TO FILE THE NOTICE OF COMPLETION FOR THE IRVINE
BOULEVARD STORM DRAIN PROJECT - PHASE I (CIP NO. 5024)
SUMMARY
Construction of the Irvine Boulevard Storm Drain Project - Phase I (CIP No. 5024) has been
completed to the satisfaction of the City Engineer and is now ready for City Council
acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 04-25 accepting the Irvine
Boulevard Storm Drain Project - Phase I (CIP No. 5024), and authorizing the recordation of
the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion; and
Assuming no claims or stop payment notices are filed, it is further recommended that thirty-
five (35) days after the date of recordation of the Notice of Completion, the City Council
authorize payment of the final 10% retention in the amount of $73,278.54 to Radich
Construction Inc.
FISCAL IMPACT
The final construction contract cost for the Irvine Boulevard Storm Drain Project - Phase I
(CIP No. 5025) is $732,785.41. The project was funded by the City's Capital Improvement
Program.
Project construction along with design and construction management has increased the City's
infrastructure assets by $601,226.00. The increased infrastructure valuation will be added to the
City's infrastructure inventory as required by Statement 34 of the Govemmental Accounting
Standards Board (GASB 34). Detailed cost information is shown on the attached GASB 34
Infrastructure Inventory Valuation Form.

BACKGROUND AND DISCUSSION
The construction of the Irvine Boulevard Storm Drain Project - Phase I (CIP No. 5024) was
completed on December 19, 2003. The project involved construction of a pipeline outlet structure
at the EI Modena-Irvine Channel and construction of 72" storm drain pipe, across Newport
Avenue, through easement property located within the Tustin Corporate Center, along Irvine
Boulevard, and terminating just west of Holt Avenue. An agreement to address mitigation of the
construction impacts was approved with the affected easement holders in November of 2002. In
accordance with this agreement, alternative parking and accessibility were provided during
construction and the affected parking lot was improved to a condition exceeding its original state.
In addition, the property manager representing the affected commercial center has provided a
letter to the City indicating their satisfaction with the work and the terms of the aforementioned
agreement. The Orange County Permit and Subdivision Inspection Division has also confirmed
their acceptance of the work via signature approval. All of the work for this project has been
completed to the satisfaction of the City Engineer, and is now ready for City Council acceptance.

RESOLUTION NO. 04-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE IRVINE BOULEVARD STORM DRAIN
PROJECT - PHASE I (CIP NO. 5024)
WHEREAS, Radich Construction, Inc., having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:
Irvine Boulevard Storm Drain Project - Phase I (CIP No. 5024)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 1st day of March 2004.
