RESOLUTION NO. 03-135; ACCEPTANCE OF PUBLIC IMPROVEMENTS AND
AUTHORIZATION TO FILE NOTICE OF COMPLETION
SUMMARY:
The Columbus Tustin Facility & Ball Field Renovation (Project No. 2048) is ready for acceptance and
filing of the Notice of Completion.
RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. 03-135, accepting said work as
complete, authorize the recordation of the Notice of Completion and direct the City Clerk to:
1. Release the Labor and Materials Bond no sooner than thirty-five days after the date of
recordation of the Notice of Completion, and
2. Release the Faithful Performance Bond no sooner than one year after the date of
recordation of the Notice of Completion.
FISCAL IMPACT:
The final cost of the construction contract for the Columbus Tustin Facility & Ball Field Renovation
including change orders was $1,309,665.60. The project was funded through an appropriation of
Capital Improvement Program and Park Development funds.
BACKGROUND&SUMMARY:
The scope of work included the demolition and construction of a restroom/concession building,
infield improvements, replacement of backstops and construction of dugouts, replacement of
perimeter fencing, upgrade of sports field lighting, landscape improvements, office renovation at
Columbus Tustin Activity Center, removal & replacement of protective netting fabric, and other
related improvements. The project was substantially complete as of November 19, 2003. The City
is retaining 10% of the contract amount that will be disbursed no sooner than thirty-five days after
the recordation of the Notice of Completion.

1. The City of Tustin is the owner in fee of the improvements hereinafter described in Paragraph 3.
2. The full name and the full address of the City of Tustin is City of Tustin, 300 Centennial Way, Tustin, CA 92780.
The work of improvement is generally described as follows:
The renovation of the Columbus Tustin Park Ball Fields, restrooms, sports field lighting, perimeter
fencing and other related improvements.
The work of improvement was completed on the 19th day of November, 2003
The name of the contractor, if any, for such work of improvement was Lehman Construction, Inc.
The property on which said work of improvement was completed is in the City of Tustin, County of Orange, State
of California, and is described as follows:
Columbus Tustin Park, 17522 Benta Way, Tustin, CA 92780

RESOLUTION NO. 03-135
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
COLUMBUS TUSTIN FACILITY & BALL FIELD RENOVATION
(PROJECT NO. 2048).
The City Council of the City of Tustin does hereby resolve as follows:
WHEREAS, Lehman Construction, Inc., having a contract with the City of
Tustin to construct the hereinafter described public works and improvements; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvements hereinafter mentioned in a manner
satisfactory to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said
public improvement hereinafter more particularly described in accordance with the
provisions of the contract documents and the Notice of Completion, and acceptance of
said public work and improvement should be filed and payment of the balance due
said contractor authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said public work and improvement be accepted, and the same is hereby
accepted. Said public work and improvement is more particularly described as
follows:

meeting held on the 1st day of December, 2003.
