledendecker explained that final plans and specifications have gone to Cal Trans and the Federal Highway Works Administration in Sacramento for final approval and he had an indication that he would have the authoriza- tion to advertise for bids by March 1. This project would approve modi- fications of signals at Irvine and Newport, First and Newport, Main and Newport and Laguna and Newport, with a new installation at Holt and Newport. All of these signals will be interconnected. COUNCIL MINUTES Page 6, 1-21--80 VI. ADJOUP~N~ _. _ SUIT FILED AGAINST DYNACHEM Councilwoman Kennedy reported that according to the newspaper, an Orange County Fireman has filed suit against Dynachem for exposure to toxic materials, which they claim when the firemen entered the building were not there. The fireman has been incapacitated. On November 28th, she detected a scent in the air at the corner of Edinger and Newport Fwy.; on Dec. 7th, 2 complaints were phoned to her; and on January 18 and 19, she received 4 more compla~ts by phone and 2 in person. Of these, 6 were of a pungent sweet smell that caused a stinging eye and headache, and one said it smelled like broccoli. She was concerned that we had not heard the end of this odor problem. TRAFFIC LIGHT AT REDHILL AND SYCAMORE Councilman Saltarelli reported that he had had a lot of complaints about the traffic light at Redhill and Sycamore because there was so little time on Sycamore. He asked if it is now a timed intersection. Bob Ledendecker, City Engineer, clarified that the operation of the signal is such that the long time is given to Redhill traffic. Each leg of. Redhill north and south at approximately 400 ft. up the road has detectors and if a car keeps tripping it, it will continue to hold for 2 minutes. If no car trips it, it will change in about 45 seconds. Staff is in the process of looking at that particular intersection to see what modifications can be made. CENTENNIAL PAR/< AND BRIARCLIFF Councilman Saltarelli advised that Briarcliff is still being used as a parking lot for Centennial Park and the residents are still quite upset about it. All weekend and weekday afternoons the residents are not able to park on the street. The park situation is a lot better than it has been. it was moved by Kennedy, seconded by Schuster, to adjourn at 9:42 P.M. nc an Exec]tive Session and thence to the next regular meeting on February 4, 1980.
