HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION UNDERGROUND UTILITY DISTRICT NOS. 03-01 AND 03-02 FOR THE NEWPORT AVENUE EXTENSION, STATE ROUTE 55 NORTHBOUND RAMP RECONFIGURATION, VALENCIA AVENUE AND DEL AMC AVENUE WIDENING PROJECT - PHASE 1 (CIP NO. 7130) AND FOR THE EDINGER AVENUE ("SMART STREET") WIDENING PROJECT (CIP NO. 7147) SUMMARY The City Council, at their meeting of October 20, 2003, adopted Resolution No. 03-91, which set Monday, November 17, 2003, at 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin, California, as the time and place for a public hearing regarding the formation of Underground Utility District Nos. 03-01 and 03-02. The area of each district is generally the area bounded by Edinger Avenue on the north, the Burlington Northern and Santa Fe railroad spur line east of Del Amc Avenue on the east, Valencia Avenue on the south, and State Route 55 on the west. RECOMMENDATION It is recommended that the City Council: 1. Conduct the public hearing as noticed to determine if the public necessity, health, safety or welfare require the removal of poles, overhead wires and associated overhead structures on Edinger Avenue between State Route 55 and approximately 1,000 feet southeast of Del Amc Avenue, and on Del Amc Avenue between Edinger Avenue and Valencia Avenue. 2. At the conclusion of the public hearing, if the City Council determines that this area should be designated an underground utility district, adopt Resolution 03-129 establishing Underground Utility District Nos. 03-01 and 03-02 within the area of the City generally bounded by Edinger Avenue on the north, the Burlington Northern and Santa Fe railroad spur line east of Del Amc Avenue on the east, Valencia Avenue on the south, and State Route 55 on the west. Underground Utility District Nos. 03-01 and 03-02 for the Newport Avenue Extension, State Route 55 Northbound Ramp Reconfiguration, Valencia Avenue and Del Amo Avenue Widening Project - Phase 1 (CIP No. 7130) and for the Edinger Avenue ("Smart Street") Widening Project (CIP No. 7147) November 17, 2003 Page 2 FISCAL IMPACT Funds to construct both Underground Utility Districts are included in the Fiscal Year 2003-2004 Capital Improvement Program Budget for the Newport Avenue Extension, State Route 55 Northbound Ramp Reconfiguration, Valencia Avenue and Del Amo Avenue Widening Project-Phase 1 (CIP No. 7130), and the Edinger Avenue ("Smart Street") Widening Project (CIP No. 7147). There are two sources of funding to underground existing overhead facilities, Rule 20A funds and Rule 20B funds. Rule 20A funds are set aside funds from Southern California Edison to assist cities to underground overhead utilities. Rule 20B funds are local agency funds (in this case City of Tustin) used to underground overhead utilities. The engineering and construction cost for Underground Utility District No. 03-01 is estimated at $1,745,000 and will be funded by the City of Tustin (Rule 20B funds) from CIP No. 7130 and CIP No. 7147. Construction funds currently budgeted in CIP No. 7130 consist of Measure "M" Competitive funds, South Central Redevelopment Agency funds, Water Capital Improvement Program funds, and Developer Bond and cash payment funds. Construction funds currently budgeted in CIP No. 7147 consist of Measure "M" Competitive funds, Santa Ana-Tustin Transportation System Improvement Authority funds, and Developer Bond and cash payment funds. This funding will also be utilized to replace ten existing Edison owned street lights with ten new Edison owned street lights on marbelite poles. It is the intention of the City of Tustin to pay all costs to connect any existing overhead facilities to underground facilities at no cost to the individual property owners and these conversion costs are included in the above estimated cost. The engineering and construction cost for Underground Utility District No. 03-02 is estimated at $1,700,000 and will be funded entirely by Southern California Edison utilizing Rule 20A funds. BACKGROUND On October 20, 2003, the City Council adopted Resolution No. 03-91, which set the time and place for a public hearing to consider the designation and adoption of Underground Utility District Nos. 03-01 and 03-02 requiring the removal of poles, overhead wires and associated structures within the area of the City generally bounded by Edinger Avenue on the north, the Burlington Northern and Santa Fe railroad spur line east of Del Amo Avenue on the east, Valencia Avenue on the south, and State Route 55 on the west. Resolution No. 03-91 set the time and place for a public hearing on this matter at 7:00 P.M. on Monday, November 17, 2003, at the Tustin City Council Chambers, 300 Centennial Way, Tustin, California, 92780. The time and place of the public hearing has been duly noticed as prescribed by law. The conversion of the existing overhead utilities to underground facilities within the area of the City generally bounded by Edinger Avenue on the north, the Burlington Northern and Santa Fe railroad spur line east of Del Amo Avenue on the east, Valencia Avenue on the south, and State Route 55 on the west was covered by Final Environmental Impact Report 90-1 as revised by Final Supplement #1 which was approved by the City Council on May 5, 2003. Underground Nos. 03-01 and 03-02 for the Newport Avenue Extension, State Route 55 Northbound Ramp Reconfiguration, Valencia Avenue and Del Amo Avenue Widening Project - Phase 1 (CIP No. 7130) and for the