Reid, Building Official SUBJECT: Board of Appeals, Nomination fo Fill Vacancy The Board of Appeals, City of Tusfin, is constituted as five members appointed by the City Council. I just received information we have only four current members: ~Thomas Shoemaker, Chairman, Architect vWalfer Fredrickson, At-large fR.M. Skamnes, Engineering Contractor (cannot serve) Frank Barden, General Contractor Ralph S. Cripps, Retired Bldg. Code Adm. An appeal is fo be heard by the Board of Appeals January 30, 1980. One member, Thomas Shoemaker, has a vested interest and plans fo disqualify himself for this hearing. With three members remaining all decisions must be 3-0. This could make the case vulnerable fo legal court challenge. If would be ideal, fo avoid this possibility, fo fill the vacancy prior fo the proposed public hearing. Mr. $kamnes advised, on January 15, 1980, he had moved and can no longer serve as a member. Mr. Delberf D. Boyer, registered civil engineer, has expressed interest in ser- ving as a member of the Board of Appeals. He has his civil engineering office at 108 East Main Street, Tusfin. Mr. Boyer lives at 13272 Molena (Post office is Santa Anal, which is in the Tusfin influence area (less than a block out- side the city limits of Tustin). He is a civil engineer, graduate of Iowa State University, Class of 1956. He has practiced civil engineering in this area for over sixteen years. Mr. Boyer was recommended by Bob Ledendecker, who has known Del since 1961. Both Bob and I have reviewed many of his designs and are usually approved with- out change. The judmenf of members of boards of appeals being professionally and technically knowledgeable, such as architects/engineers/contractors, is acknowledged and accepted by most appellants and, should the appellant appeal fo the courts, the judge decides that due process of law was afforded the ap- pellant and the evidence at the public hearing justified the findings; he does not question the judgment of the members when they are architects/engineers/ contractors. I recommend Delbert D. Boyer to the Board of Appeals, City of Tusfin. Building Official
