These parcels are described by a legal description and map attached to each resolution. These parcels are more commonly described as follows: The most southerly parcel lies between and adjacent to the Don Jose Restaurant development and Newport Boulevard between Holt Avenue and the Orange County Flood Control District Channel and contains 5581.44 square feet. The most northerly parcel lies adjacent to and westerly of Newport Avenue between the Orange County Flood Control District Channel and Irvine Boulevard and cOntains 6866.42 square feet. The classification zoging on these two parcels is retail commercial. These parcels were acquired from the Southern Pacific Railroad Company at the time of the widening of Newport Avenue and the construction of the off-street bike trail. These parcels were a p~rt of the overall right-of-way acquisition, but are no longer needed for public purposes. Each parcel has only 30' of depth and no access to Newport Avenue, therefore, it is not considered developable property under the ex- isting zoning code. The Planning Agency will be acting upon a resolution at their meeting of January 21, 1980, recommending to the City Council disposition of the subject properties. WHEREAS, there is no contemplated use of the property for public right- of-way, either presently or prospectively; and WHEREAS, the hereinafter described property is not suitabl'e nor adequate for any public purpose to include a park; NOW, THEREFORE, the City Council of the City of Tustin, California re- solves as follows: It appears that the property described in Exhibit "A" and as shown on a map referred to as Exhibit "B" both which are attached and made a part hereof, is unnecessary for any present or prospective public uses. 2. It is proposed that said property be sold as excess, unused, and unneeded land. 3. The proposed action is declared as qualified as a Negative Declara- tion under the California Environmental Quality Act. A public hearing is hereby set for February 18, 1980, at 7:30 p.m. in the Chamber of the City Council at 300 Centennial Way, Tustin, California, for hearing all persons interested in being heard or objecting to the proposed sale. A copy of this resolution shall be published once a week for two weeks in the Tustin News, a newspaper of general circulation pub- lished in the City of Tustin, not tess than fifteen (15) days before said hearing, and notice of said hearing shall be posted conspicuously along the line of the portion of said property pro- posed to be sold not less than ten(lO) days before said hearing and not less than three (3) copies shall be posted.
