A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, SUPPORTING THE CALIFORNIA
GOVERNOR'S POSITION ON WORKERS COMPENSATION
REFORM

The City Council of the City of Tustin, California, does hereby
resolve:
8 WHEREAS, the Governor has been supportive of revising
workers' compensation for California employers as a cornerstone
9 to reviving our State's economy, and

WHEREAS, the Governor's workers' compensation plan is
designed to save California employers $2 billion and provide
injured workers with increased benefits by the following six
points:
1. Repealing the "minimum rate law,"
2. Controlling medical costs by allowing employers
to require injured workers without previously
designated personal physicians to seek
treatment at a state-sanctioned care provider,

3. Limiting medical evaluations by making
employers liable for only one evaluation done
by a physician who has been mutually agreed
upon by the employer and the injured worker,
4. Curtailing stress claims by stipulating that
benefits can only be paid when it can be shown
that a sudden and extraordinary job event was
the predominant cause of the stress injury.
(Police officers, firefighters and others with
life-threatening jobs would be excluded from
the increased proof threshold). This plan
would also prohibit claims filed as a result of
a personnel action such as demotions or
firings,

5. Reducing vocational rehabilitation costs by
removing benefits from current workers'
compensation system,

6. Increasing benefits for injured workers, and

WHEREAS, the City of Tustin advocates a closer examination
of workers' compensation laws with specific measures designed
to halt the exodus of both large and small businesses from the
State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Tustin, to support the State of California Governor's
plan to reform California workers' compensation laws.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin, California, held on the 5th day of
October, 1992.
