APPROVAL OF MINUTES - FEBRUARY 23, 2004,
PLANNING COMMISSION MEETING.
It was moved by Pontious, seconded by Nielsen, to approve the
Consent Calendar. Motion carried 5-0.
PUBLIC HEARINGS
Adopted Resolution 2.
No.3908
CONDITIONAL USE PERMIT 04-003 REQUESTING
AUTHORIZATION TO ALLOW A VETERINARY OFFICE
THAT WOULD TREAT DOMESTIC ANIMAL CANCER.
THIS PROJECT IS LOCATED AT 2887 EDINGER
AVENUE, BUILDING 15, IN THE PLANNED COMMUNITY
INDUSTRIAL (PC-IND) ZONING DISTRICT.
RECOMMENDATION:
That the Planning Commission adopt Resolution No. 3908
approving Conditional Use Permit 04-003.

Presented the staff report.

Director
Noted that staff will deal with applicants on a case-by-case basis
and asked for consideration of the resolution only, rather than the
recommended action in the staff report.

Verified with staff that the business hours are 9:00 a.m. to 7:00
p.m.
Amante
Asked if there is an oncology center for veterinary care in this
center.
Peterson
Answered there is one oncology specialist.
Amante
Asked if that facility provides service for all pets.
Peterson
Stated staff is not certain about the types of animals that are
treated.
Pontious
Verified with staff that this applicant is already doing business in
the center and is simply moving the location and that there are a
total of six veterinary facilities within Jamboree Plaza.
Ortlieb
Indicated that approval of this application would bring the total to
seven.
Nielsen
Asked whether or not there is any inkling of future applications for
veterinary uses.
Peterson
Answered in the negative.
Nielsen
Asked if the center is at full leasing capacity.
Peterson
Indicated staff has not heard the current vacancy rate, but the
center seems to be at capacity.
Amante
Stated it is the mix of specialty veterinary services that makes the
Jamboree Plaza practices attractive; and, added that Tustin is
becoming known as a place to bring seriously ill or injured
animals due to the high degree of critical care available.
Director
Indicated that a concern was that Jamboree Plaza was supposed
to be serving the commuter rail facility; staff was concerned that
the purpose, intent, and nature of the facility was changing.
Nielsen
Suggested that the mix may change during the course of the
Legacy's development.
Pontious
Indicated that the needs of the community are being met with the
facilities that exist now.

Invited the applicant to the lectern.
Stated the applicants will be owner/occupants and look forward to
treating more dogs and cats with cancer; the treatment is similar
to treating humans; the collaborative nature of the center is
becoming a popular trend across the country; the animals can be
reviewed and evaluated for all types of related disorders and
treated in the same area, which benefits the clients and the pets.
Asked what specialties are not currently represented at the
center.
Responded that cardiology is one and perhaps certain surgical
specialties.
Asked if there is an exotic pet specialist there now.
Answered in the negative.
The Public Hearing closed.
It was moved by Pontious, seconded by Nielsen, to adopt
Resolution No. 3908. The motion carried 5-0.
REGULAR BUSINESS
STAFF CONCERNS

REPORT OF ACTIONS TAKEN AT THE MARCH 1, 2004,
CITY COUNCIL MEETING.
The interviews have been set at 5:15 p.m., March 15,2004, for the
Planning Commission vacancies.
COMMISSION CONCERNS
Stated it was his honor and pleasure to work with Linda Jennings
on the Planning Commission; the City should be thankful to have
her in its midst.
Indicated several residents have expressed major concerns
regarding the Red Hill and 1-5 freeway expansion project, especially
during the morning hour traffic around the Starbucks center when
students are walking to Tustin High School; and, asked if Public
Works has any contingency plans to alleviate the vehicular and
pedestrian congestion.

In Memory of
Barbara Benson
Asked that the meeting be adjourned in memory of Barbara
Benson, one of the great citizens of Tustin whose civic involvement
was quite amazing.
Added that the pedestrian traffic is one of the most dangerous
elements of the Red Hill/El Camino Real intersection.
Expressed his feeling of honor in sitting on the Planning
Commission with Linda Jennings.
Referred to her long history of involvement with Chairperson
Jennings in many endeavors; and, stated it was a joy to serve on
the Planning Commission with her.
Added his congratulations and thanks to Linda Jennings for her
service to the City and to the Planning Commission.
Congratulated all the people who voted; noted the defeat of
Proposition 56; and, stated everyone must remain vigilant regarding
the funding of local government in the future.
Stated it was an honor and a privilege to serve on the Planning
Commission; indicated she learned a great deal about land use,
government, and politics which was enlightening; added that it was
a joy to get to know and work with everyone on the Planning,
Engineering/Public Works, and legal staffs; and, thanked everyone
for their assistance during her experience.
Noted that she worked with Barbara Benson for many years; she
was an extraordinary woman who will be missed.
ADJOURNMENT
The next regular meeting of the Planning Commission is scheduled
for Monday, March 22, 2004, at 7:00 p.m. in the Council Chamber
at 300 Centennial Way.
