Kendig: The City Council unanimously denied Claim No. 17-03 and will reconvene following the Regular Meeting. City Council March 7, 2017 Meeting Minutes Page 2 of 11 PRESENTATIONS — Mayor Bernstein presented a Certificate of Recognition to Isabella Walters in honor of being recognized as a Gem of Tustin. Gurpreet Singh Ahuja, M.D. provided an update regarding the Orange County Human Relations Annual Report 2015-2016. ORAL COMMUNICATION/PUBLIC INPUT — 1. Jay Samora, District Representative from Congresswoman Mimi Walters CONSENT CALENDAR ITEMS 1-6 It was moved by Councilmember Puckett and seconded by Mayor Pro Tem Murray to pull Items 2 and 5 and approve the balance as recommended by staff. Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD ON FEBRUARY 21, 2017 AND SPECIAL CLOSED SESSION MEETING OF THE CITY COUNCIL HELD ON FEBRUARY 21, 2017. Councilmember Gomez requested to have City Manager Jeffrey C. Parker's comments regarding the City's positive financial situation. It was moved by Councilmember Gomez and seconded by Mayor Pro Tem Murray to approve the Action Minutes of the Regular Meeting of the City Council held on February 21, 2017 and the Special Closed Session Meeting held on February 21, 2017. Motion carried: 5-0 3. RATIFICATION OF PAYROLL AND DEMANDS City Council March 7, 2017 Meeting Minutes Page 3 of 11 The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: That the City Council approve Payroll in the amount of $706,202.01; and Demands in the amount of $3,857,326.78. 4. 2016 GENERAL PLAN ANNUAL REPORT AND ANNUAL MITIGATION MONITORING STATUS REPORT FOR FEIS/EIR FOR MCAS TUSTIN SPECIFIC PLAN The California Government Code requires that the Planning Commission provide an annual progress report to the City Council on the status of the City's General Plan and the progress in its implementation, including the progress in meeting our share of regional housing needs and efforts to remove governmental constraints to housing development, maintenance, and improvement. In addition, the City Council certified the Program Final Environmental Impact Statement/Environmental Impact Report (FEIS/EIR) for the Disposal and Reuse of MCAS Tustin along with its Supplemental and Addendums. The FEIS/EIR evaluated the environmental impacts of the reuse and disposal of MCAS-Tustin, which included the adoption of a Mitigation Monitoring and Reporting Program (MMRP) pursuant to CEQA Guidelines Section 15097. The MMRP requires annual review to ensure compliance with required mitigations. On February 28, 2017, the Planning Commission reviewed the General Plan Annual Report and Annual Mitigation Monitoring Status Report and authorized staff to forward the reports to the City Council. With Council authorization, staff will forward the General Plan Annual Report to the State Office of Planning and Research and the State Department of Housing and Community Development (HCD) in fulfillment of the State's requirement, and receive and file the Annual Mitigation Monitoring Status Report. Motion: That the City Council: 1. Authorize staff to forward the General Plan Annual Report to the State Office of Planning and Research and the State Department of Housing and Community Development; and 2. Receive and file the Annual Mitigation Monitoring Status Report and authorize staff to submit a subsequent report when considerable and significant activities occur. 5. AWARD OF CONTRACTS FOR PEPPERTREE PARK (CIP 10032) AND CAMINO REAL PARK (CIP 20054) LIGHTING IMPROVEMENTS City Council March 7, 2017 Meeting Minutes Page 4 of 11 Mayor Bernstein and Mayor Pro Tem Murray recused themselves due to a potential conflict in real property interest. The Peppertree Park Lighting Improvements (CIP No. 10032) and Camino Real Park Lighting Improvements (CIP No. 20054) will provide for key pathway. safety, minimize the need for maintenance and decrease energy usage. The purpose of this item is to consider the acceptance of the lowest responsive, responsible bid from Comet Electric, Inc. for both projects and to seek authorization to award the construction contracts. It was moved by Councilmember Gomez and seconded by Councilmember Puckett to: 1. Award the construction contract for the Peppertree Park Lighting Improvements CIP No. 10032 to the lowest responsive/responsible bidder, Comet Electric, Inc. in the amount of $132,100, and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City; and 2. Award the construction contract for the Camino Real Park Lighting Improvements CIP No. 20054 to the lowest responsive/responsible bidder, Comet Electric, Inc. in the amount of $121,588, and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. Motion carried: 3-0-2 Mayor Bernstein and Mayor Pro Tem Murray returned to the dais 6. AUTHORIZE THE REQUEST FOR THE ORANGE COUNTY TRANSPORTATION AUTHORITY MEASURE M2 TIER 2 ENVIRONMENTAL CLEANUP PROGRAM FUNDING EXTENSION FOR THE MEDIAN IRRIGATION REPLACEMENT AND STORM DRAIN RETROFITS The City of Tustin was awarded a grant in the amount of $200,000 from the Orange County Transportation Authority (OCTA) Measure M2 Environmental Cleanup Program Tier 2 for the Median Irrigation Replacement and Storm Drain Retrofits project. The funds were budgeted for Fiscal Year 2016/2017 and the grant requires that a contract for the work must be awarded by June 30, 2017. Project design is in process. However, award of the construction contract is not anticipated until August 2017. A funding extension request will be submitted to OCTA at the first 2017 grant