CALL TO ORDER — Meeting #2404 at 7:12 p.m. PRESENTATION OF COLORS, INVOCATION AND PLEDGE OF ALLEGIANCE — American Legion ROLL CALL — City Clerk Present: Mayor Dr. Allan Bernstein, Mayor Pro Tem Murray, and Councilmembers Rebecca Gomez, Charles E. Kendig, City Attorney CLOSED SESSION REPORT — City Attorney David E. Kendig: The City Council unanimously denied Claim No. 16-19. Other than that, there was no reportable action. PRESENTATIONS — Mayor Bernstein presented a Certificate of Recognition to Master Reserve Officer George Vallevieni in honor of being a Gem of Tustin. Mayor Bernstein provided a PowerPoint presentation of his 2017 Goals. ORAL COMMUNICATION/PUBLIC INPUT — None CONSENT CALENDAR ITEMS 1-6 It was moved by Councilmember Puckett and seconded by Mayor Pro Tem Murray to pull Item No. 4, as requested by Mayor Pro Murray, and approve the balance as recommended by staff. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD ON DECEMBER 20, 2016 AND THE SPECIAL CLOSED SESSION MEETINGS HELD ON DECEMBER 20, 2016 Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on December 20, 2016 and the Special Meetings held on December 20, 2016. 3. RATIFICATION OF DEMANDS AND RATIFICATION OF PAYROLL The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: That the City Council approve Payroll in the amounts of $723,564.43 and $1,285,784.85; and demands in the amount of $4,792,460.37. 4. APPROVE COOPERATIVE AGREEMENTS WITH THE CITY OF IRVINE FOR THE TUSTIN RANCH ROADIVON KARMAN AVENUE AND EDINGER AVENUE/IRVINE CENTER DRIVE REGIONAL TRAFFIC SIGNAL SYNCHRONIZATION PROJECTS (PROJECT P) Staff is requesting that the City Council approve the Cooperative Agreements with the City of Irvine for implementation of the Tustin Ranch RoadNon Karman Avenue and Edinger Avenue/Irvine Center Drive Regional Traffic Signal Synchronization Projects. Engineering and construction will be performed in collaboration with and led by the City of Irvine. Work will be performed under the OCTA Competitive Measure M2 Regional Traffic Signal Synchronization Program (Project P). It was moved by Mayor Pro Tem Murray and seconded by Councilmember Puckett to approve the Cooperative Agreements with the City of Irvine for the Tustin Ranch RoadNon Karman Avenue and Edinger Avenue/Irvine Center Drive Regional Traffic Signal Synchronization Projects, authorize the Mayor and City Clerk to execute the agreement on behalf of the City, and amend the adopted Capital Improvement Program for Fiscal Year 2016117 to appropriate Gas Tax (Fund 130) in lieu of Measure M2 Fair Share (Fund 139) for both projects. SALARY RESOLUTION FOR UNREPRESENTED PART-TIME NON - BENEFITTED EMPLOYEES Adoption of the attached Resolution will authorize terms and conditions of employment for unrepresented Part -Time Non -Benefitted employees in accordance with California state law. Motion: That the City Council adopt Resolution No. 17-02 amending the City's Classification and Compensation Plan for unrepresented Part -Time Non - Benefitted employees. RESOLUTION NO. 17-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN RELATING TO COMPENSATION FOR UNREPRESENTED PART-TIME NON - BENEFITTED EMPLOYEES AND SUPERSEDING RESOLUTION 15-47 6. CITY COUNCIL APPROVAL OF AN AMENDED ADMINISTRATIVE BUDGET AND AUTHORIZATION TO ENTER INTO AN ELEVENTH AMENDED AGREEMENT BETWEEN THE CITY AND SUCCESSOR AGENCY FOR ADMINISTRATIVE SUPPORT City Council approval is requested of an amended Administrative Budget and authorization for the City and Successor Agency to enter into an Eleventh Amended Agreement for reimbursement of administrative support. Motion: That the City Council approve and authorize the City to enter into an Eleventh Amended Agreement for Reimbursement of Costs and City/Successor Agency Operations Loan with the City acting as Successor Agency to the Tustin Community Redevelopment Agency. REGULAR BUSINESS ITEMS 7-10 7. WATER CONSERVATION UPDATE - NOVEMBER 2016 As a result of the drought, the City of Tustin is required to provide the State Water Resources Control Board with a monthly report regarding water consumption and restrictions. This report summarizes the information provided to the State for the month of November 2016 and provides the City Council and the public with general