RECOMMENDATION
That the Planning Commission adopt Resolution No. 3907 determining that the location,
purpose, and extent of proposed water quality testing, health inspection, and plan
checking services within an existing 51,105 square foot building located at 2642 Michelle
Drive is in conformance with the Tustin General Plan.

BACKGROUND
Section 65402(b) of the California Government Code (Planning and Development Law)
requires counties to inform and obtain general plan conformity determinations from local
planning agencies prior to authorizing use for a public building within the local planning
agencies' jurisdiction. The Planning Commission is authorized to determine whether the
location, purpose, and extent of the proposed facility are consistent with the General Plan.
The County of Orange Health Care Agency is proposing to lease or possibly purchase an
existing 51,105 square foot building at 2642 Michelle Drive to accommodate their water
quality testing, health inspection, and plan checking services facility (Attachment A -
Location Map). The County previously considered a building at 14511 Myford Road
which was determined by Planning Commission on June 24, 2002, through Resolution
No. 3835, to be in conformance with the City's General Plan. The County, however, is no
longer interested in that site and now is considering the location at 2642 Michelle Drive. At
the new location the County would occupy the entire building and would have
approximately 150 to 200 Health Care Agency employees. (Attachment B - Letter/Site
and Floor Plans).
DISCUSSION
Both the previously considered and proposed sites are located within the General Plan
"Planned Community Commercial/Business" land use designation and the Irvine Industrial
Complex Planned Community District. The "Planned Community Commercial/Business"
land use designation provides opportunities for a mixture of industrial, commercial, and
office activities. The specific land uses and development standards are regulated by the
Irvine Industrial Planned Community District regulations.
The proposed building is currently vacant and surrounded to t he east north, west, and
south with industrial business complexes under the same general plan land use and
zoning designations. Since the primary purpose of the use would be to provide water
quality testing, health inspection services, and plan checking services within an existing
building that, has adequate access/office parking and previously accommodated a similar
office and industrial use; the proposed location, purpose, and extent of the use is
consistent with the General Plan land use designation and the permitted uses within the
Irvine Industrial Planned Community District.
In addition, the purpose of the use as a public service facility is consistent with the
following General Plan policy:
Policy 8.1:
Encourage within economic capabilities, a wide range of accessible public
facilities and community services, including fire, police, and other
governmental and municipal services.

Based upon the above discussion, staff recommends that the Planning Commission adopt
Resolution No. 3907 (Attachment C) determining that the location and purpose of the
proposed water quality testing, health inspection, a nd plan checking services within an
existing 51,105 square foot building located at 2642 Michelle Drive is in conformance with
the Tustin General Plan.

Pursuant to Government Code Section 65402, you are hereby given notice that the County of
Orange is considering leasing or purchasing approximately 52,000 square feet of space in an
existing building located at 2642 Michelle Drive in the City of Tustin.
This program provides offices for plan checking for restaurant facilities, water quality testing,
and provides inspectors for underground storage tanks, waste disposal, pool sanitation, mobile
food vendors, hazardous waste and various other State mandated programs. Please review this
proposal and detennine if the use confonns to the City's General Plan. To simplify processing,
you may complete the bottom portion of this letter and return it to me.
This site would replace, and not be in addition to, the 14511 Myford Road building, which
we noticed your office by letter dated, May 21, 2002, which your Planning Commission
approved on June 24, 2002.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN DETERMINING THAT THE
LOCATION, PURPOSE, AND EXTENT OF THE
PROPOSED FACIL TIY TO PROVIDE WATER QUALITY
TESTING, HEALTH INSPECTION, AND PLAN CHECKING
SERVICES WITHIN AN EXISTING 55,105 SQUARE FOOT
BUILDING AT 2642 MICHELLE DRIVE CONFORMS WITH
THE TUSTIN GENERAL PLAN.
The Planning Commission does hereby resolve as follows:
I.
A.
The Planning Commission finds and determines as follows:
That the County of Orange Health Care Agency proposes to lease
an existing approximately 55,105 square foot building located at
2642 Michelle Drive to provide water quality testing, health
inspection, and plan checking services.
B.
That the County previously considered a building at 14511 Myford
Road which was determined by the Planning Commission on June
24, 2002, through Resolution No. 3835, to be in conformance with
the City's General Plan. However, the County wishes to substitute
the previously approved site with the new site at 2642 Michelle Drive.
C.
That the site is located within the General Plan "Planned Community
Commercial/Business" land use designation and the Irvine Industrial
Complex Planned Community District. Together, these general plan
and zoning designations provide for a variety of light industrial uses
and their support offices and services. The location, purpose, and
extent of a water quality testing, health inspection, and plan checking
facility within an existing 55,105 square foot building with adequate
access and parking is consistent with the "Planned Community
Commercial/Business" general plan land use designation and
permitted uses within the Irvine Industrial Complex Planned
Community District. In addition, the purpose of the proposed use is
consistent with the following General Plan policy:

D.
That California Government Code Section 65402 (b) provides that a
county shall not authorize a public building within the corporate limits
of a city until the location, purpose, and extent of the project has
been reported by the local planning agency as to the conformity with
the applicable, adopted general plan.
E.
That this project is categorically exempt (class 1) pursuant to the
provisions of Section 15301 of the California Environmental Quality
Act.
II.
The Planning Commission hereby determines that the location, purpose,
and extent of the proposed facility to provide water quality testing, health
inspection, and plan checking services within an existing 55,105 square foot
building located at 2642 Michelle Drive conforms with the Tustin General
Plan.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a
regular meeting held on the 23rd day of February, 2004.
