HomeMy WebLinkAboutCC RES 90-142 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 1 (; 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 90-142 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING FINAL TRACT MAP NO. 13786 The City Council of' the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: ae That Final Tract Map No. 13786 has been submitted by Akins Development Company to subdivide 13.69 acres into (three) 3 numbered and two (2) lettered lots to accommodate multiple family development. Be That a public hearing was held by the Planning Commission on December 11, 1989. At that hearing, the Planning Commission recommended approval of Vesting Tentative Tract Map 13786 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 13786 on February 5, 1990. Ce That the Planning Commission at its meeting of November 26, 1990 recommended to the City Council approval of Final Tract Map 13786. De The Final Map is considered ministerially exempt pursuant to Section 15268(B) of the California Environmental Quality Act. Ee That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of single family dwellings. Fe The 2.01 acres of parkland required for this development was previously dedicated with recordation of Tract 12870. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 13786 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. 1 2 3 4 5 6 7 8 9 10 11 13I 14 15 1(;~ 17 18 1.0 20 21 22 23 27 Resolution No. 90-142 Page 2 That the site is physically suitable for the type of development proposed. That the site is physically suitable for the proposed density of development. Je That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at- large, for access through or use of the property within the proposed subdivision. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. That the Final Map is in substantial conformance with the Vesting Tentative Map. II. The City Council hereby approves Final Tract Map No. 13786, subject to final approval of City Engineer. PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the 3rd day of December, 1990.
