A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
3 AUTHORIZING APPLICATION FOR FUNDS FOR THE TRANSPORTATION
4 ENHANCEMENT ACTIVITY PROGRAM UNDER THE 1998 TRANSPORTATION
EQUITY ACT FOR THE 21 ST CENTURY FOR TUSTIN OLD TOWN
5 STREETSCAPE IMPROVEMENT PROJECT.
6 WHEREAS, the United States Congress in June 1998 enacted the Transportation Equity Act
7 (TEA) for the 21~t Century, replacing the expired Intermodal Surface Transportation Efficiency
Act of 1991 which makes funds available to the Orange County Transportation Authority
8 (OCTA) for transportation enhancement activities; and
9 WHEREAS, OCTA has established the procedures and cfiteri//Tor reviewing nominations and
10 applications for TEA funds; and
11 WHEREAS, the City of Tustin possesses authority to nominate transportation enhancement
activities for TEA funding and to finance, acquire, and construct the proposed project with
12 matching funds.

NOW, THEREFORE, BE IT RESOLVED

1_. That the City of Tustin hereby authorizes the Director of Public Works/City Engineer to
15 act as the official representative of the City of Tustin and to apply for the Transportation
Enhancement Activities Program of the Tustin Old Town Streetscape Improvement
16 Project. The City's representative is authorized to execute whatever documents are
17 required to receive' funds under the TEA program under the Transportation Equity Act for
the 21't Century for the Tustin Old Town Streetscape Improvement Project.

2. The City of Tustin will maintain and operate the property acquired, developed.
19 rehabilitated, or restored for the life of the resultant facility(ies) or activity.

3. With the approval of the California Department of Transportation (CalTrans) and OCTA,
21 the. City of Tustin or its successors in interest in the property may transfer the responsibility
to maintain and operate the property.

23 4. The City of Tustin will give the CaiTrans and OCTA representatives access to and the right
to examine all records, books, papers or documents related to the nominated transportation
24 enhancement activity.
25 5. The City of Tustin will cause work on the project to be commenced within a reasonable
time after receipt of notification funds have been approved and that the project will be

carded to completion with reasonable diligence.

6. The City of Tustin will comply where applicable with provisions of the California
9_ Environmental Quality Act, the National Environmental Policy Act, the American with
~1 Disabilities Act, the Secretary of Interiors Standards and Guidelines for Archeological and
Historic Preservation, and any other applicable federal, state, and/or local laws, rules
4 and/or regulations.
5 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held
on the 20th day of September 1999.
