AWARD OF CONTRACT FOR THE CONSTRUCTION OF THE ANNUAL
MAJOR MAINTENANCE PROJECT, FY 2003-2004 (CIP NO. 7001), AND
ANNUAL SIDEWALK, CURB AND GUTTER REPAIR PROJECT, FY 2003-2004
(PROJECT NO. 402-6235)
SUMMARY
Bids for the combined Annual Major Maintenance Project, FY 2003-2004 (CIP No. 7001), and Annual
Sidewalk, Curb and Gutter Repair Project, FY 2003-2004 (Project No. 402-6235), have been received
and a construction contract is ready to be awarded.
RECOMMENDATION
It is recommended that the City Council award the construction contract for the Annual Major
Maintenance Project, FY 2003-2004 (CIP No. 7001), and Annual Sidewalk, Curb and Gutter Repair
Project, FY 2003-2004 (Project No. 402-6235), to Sequel Contractors, Inc., the Iow responsible bidder
in the amount of $633,306.70 and authorize the Mayor and the City Clerk to execute the contract
documents on behalf of the City.
FISCAL IMPACT
The FY 2003-2004 Capital Improvement Program (CIP) Budget provides $600,000 for all of the
various components in the Annual Major Maintenance Project (CIP No. 7001), including design,
construction and contract administration. The bid amount for this portion of work is $472,435.50. The
Public Works Department/Engineering Division Operating Budget for FY 2003-2004 provides
$200,000 to cover all of the costs associated with the Annual Sidewalk, Curb and Gutter Repair
Project (Project No. 402-6235). The bid amount for this portion of work is $160,871.20. Both of these
projects are part of the City's on-going Maintenance of Effort (MOE) requirement to maintain eligibility
for Measure M funding. The total bid amount for both projects is $633,306.70.
BACKGROUND
The Annual Major Maintenance Project, FY 2003-2004 (CIP No. 7001), and Annual Sidewalk, Curb
and Gutter Repair Project, FY 2003-2004 (Project No. 402-6235) were again bid as one project to
simplify the contract administration process and to reduce duplication of effort in coordination of the two
projects. Combining the two projects will reduce disruption in the areas where both projects have
construction impacts and will facilitate contract administration efforts by City staff during construction.

Bids were opened on January 6, 2004, and the seven (7) bids received are summarized as follows:

International Pavement Solutions, Inc. submitted the initial Iow bid in the amount of
$537,039.50. However, International Pavement Solutions, Inc. acknowledged that a clerical
error was committed in the preparation of their bid and requested withdrawal of the bid via
letter dated January 7, 2004. Their request for withdrawal was submitted within five days from
the bid opening date pursuant to the requirements of the Government Code and their bid bond
will be returned to them.
As a result of the bid withdrawal by International Pavement Solutions, Inc., Sequel Contractors, Inc.
becomes the lowest responsible bidder. The references and the contractor's State License for Sequel
Contractors, Inc. have been checked and are appropriate for the subject project. Sequel Contractors,
Inc. bid for the Annual Major Maintenance Project (CIP No. 7001) and for the Annual Sidewalk, Curb
and Gutter Repair Project (Project No. 402-6235) is about 8% above the engineer's estimate of
$585,000. The bid amount is higher than the engineer's estimate due to the recent increase in oil
prices which directly effects the price of asphalt concrete paving. There are, however, sufficient funds
within the two project budgets to accommodate the cost of this work.
