Association (TPSSA), Tustin Municipal Employees Association

2. Confer with the City's real property negotiator for property
acquisition and litigation Agency Negotiator: Assistant City
Manager; Negotiating Parties: City of Tustin and Carolyn Louise
De Nicola, as Trustee of the B Trust of the De Nicola Family Trust
for property at 235 E. Main Street; and Walter and Marilyn Emery

Invited all to attend the Tustin Community Foundation's Mayor's
Thanksgiving Breakfast that will be held on November 20 to benefit the
Orange County Rescue Mission. Keynote speaker will be Hugh Hewitt.

RESOLUTION NO. 03-126; ACCEPTANCE OF PUBLIC
IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF
COMPLETION
Recommendation:
1. Adopt Resolution No. 03-126:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, ACCEPTING WORKS OF
IMPROVEMENT AND AUTHORIZING RECORDATION OF
NOTICE OF COMPLETION FOR THE COMMUNITY
CENTER ACOUSTICAL IMPROVEMENTS
2. Authorize the recordation of the Notice of Completion, and
direct the City Clerk to:
A. Release the Labor and Materials Bond no sooner than
thirty-five (35) days after the date of recordation of the
Notice of Completion; and
B. Release the Faithful Performance Bond no sooner than
one year after the date of recordation of the Notice of
Completion.

WATER PROGRAM DRAINAGE AREA MANAGEMENT PLAN
(DAMP) AND THE CITY'S LOCAL IMPLEMENTATION PLAN (LIP)
Recommendation: Approve the Orange County Storm Water
Program 2003 Drainage Area Management Plan (DAMP) and the
City's Local Implementation Plan (LIP)

Councilmember Davert requested clarification on permit approval.
Parks and Recreation Department Director Sanchez advised
Council that the permit process is only first step in planning event
and will require approval by TC. Councilmember Davert asked
that the application also be approved by Council. Council was
informed that both events are planned for Sundays.
Councilmember Bone indicated that the Chamber of Commerce
is in full support of events and feel that this would bring more
people to Old Town. Councilmember Thomas would like to set
policy on street closures in TC.
Recommendation: Grant facility use and public street permits upon
the successful completion of the applications and meeting
conditions of approval for the Old Town Children's Book Festival
and the Antique Car Show.
Motion by Thomas, seconded by Davert. Motion approved by a 5-0
vote.

Recommendation by the Public Works Department to introduce
and have first reading by title only of the following Ordinance:

COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING

Recommendation by the Community Development Department to
introduce and have first reading by title only of the following

ORDINANCE NO. 1280 - AN ORDINANCE OF THE CITY

OTHER BUSINESS / COMMI'I-FEE REPORTS
Councilmember Davert:
· Thanked all for success of 2003 Dinosaur Dash; and
· Invited all to participate in the Veterans Day parade next week.
Councilmember Bone:
· League of Cities preparing ballot initiative to help cities maintain taxes;
· Complement Director Sanchez on success of Halloween event; and
· Reported that the Water Advisory Council of Orange County toured
Diamond Valley Lake to observe lake that is filled with 750,000 acre feet
of water and has potential to go to 800,000; water serves a reserve
supply for Tustin among other communities.
Councilmember Thomas:
· Steve Peckett, former owner of Tustin Tires has expressed interest in
LA Fitness Center and would like to have City staff contact owner of
center to determine use;
· Noted that the Mayoral change will take place at the December 1
Council meeting; and

· Reported that the Southern California fires are 100% contained partly
due to cooler weather and snow in mountains; real outpour of
assistance both monetary and supplies, and asked all to continue to be
generous during these difficult times.
Mayor Pro Tem Kawashima:
· Armstrong Nursery groundbreaking held today and plan on opening in
Spring of 2004;
· Complemented all on success of Dinosaur Dash; and
· A recent article in the Tustin News reported on Base and have received
a lot of positive responses.
Mayor Worley Hagen:
· Dinosaur Dash great success;
· Veteran's Day parade on Sunday at 12 noon; and
· Reported that the TCA consolidation may result in a 20% reduction in
toll rates.