information on previous and upcoming actions taken by the City. It was moved by Mayor Pro Tem Murray and seconded by Councilmember Puckett to receive and file this report. City Council January 17, 2016 Meeting Minutes Page 5 of 10 Motion carried: 5-0 8. COMPREHENSIVE ANNUAL FINANCIAL REPORT FOR THE YEAR ENDED JUNE 30, 2016 The City engages an independent certified public accounting firm to complete an annual audit of the City's financial records. There are a number of reports such as the Comprehensive Annual Financial Report (CAFR), produced as a result of the annual audit and there are actions that are required by the City's governing board (City Council) to meet the requirements of various auditing standards, such as meeting with the auditing firm that conducted the audit to discuss the audit and internal control issues. Nitin P Patel, CPA from White Nelson Diehl Evans LLP provided a presentation. Finance Manager Jenny Leisz provided a PowerPoint presentation. It was moved by Mayor Pro Tem Murray and seconded by Councilmember Puckett to: 1. Receive and file the CAFR for the year ended June 30, 2016. 2. Discuss the audit and internal controls with the independent certified public accounting firm, White Nelson Diehl Evans LLP, who conducted the audit. Motion carried: 5-0 9. LEGISLATIVE UPDATE Staff has prepared a brief summary of California laws most relevant to the City of Tustin or that may be of particular interest in the coming year. These laws went into effect on January 1, 2017. It was moved by Councilmember Clark and seconded by Councilmember Gomez receive and file this report. Motion carried: 5-0 10. 2017 COMMISSION VACANCIES Due to term expirations, staff requested that the City Council provide direction on the desired process to fill upcoming vacancies on the Planning and Community Services Commissions. It was moved by Mayor Pro Tem Murray to poll current Commissioners whose terms will expire to receive confirmation of their interest to continue to serve and City Council January 17, 2016 Meeting Minutes Page 6 of 10 reappoint if interested. If a vacancy exists, appoint an ad hoc committee of two Council Members to interview the candidates and make a recommendation to the full City Council; and direct staff to examine the current policy regarding terms limits and return for Council's consideration. Amended Motion: It was moved by Mayor Pro Tem Murray and seconded by Councilmember Gomez to appoint an ad hoc committee (Mayor Pro Tem Murray and Council Member Gomez) to interview the candidates and make a recommendation to the full City Council; and direct staff to examine the current policy regarding terms limits and return for Council's consideration. Motion carried: 5-0 OTHER BUSINESS/COMMITTEE REPORTS City_Manager Jeffrey C. Parker Thanked the Finance Department for their hard work with the Comprehensive Annual Financial Report (CAFR), the City of Tustin's General Fund budget balance is up which gives the city the ability to move forward with a lot of projects; appreciated the hard work and effort of all the departments. Councilmember Puckett Wished everyone a Happy New Year. Attended the Transportation Corridor Agencies meeting. January 13 Attended the Tustin Police Department Annual Awards Dinner at the Tustin Marconi Auto Museum; honor to see the quality of Tustin Police Officers; thanked Chief Charles F. Celano for the great job the Tustin Police Department does. Councilmember Gomez January 11 Attended the Tustin Chamber of Commerce Breakfast; nice to see Tustin Police Officers recognized as well seeing their stories on the website. January 12 Attended the Library Advisory Board meeting in Tustin; many new members were welcomed; the 2017 meeting schedule was approved and a brief update was given regarding library renovations; in 2016 there were 6.2 million visits with over 500,000 new library cards issued; there was over 2,500 story times for those at a pre -reading level; the Literary Orange program will be held on April 1; early bird pricing is available until March 1; please visit www.Literary0range.org for more information. City Council January 17, 2016 Meeting Minutes Page 7 of 10 January 13 o Attended the Orange County Senior Advisory meeting; the presentation for the