Edinger Avenue ("Smart Street") Widening Project (CIP No. 7147) November 17, 2003 Page 3 DISCUSSION City of Tustin Ordinance 411 (Tustin City Code, Section 7500§) authorizes the City Council to call public hearings to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires, etc., within certain designated areas of the City and to consider the underground installation of the above-mentioned appurtenances for supplying electric, communication, and other similar services. At the September 18, 2000 City Council meeting, the project to underground the existing overhead facilities on Edinger Avenue between State Route 55 and approximately 1000 feet southeast of Del Amo Avenue, and on Del Amo Avenue between Edinger Avenue and Valencia Avenue was added to the City's Public Utility Commission (PUC) Rule 20A project list and established as the first priority project. The existing overhead facilities within these limits consist of both distribution lines and transmission lines. Rule 20A funds currently available from Southern California Edison are sufficient to fund only a portion of the underground costs for the transmission facilities. The remaining transmission facilities and all distribution facilities will be funded with Rule 20B funds. This project will also consist of installation of new marbelite street light poles and luminaries to replace those being removed as part of the underground work. The proposed Underground Utility District Nos. 03-01 and 03-02 provide for conversion of all overhead distribution and transmission utilities to underground utilities on Edinger Avenue between State Route 55 and approximately 1,000 feet southeast of Del Arno Avenue, and on Del Arno Avenue between Edinger Avenue and Valencia Avenue. Underground Utility District No. 03-01 provides for undergrounding of the overhead distribution facilities and a portion of the overhead transmission facilities. The cost of constructing these improvements will be funded by the City (Rule 20B funds). Underground Utility District No. 03-02 provides for undergrounding of the remaining overhead transmission facilities that can be constructed with the Rule 20A funds provided by Southern California Edison. Ordinance No. 411 also requires the City to notify all affected property owners and all concerned utilities by mail of the time and place of said hearings at least ten (10) days prior to the date of said hearing to determine whether to form an underground utility district. Notices were sent to all affected property owners and all concerned utilities by mail in the manner and time required by law. Attached for the City Council's information is a copy of the Engineer's Reports for the subject districts. The Engineer's Reports outline the extent of each utility's participation, an estimate of the total costs to the City, and a declaration that the City, on behalf of the property owner, will have the responsibility to connect any existing service meter panels to the proposed underground facilities at no cost to the property owner. The estimated time for completion of each district is 18 months, which includes 3 months for construction. The construction will be coordinated with the construction of the Newport Avenue Extension, State Route 55 Northbound Ramp Reconfiguration, Valencia Avenue and Del Arno Avenue Widening Project - Phase I (CIP No. 7130) and the Edinger Avenue ("Smart Street") Widening Project (CIP No. 7147). The roadway project schedule will include utility construction schedule windows to accommodate the construction of the underground facilities. Kasdan ' ~ Engineering Services Manager RESOLUTION NO. 03-129 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ESTABLISHING UNDERGROUND UTILITY DISTRICT NOS. 03-01 AND 03-02 WITHIN THE AREA OF THE CITY OF TUSTIN GENERALLY BOUNDED BY EDINGER AVENUE ON THE NORTH, THE BURLINGTON NORTHERN AND SANTA FE RAILROAD SPUR LINE EAST OF DEL AMO AVENUE ON THE EAST, VALENCIA AVENUE ON THE SOUTH, AND STATE ROUTE 55 ON THE WEST WHEREAS, by Resolution No. 03~91 a public hearing was called for on November 17, 2003, at the hour of 7:00 P.M. in the City Council Chambers of the City of Tustin, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires, and associated structures and the underground installation of wires and facilities for supplying electrical communication, or similar or associated service, within that certain area of the City of Tustin generally bounded by Edinger Avenue on the north, the Burlington Northern and Santa Fe railroad spur line east of Del Amo Avenue on the east, Valencia Avenue on the south, and State Route 55 on the west and shown on a map marked Exhibit "A" attached hereto. WHEREAS, notice of such hearing has been given to all affected property owners, if any, as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and time required by law; and WHEREAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that: I. The Council hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, 1) to eliminate concentrations of overhead distribution facilities, 2) to clear streets used extensively by the general public, which carry a heavy volume of vehicular traffic, and to clear streets which pass through a civic area, and 3) to facilitate the underground installation of wires and facilities for supplying electric, communication or similar or associated service in the underground districts described in Exhibit "A" attached hereto and made a part hereof by this reference, and