ORD. 02-02-04AGENDA REPORT Agenda Item 12 Reviewed: ~' City Manager Finance Director N/A MEETING DATE: FEBRUARY 2, 2004 TO: FROM: SUBJECT: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL CITY ATTORNEY ORDINANCE AMENDING THE TUSTIN CITY CODE PERTAINING TO THE PARKS AND RECREATION COMMISSION SUMMARY: The proposed Ordinance WOuld conform the size of the Parks and Recreation Commission to other City Commissions and Committees, including the City Council, at the end of expiring terms in March of 2004. While it would limit the number of positions available for appointment in March, no person currently serving on the Commission would have their term shortened. DISCUSSION: With the exception of the Parks and Recreation Commission, all Official City Commissions, Committees, and the City Council consist of five members. The Parks and Recreation Commission was augmented to seven members some time in the distant past at the special request of one Councilmember who wished to add additional appointees. Given the current and likely on-going City budgetary constraints, one way of streamlining City operations is to conform the size of the Parks and Recreation Commission to the size of other Committees, Commissions, and City Council. If approved, the attached ordinance would reduce the size of the Commission at the end of the current terms of three appointees. (Three members who were appointed in 2002 have terms expiring on March 1, 2004.) The Ordinance would provide that those persons continue to serve until a new member is appointed. This would immediately reduce the size of the Commission to five members. In order to stager terms, the Ordinance also provides that in March of 2005, when four members are up for re-appointment, that one of the four new appointees have a term of one year or until March 1, 2006. After the completion of that term, the Council would be in a position to have staggered 2-year terms for all five members. For your information, the current members of the Parks and Recreation Commission and the expiration date of their terms are also attached. 180603.1 As a practical matter, members whose terms will be expiring March 1, 2004 will be able to serve until at least March 16, 2004, which is when this Ordinance becomes effective. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTIONS OF THE TUSTIN CITY CODE PERTAINING TO THE PARKS AND RECREATION COMMISSION The City Council of the City of Tustin hereby ordains as follows: SECTION 1. Section 1552 of the Tustin City Code entitled, Members, is hereby amended to read as follows: The Parks and Recreation Commission shall consist of seve~fiW (75) members who shall be residents of the City during all times they hold office. SECTION 2. Section 1553 of the Tustin City Code entitled, Appointments and Terms, is hereby amended to read as follows: Members of the Parks and Recreation Commission shall be appointed by the City Council. Any member of the Parks and Recreation Commission who has served three full (3) consecutive terms shall not be reappointed as a member of the Parks and Recreation Commission for at least one (1) year from the last date of the third consecutive term. All members of the Commission shall serve at the pleasure of the City Council and may be removed upon motion of the City Council adopted by at least three (3) affirmative votes. All members of the Commission shall serve until their respective successors are appointed and qualified. SECTION 3. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Tustin hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
