It was moved by Councilmember Davert, seconded by Mayor Pro Tem Bone, to approve
Consent Calendar items 1 through 9 as recommended by staff. Motion carried 5-0.

APPROVAL OF MINUTES - REGULAR AND SPECIAL MEETING MINUTES OF
FEBRUARY 17, 2004
Motion: Approve the City Council Minutes of February 17, 2004.
2.
APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Motion: Approve Demands in the amount of $291,888.92; and $354,600.48 and
reversals in the amount of $725.21; and ratify Payroll in the amount of
$485,055.84

APPROVAL OF AN AGREEMENT BETWEEN THE CITY OF TUSTIN, WL
HOMES LLC, AND THE SALVATION ARMY

Motion: Subject to non-substantial modifications as may be determined
necessary by the City's Special Counselor the City Manager prior to execution
by all parties, approve and authorize the City Manager, or designee to execute
the Agreement between the City of Tustin, WL Homes LLC, and the Salvation
Army and to carry out all actions necessary to implement the Agreement
including the execution of all related documents.
4.
DESTRUCTION OF RECORDS - HUMAN RESOURCES DEPARTMENT
Motion: Adopt resolution.
RESOLUTION NO. 04-27 - A resolution of the City Council of the City of
Tustin, California authorizing the destruction of certain city records and
papers in the possession of the Human Resources Department of the City
of Tustin no longer required for the conduct of city business, pursuant to
the authority granted by the City of Tustin's Records Retention Schedule

ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE
THE NOTICE OF COMPLETION FOR THE IRVINE BOULEVARD STORM
DRAIN PROJECT - PHASE I (CIP NO. 5024)
Motion:
5.a.
Adopt resolution.
RESOLUTION NO. 04-25 - A resolution of the City Council of the City of
Tustin, California, accepting the works of improvement and authorizing
the recordation of the Notice of Completion for the Irvine Boulevard Storm
Drain Project - Phase I (CIP No. 5024)
5.b.
Authorizing the recordation of the Notice of Completion, and direct the City
Clerk to:
1.
Release the Labor and Materials Bond not sooner than thirty-five (35)
days after the date of recordation of the Notice of Completion; and
2.
Release the Faithful Performance Bond not sooner than one year
after the date of recordation of the Notice of Completion.
5.c.
Assuming no claims or stop payment notices are filed, it is further
recommended that thirty-five (35) days after the date of recordation of
the Notice of Completion, the City Council authorize payment of the final
10% retention in the amount of $73,278.54 to Radich Construction Inc.

6.
SOLICITATION OF DESIGN SERVICES FOR THE PROPOSED TUSTIN
LIBRARY
Motion: Authorize the Assistant City Manager to solicit proposals for design
services associated with the proposed new Tustin Library.
7.
WORKERS COMPENSATION CLAIMS SETTLEMENT AUTHORITY
Motion: Adopt resolution.
RESOLUTION NO. 04-19 - A resolution of the City Council of the City of
Tustin, California, authorizing the City Manager or the City Manager's
designees to settle workers compensation claims up to the limit of the
City's self-insured retention
8.
DECLARATION OF SURPLUS PROPERTY
Motion:
8.a.
Declare the listed equipment and furniture surplus and not required for
public use;
8.b.
Authorize staff to sell/have auctioned serviceable equipment of value and
otherwise dispose of assets beyond repair; and
8.c.
Authorize staff to dedicate any auction or sales proceeds to the
maintenance of the Senior Center Computer Lab.
9.
PLANNING COMMISSION ACTION AGENDA
All actions of the Planning Commission become final unless appealed by the City
Councilor member of the public.
Motion: Ratify the Planning Commission Action Agenda of February 9, 2004.
REGULAR BUSINESS

CITY OF TUSTIN RESOLUTION NO. 04-28 ADOPTING GOALS AND POLICIES
CONCERNING THE USE OF THE MELLO-ROOS COMMUNITY FACILITIES

Motion:
10.a. Adopt resolution; and
RESOLUTION NO. 04-28 - A resolution of the City Council of the City of
Tustin, California, adopting Local Goals and Policies for Mello-Roos
Community Facilities Districts
10.b. Direct staff to proceed with establishment of Community Facilities Districts
on the Tustin Legacy project.
It was moved by Mayor Kawashima, seconded by Councilmember Thomas to
approve as recommended by staff. Motion carried 5-0.
11.
SET INTERVIEW DATE FOR PLANNING AND PARKS & RECREATION
COMMISSION VACANCIES
Council unanimously concurred to set the date for interviews to fill vacancies on
the Planning Commission, and Parks & Recreation Commission on March 15,
2004 at 5:15 p.m.

OTHER BUSINESS / COUNCIL REPORTS
Councilmember Davert:
. Requested adjournment of meeting in memory of Barbara Benson's recent passing;
. Announced that the Orange County Vector Control voted to terminate the Fire Ant
Program;
. Reminded everyone to vote at tomorrow's Primary Election;
. Announced that cellular telephone service would be available on 241/261 toll roads;
. Stated Mayor Kawashima was on the local news in regards to Tustin Field Homes; and
. Wished a Happy Birthday to daughter Grace.
Councilmember Hagen:
. Announced that the Transportation Corridor Agency was looking at alternatives to
merging the two toll roads; and
. Orange County Fire Authority was considering a ballot measure to share Proposition
172 Public Safety Funds with Orange County Sheriff Department and District Attorney
to avoid potential financial problems in the near future.
Mayor Pro Tem Bone:
. Also requested adjournment of meeting in memory of Barbara Benson;
. Attended John Laing Homes Neighborhood Fair over the weekend; 10,000 people
were there for the chance to purchase 300 new homes being built at MCAS, Tustin;
and

. Orange County Council of Governments - recently approved 2004 projections on
housing, jobs and population; complimented staff who worked on project.
Mayor Kawashima:
. Commented that the John Laing event at MCAS, Tustin was a winning project;
. Stated that the Orange County Sanitation District would be replacing sewer systems in
near future, the sewers were over 50 years old;
. Attended Eagle Scout ceremony for Ralph Cipriano at Aldersgate Church;
. Reminded everyone to vote tomorrow;
. Remarked his 6th grade son was elected Student Council Vice President of his school;
. Mentioned Cox Cable users had complained that audio system was not audible;
. Requested quarterly progress reports on departmental projects; and
. Adjourned meeting in memory of Barbara Benson.
ADJOURNMENT - 7:20 P.M. - The next regular meeting of the City Council was
scheduled for Monday, March 15, 2004, at 5:15 p.m. in the Council Chamber at 300
Centennial Way, Tustin.
