HUSTON, CITY MANAGER PATRICK SANCHEZ, DIRECTOR, PARKS AND RECREATION SERVICES ADOPT A RESOLUTION FOR THE APPLICATION FOR 2002 RESOURCES BOND ACT PER CAPITA PROGRAM SUMMARY: Cities submitting applications for Per Capita Grant Program under the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002 must first submit an approved resolution from the applicant's governing body. The Bond Act would be used to fund a portion of the construction and design costs for the Lemon Tree/Citrus Ranch Park project. RECOMMENDATION: The City Council approve the application for the Per Capita Grant Program and adopt the attached Resolution No. 04-11 to support the grant request. FISCAL IMPACT: A total of $2.7M has been allocated for the design and construction of Citrus Ranch Park (Project No. 2046). Under provisions of the 2002 Resources Bond Act Per Capita Grant Program the City is eligible to receive $304,000. BACKGROUND: The Parks & Recreation Department identified the development of Citrus Ranch Park as an eligible project for Per Capita Grant Funds. The seventeen-acre site is located at Portola Parkway between Tustin Ranch and Jamboree Roads. A conceptual master plan was presented to the Planning Commission in September 25, 2000 and approved. SUMMARY: The Parks and Recreation Services Department is requesting that the City Council approve the attached resolution. Cities choosing to submit applications for Per Capita Grant Program funding under the 2002 Resources Bond Act must first submit an approved resolution from the applicant's governing body. Bond Act funding would be used to fund a portion of design and construction costs for the Citrus Ranch Park project. Construction of the park project is planned for Fiscal 04/05. WHEREAS, the people of the State of California have enacted the Per Capita Grant Program which provides funds for the acquisition and development of neighborhood, community and regional parks and recreation lands and facilities; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration of the grant program, setting up necessary procedures; and require the Per Capita Allocation, and WHEREAS, said procedures established by the California Department of Parks and Recreation the Applicant's Governing Body to certify by resolution the approval of the Applicant to apply for Capita Allocation, and WHEREAS, the Applicant will enter into a Contract with the State of California: NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin, California, hereby: 1. Approves the filing of an Application for local assistance funds from the Per Capita Grant Program under the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002; and 2. Certifies the Applicant has or will have sufficient funds to operate and maintain the Project; and 3. Certifies that the Application has reviewed, understands and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and 4. Appoints the Director of the Parks and Recreation Services Department as agent to conduct all negotiations, execute and submit all documents including, but not limited to Applications, agreements, payment requests and so on, which may be necessary for the completion of the Project.