month was an orientation for all new members and to elect this year's officers; Tustin Senior Advisor Board member, Sherry Geyer has served as the committee's chair for the past two years. o Attended the presentation "A Vision for Orange County's Future"; provided a fascinating look at our demographics and economics and how governance will change based on these characteristics. o Attended the Tustin Police Department Awards Dinner; was one of the most inspirational evenings of the year. Councilmember Clark January 7 Joined Senator Janet Nguyen and the Tustin Girl Scout Troop to talk about public policy and women in government before they left for their trip to Washington D.C. January 12 Was sworn into the Orange County Vector Control Board; had orientation and is excited to serve on the board. January 13 Attended the Tustin Police Department Annual Awards Dinner at the Tustin Marconi Auto Museum; was honored to attend the event; congratulated Officer Matt Roque on receiving the Officer of the Year Award and Sergeant Del Pickney on receiving the Lifetime Achievement Award; thanked Police Chief Chares F. Celano on the great work he does with Tustin Police Department. January 14 Was inducted into the Orange County Martin Luther King Jr. Hall of Fame with the Woman of Distinction Award; was very humbled to receive the award. January 18-20 Will be attending the League of California Cities Conference in Sacramento with Mayor Bernstein and City Manager Jeffrey C. Parker. Mayor Pro Tem Murray Janes Attended the Orange County Fire Authority (OCFA) Human Resource (HR) Committee meeting. January 4 Attended the Orange County Transportation Authority (OCTA) Executive meeting. City Council January 17, 2016 Meeting Minutes Page 8 of 10 January 11_ o Attended the Association of California Cities of Orange County (ACCOC) Homelessness Task Force meeting; thanked Officer Melissa Trahan for her phenomenal job on the panel discussion; explaining the challenges in her experience with dealing with the homelessness issue in the Tustin community. o Attended the Orange County Fire Authority (OCFA) Budget and Finance Committee meeting. January 12 Attended the Orange County Transportation Authority (OCTA) Transit Committee meeting. January 13 Attended the Tustin Police Department Annual Awards Dinner at the Tustin Marconi Auto Museum; outstanding job by the Tustin Police Department. January, 16 Complimented the Tustin Police Department and Operation Warm Wishes for working together on sponsoring a shopping spree at the Albertson's in Tustin for 115 Tustin elementary school students. Congratulated Councilmember Clark on receiving the Woman of Distinction Award. Announced that January 16t'', was a day to honor Martin Luther King Jr.; shared a quote from Martin Luther King Jr.: "Life's most persistent and urgent question is what are we doing for others?" Mayor Bernstein December 28 Attended the Orange County Sanitation District Board meeting. December 29 Attended the Menorah Lighting ceremony at the Tustin City Hall Courtyard; was a wonderful event; thanked Rabbi Ezriel and his wife for making donuts and latkes; thanked Jonathan and Lori Abelove for their participation with the event. January 6 Attended the Municipal Water District of Orange County Advisory Board meeting; announced California has received a significant amount of rain this season but unfortunately still not out of the drought; water conservation is the key. January_ 12 Had the opportunity, with Stephanie Najera, to meet with the Family Readiness Officers of the City of Tustin adopted squadrons Erika Capistran and Lynn Sheffer; planning many events for the year with the adopted squadrons; very proud the City of Tustin adopted the squadrons. Celano for the exceptional Police Department. Congratulated Councilmember Clark on receiving the Woman of Distinction Award. Congratulated Operation Warm Wishes and those who participated for sponsoring a shopping spree at the Albertson's in Tustin for 115 Tustin elementary school students; another successful event; congratulated TyRon Jackson for his work with Operation Warm Wishes. Wished everyone a Happy New Year Dedicated Council Meeting in the memory of Dr. Martin Luther King Jr.; his memory will serve as a blessing.
