to be routine by the City Council and will be enacted by one
motion without discussion. Persons wishing to speak

APPROVAL OF MINUTES - REGULAR AND SPECIAL MEETING MINUTES OF
FEBRUARY 17, 2004
Recommendation: Approve the City Council Minutes of February 17, 2004.
2.
APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $291,888.92; and
$354,600.48 and reversals in the amount of $725.21; and ratify Payroll in the
amount of $485,055.84
3.
APPROVAL OF AN AGREEMENT BETWEEN THE CITY OF TUSTIN, WL
HOMES LLC, AND THE SALVATION ARMY
Recommendation: Subject to non-substantial modifications as may be
determined necessary by the City's Special Counselor the City Manager prior
to execution by all parties, approve and authorize the City Manager, or
designee to execute the Agreement between the City of Tustin, WL Homes
LLC, and the Salvation Army and to carry out all actions necessary to
implement the Agreement including the execution of all related documents.

DESTRUCTION OF RECORDS - HUMAN RESOURCES DEPARTMENT
Recommendation: Adopt resolution.
RESOLUTION NO. 04-27 - A resolution of the City Council of the City of
Tustin, California authorizing the destruction of certain city records and
papers in the possession of the Human Resources Department of the City
of Tustin no longer required for the conduct of city business, pursuant to
the authority granted by the City of Tustin's Records Retention Schedule

ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE
THE NOTICE OF COMPLETION FOR THE IRVINE BOULEVARD STORM
DRAIN PROJECT - PHASE I (CIP NO. 5024)
Recommendations:
5.a.
Adopt resolution.
RESOLUTION NO. 04-25 - A resolution of the City Council of the City of
Tustin, California, accepting the works of improvement and authorizing
the recordation of the Notice of Completion for the Irvine Boulevard Storm
Drain Project - Phase I (CIP No. 5024)
5.b.
Authorizing the recordation of the Notice of Completion, and direct the City
Clerk to:
1.
Release the Labor and Materials Bond not sooner than thirty-five (35)
days after the date of recordation of the Notice of Completion; and
2.
Release the Faithful Performance Bond not sooner than one year
after the date of recordation of the Notice of Completion.
5.c.
Assuming no claims or stop payment notices are filed, it is further
recommended that thirty-five (35) days after the date of recordation of
the Notice of Completion, the City Council authorize payment of the final
10% retention in the amount of $73,278.54 to Radich Construction Inc.
6.
SOLICITATION OF DESIGN SERVICES FOR THE PROPOSED TUSTIN
LIBRARY
Recommendation: Authorize the Assistant City Manager to solicit proposals for
design services associated with the proposed new Tustin Library.

7.
WORKERS COMPENSATION CLAIMS SETTLEMENT AUTHORITY
Recommendation: Adopt resolution.
RESOLUTION NO. 04-19 - A resolution of the City Council of the City of
Tustin, California, authorizing the City Manager or the City Manager's
designees to settle workers compensation claims up to the limit of the
City's self-insured retention
8.
DECLARATION OF SURPLUS PROPERTY
Recommendations:
8.a.
Declare the listed equipment and furniture surplus and not required for
public use;
8.b.
Authorize staff to sell/have auctioned serviceable equipment of value and
otherwise dispose of assets beyond repair; and
8.c.
Authorize staff to dedicate any auction or sales proceeds to the
maintenance of the Senior Center Computer Lab.
9.
PLANNING COMMISSION ACTION AGENDA
All actions of the Planning Commission become final unless appealed by the City
Councilor member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of February 9,
2004.

CONCERNING THE USE OF THE MELLO-ROOS COMMUNITY FACILITIES
ACT OF 1982
Recommendations:
10.a. Adopt resolution; and

RESOLUTION NO. 04-28 - A resolution of the City Council of the City of
Tustin, California, adopting Local Goals and Policies for Mello-Roos
Community Facilities Districts
10.b. Direct staff to proceed with establishment of Community Facilities Districts
on the Tustin Legacy project.
