A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN APPROVING FINAL PARCEL MAP 2003-131 TO
RESUBDIVIDE A 4.09 ACRE SITE LOCATED AT THE
NORTHEAST CORNER OF EL CAMINO REAL AND SIXTH
STREET INTO FOUR (4) NEW PARCELS FOR THE
PURPOSE OF DEVELOPING A GARDEN CENTER ON A
1.47-ACRE PARCEL AT THE NORTHWEST OF THE
PROPERTY
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:
Final Parcel Map 2003-131 was submitted by John A. and Mary Prescott L.P.
and Armstrong Garden Center requesting to resubdivide a 4.09 acre site
(located at the northeast corner of El Camino Real and Sixth Street) into four
(4) new parcels to develop a garden center on a 1.47-acre parcel at the
northwest of the property;
The Planning Commission recommended that the City Council approve
Tentative Parcel Map 2003-131 on July 14, 2003, and the City Council
approved Tentative Parcel Map 2003-131 on July 21,2003;

The proposed subdivision is in conformance with the Tustin Area General Plan,
Tustin Zoning Code, State Subdivision Map Act, the City's Subdivision Code,
and has been determined to be consistent with the General Plan and the
General Plan Air Quality Sub-Element;
The site is physically suitable for the type of development proposed and the
proposed density;
The design of the proposed improvements is not likely to cause substantial
environmental damage or substantially and avoidably injure fish or wildlife in
their habitat;
The types of improvements proposed are not likely to cause public health
problems;
All necessary easements and dedications have been shown on the map. A
designated area for access, utilities, and a slope control area would be
established across the four parcels with recordation of a covenant concurrent
with the final map, and,
Final Parcel Map 2003-131 is Categorically Exempt (Class 15) from the
provisions of the California Environmental Quality Act pursuant to Section
Resolution No. 04-14

15315 of Title 14, Chapter 3 of the California Code of Regulations (Guidelines
for the California Environmental Quality Act).
II. The City Council hereby approves Final Parcel Map 2003-131 to resubdivide a 4.09
acre site (located at the northeast corner of El Camino Real and Sixth Street) into four (4)
new parcels to develop a garden center on a 1.47-acre parcel at the northwest of the
property, subject to final review and approval by the City Engineer and the City Attorney
prior to recordation.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the
20th day of January 2004.