pursuant to the provisions of Ordinance No. 411 of the City of Tustin, such area is hereby established as Underground Utility District Nos. 03-01 and 03-02. II. The City Council hereby declares its intention to order the conversion. III. The Council does hereby fix December 31, 2004 as the date on which affected property owners, if any, must be ready to receive underground service and does hereby order the removal of all poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within Underground Utility District Nos. 03-01 and 03-02, on or before May 31, 2005. The City Clerk is hereby instructed to notify all affected utilities and all persons owning real property, if any, within Underground Utility District Nos. 03-01 and 03-02 of the adoption of this resolution within ten (10) days after the date of such adoption. Said City Clerk shall further notify said property owners, if, any, of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, or other similar or associated service, they or such occupant shall, by the date fixed in this resolution provide all necessary facility changes on their premises so as to receive such service from the line of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities or file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this resolution together with a copy of said Ordinance No. 411, together with a statement that the Engineer's Report containing details of the districts are available for inspection by the public in the office of the City Clerk, to all affected property owners as such are shown on the last equalized assessment roll and to all utilities affected by this resolution. It is the intention of the City of Tustin to pay all costs to connect any existing overhead facilities to underground facilities at no cost to the individual property owners. V. The City Council hereby requests that all utilities which provide service within Underground Utility District Nos. 03-01 and 03-02 underground each property owner's service lateral, at the utility's expense in accordance with the provisions of that utility's applicable rule on file with the Public Utilities Commission. The area of the District is generally described as the area bounded by Edinger Avenue on the north, the Burlington Northern and Santa Fe railroad spur line east of Del Arno Avenue on the east, Valencia Avenue on the south, and State Route 55 on the west, more particularly described and shown on Exhibit "A" attached hereto. City of Tustin Ordinance 411 (Tustin City Code, Section 7500§) authorizes the City Council to call Public Hearings to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires, etc., within certain designated areas of the City and to consider the underground installation of the above-mentioned appurtenances for supplying electric, communication, and other similar services. Construction of both Underground Utility Districts will be coordinated with the construction of the Newpod Avenue Extension, State Route 55 Northbound Ramp Reconfiguration, Valencia Avenue and Del Arno Avenue Widening Project - Phase 1 (CIP No. 7130) and the Edinger Avenue (Smart Street) Widening Project (CIP No. 7147). Underground Utility District No. 03-01 provides for undergrounding of the overhead distribution facilities and a portion of the overhead transmission facilities. Field and telephone meetings have been held with Edison and SBC to determine the costs involved. Per the terms of the City's Franchise Agreement with Media One Cable, any overhead cable facilities within the district will be placed underground by Media One Cable, at no cost. Funding will be provided by the City under the provisions of Rule 20B. Ten (10) Edison owned street lights will be removed and ten (10) new Edison owned street lights on Page 1 of 2 marbelite poles-will be installed. The estimated cost of the proposed underground work is as follows: Distribution System Cost for conduit structure and Cable ........................................ $1,230,000 Transmission System Cost for conduit structure and Cable ........................................... $515,000 Four (4) properties will require conversion to accept underground services. Pacific Bell and Media One Cable will provide the necessary conversion at no cost to the affected property owners. Edison will stub their conduit and conductors to within 6" to 8" below the existing ground level at the building. The City, on behalf of the property owner, will have the responsibility to have an electrician extend the conduit and conductors from this location to the service meter panel and make the conversion to the underground system. All landscaping and hardscape which is removed and/or damaged as a result of construction will be replaced and/or repaired by the Edison contractor at no cost to the property owner. The following list shows the estimated expense for the Edison conversion for the four properties to be converted. 1.) 1211 Edinger Avenue (APN 430-252-08) .............................................. $1,000 2.) 1221 Edinger Avenue (APN 430-252-09) .............................................. $1,000 3.) 1231 Edinger Avenue (APN 430-263-01) .............................................. $1,000 4.) 15171 Del Amo Avenue (APN 430-251-11) ......................................... $1,000 There will be no other property owner conversion expense. All other existing private utility service lines are presently underground and/or are ready to accept underground service.