semi-annual review. To submit the request for extension, OCTA requires City Council concurrence with the request. Recommendation: That the City Council authorize the Public Works City Council March 7, 2017 Meeting Minutes Page 5 of 11 Department to request a one-time, two year extension from OCTA for the Measure M2 Environmental Cleanup Program Tier 2 funding for construction of the Median Irrigation Replacement and Storm Drain Retrofits. REGULAR BUSINESS ITEM 7 7. WATER CONSERVATION UPDATE — JANUARY 2017 As a result of the drought, the City of Tustin is required to provide the State Water Resources Control Board with a monthly report regarding water consumption and restrictions. This report summarizes the information provided to the State for the month of December 2016 and provides the City Council and the public with general information on previous and upcoming actions taken by the City It was moved by Mayor Pro Tem Bernstein and seconded by Councilmember Clark to receive and file this report. Motion carried: 5-0 OTHER BUSINESS/COMMITTEE REPORTS City Manager Jeffrey C. Parker Announced on March 18th a Strategic Plan Workshop will be held at the Community Center at the Market Place; several topics will be discussed such as the City's revenue and expenditure budget; upcoming planning issues; updating the Council on the City's specific plan projects. March 7 Attended the Association of California Cities of Orange County (ACCOC) and the United Way Homelessness Task Force seminar with Mayor Pro Tem Murray and Deputy City Manager Mathew West; upcoming challenges, cities will have less federal funding for the homelessness issue; Susan Price, Care Coordinator Director (homeless "czar") for the County of Orange was in attendance answering questions and providing insight into the homelessness issue; the number one need is to provide more homelessness housing. Councilmember Puckett February 22 Attended the Transportation Corridor Agencies meeting. February 25 o Attended the Tustin Community Foundation's Swirl, Sip, and Stroll event in Old Town Tustin; very well attended; job well done by the volunteers and the Tustin Community Foundation. o Attended the Foothill Regional Medical Center Ribbon Cutting event. o Attended the Miss Tustin Pageant; congratulated 2017 Miss Tustin winner, Emma Foss. February 26 Attended the Blue Buoy Swim School Assisteens Swim Competition; great to see the participation. March 4 Attended the Los Angeles Angels Spring Training Exhibition game in Phoenix, Arizona. March 7 o Attended the Transportation Corridor Agencies (TCA) meeting. o Was appointed to the Southern California Association of Governments (SCAG) Board. Councilmember Gomez February 22 o Attended the Mid-Grant Technical Review at Tustin High School; small group of students that received a Technical Education (Tech Ed) grant; students designed a gum removal machine; students explained how they developed the machine and what substances were used; students are currently raising money to go back to Massachusetts Institute of Technology (MIT) in June. o Attended the Architects of Justice dinner to honor those who played a role in Social Justice issues over the past several years; former Irvine Councilmember Beth Krom was honored at the dinner. February 23 Attended the Tustin Area Senior Center Needs Assessment; eighty (80) to one hundred (100) people participated and were in attendance for the workshop; was a very productive workshop; will know more once the Needs Assessment consultants disclose their findings. March 2 Interviewed candidates, with Mayor Pro Tem Murray, for potential Commissioner seats for Audit, Planning, and Community Service Commission; asked for this to be placed on the next City of Tustin Council meeting agenda to discuss the next steps to fill the Commission positions. February 24-26 Was out of town due to work commitments, was unable to attend the events which City Council March 7, 2017 Meeting Minutes Page 7 of 11 occurred that weekend. Councilmember Clark February 22 o Attended the Mid-Grant Technical Review at Tustin High School; the school is on all social media platforms; if anyone is interested in donating, links for the Go Fund Me Page are on their social media platforms. o Attended the Architects of Justice dinner honoring former Irvine Councilmember Beth Krom as well as other local leaders who have made an impact on Social Justice in Orange County. February 23 Attended the California Women's Leadership Association Networking event. February 24 Attended the first Association of California Cities of Orange County (ACCOC), Public Policy Making class at the University of California, Irvine (UCI); thanked Mayor Pro Tem Murray for the recommendation on taking the class. February 25 o Was a judge for the Miss Tustin Pageant; congratulated 2017 Miss Tustin winner, Emma Foss; amazed to see the Miss Tustin program grow and expand; great to see the young women leaders of tomorrow come out of the program. o Was unable to attend the Tustin Community Foundation's Swirl, Sip, and Stroll event in Old Town Tustin, however heard it was a great event; was on the committee for the event a four years ago; excited to see the event grow. February 27 Attended the Susan G. Komen of Orange County, Circle of Promise Roundtable at the Tustin Community Center at the Marketplace, for their annual meeting. February 28 Honored at the Democratic Foundation Orange County Luncheon. March 3 Attended the second Association of California Cities of Orange County (ACCOC), Public Policy Making class at University of California, Irvine (UCI). March 6 Attended the Orange County Pacific Symphony concert at Red Hill Lutheran Church and School; watched the music of Wolfgang Amadeus Mozart being performed. Thanked Director of Community Development, Elizabeth Binsack for the tour of the Community Development Department and being introduced to staff. Encouraged everyone to attend the Tustin Hanger Half Marathon on Sunday, March 12, City Council March 7, 2017 Meeting Minutes Page 8 of 11 2017. Announced that March is Women's History month. Mayor Pro Tem Murray February 22 Attended the 2017 Black History Leadership Reception hosted by the Orange County Black Business Chamber of Commerce at the Great Wolf Lodge in Garden Grove; the City of Tustin was recognized as being the first City Council in Orange County to have two African American Councilmembers serving on the Council at the same time. February 23 Attended the Association of California Cities of Orange County (ACCOC) Legislative and Regulatory Committee meeting; discussed current assembly and senate bills. February 24 Attended the Association of California Cities of Orange County (ACCOC), Public Policy Making class at the University of California, Irvine (UCI). February 25 Was unable to attend the Miss Tustin Scholarship and Pageant due to a power outage in the neighborhood. February 27 Attended the Orange County Transportation Authority (OCTA) Board meeting; update was given on the 405 freeway project; there was discussion on the OCTA bus ridership program; discussion on Orange County Streetcar project. February 28 Presented an update to the Villa Park City Council, with Association of California Cities of Orange County (ACCOC) Chief Executive Director, Heather Stratman. March 1 Attended the Los Angeles—San Diego—San Luis Obispo Rail Corridor (LOSSAN) Board meeting; rideshare on the rail system has increased by four (4) percent from last year; encouraged everyone to take the rail system at least once. March 2 Interviewed candidates, with Councilmember Gomez, for potential Commissioner seats for Audit, Planning, and Community Service Commission. March 3 Attended the League of California Cities capital update meeting with City Manager Jeffrey C. Parker; feature speakers were Assemblyman Steven Choi and Senator John M. W. Moorlach City Council March 7, 2017 Meeting Minutes Page 9 of 11 March 6 Attended the Orange County Transportation Authority (OCTA) Executive Committee meeting. March 7 o Attended the Association of California Cities of Orange County (ACCOC) and the United Way Homelessness Task Force forum with City Manager Jeffrey C. Parker and Deputy City Manager Mathew West; very informative forum. o Attended the Orange County Task Force on Drowning Prevention meeting was held; beginning to move forward with efforts to campaign for drowning prevention awareness. Mayor Bernstein February 22 o Addressed the Realtors of Tustin at Round Table Pizza; gave them an update on what is going on within the City of Tustin; a good time was had by all. o Attended the Orange County Sanitation District Board meeting. February 25 o Attended the Foothill Regional Medical Center Ribbon Cutting event; congratulated Foothill Regional Medical Center for opening and welcomed them to the City of Tustin; first time in many years Tustin has had a medical emergency room; glad to see the hospital up and running again. o Attended the Tustin Community Foundation's Swirl, Sip, and Stroll event in Old Town Tustin; congratulated the Tustin Community Foundation for a wonderful and successful event. o Attended the Miss Tustin Scholarship Pageant; congratulated Miss Tustin coordinator Cherrill Cady for her hard work with organizing the event and Miss Tustin Program; congratulated 2017 Miss Tustin winner, Emma Foss and Miss Tustin court Raena Ramirez and Maaikee Kiyoe Pronda. February 26 Attended the Blue Buoy Swim School Aquacheivers Assisteens Swim Competition; great to see the Assisteens, who are volunteer teenagers teaching children drowning prevention; congratulated Blue Buoy Swim School for a job well done; thanked Johnny and Cindy, owners of Blue Buoy Swim School, for the great job they do. March 1 Attended the Orange County Sanitation District Operations meeting. March 2 Attended the League of California Cities Environmental Committee meeting. March 3 o Attended the Water Advisory Committee meeting; two very interesting presentations were given. City Council March 7, 2017 Meeting Minutes Page 10 of 11 o Attended the Read Across America program at Tustin Ranch Elementary School; had a great time reading to Ms. Gameroz first grade class. March 6 o Had an informative meeting regarding the two Tustin Adopted Squadrons and then gave a tour of the Tustin Hanger to three (3) Orange County cities; thanked Communications Manager, Stephanie Najera for organizing the meeting. o Attended the tri-club (Lions, Rotary, and Kiwanis Clubs) luncheon; the only luncheon in the state of California where all three (3) service clubs come together; thanked the service clubs for their hard work and everything they do for the City of Tustin. o Attended the Orange County Pacific Symphony concert at Red Hill Lutheran Church and School; watched the music of Wolfgang Amadeus Mozart being performed. Announced March 8, 2017 is Arbor Day; invited everyone to attend the Arbor Day event at Cedar Grove Park at 10:30 a.m. Encouraged everyone to attend the Tustin Hanger Half Marathon on Sunday, March 12, 2017.
