STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS FOR THE MOFFETT DRIVE (CIP NO. 70230) AND LEGACY ROAD (CIP NO. 70231) EXTENSION ROADWAY CONSTRUCTION PROJECT SUMMARY The plans and specifications for the Moffett Drive (CIP No. 70230) and Legacy Road (CIP No. 70231) Extension Roadway Construction Project have been prepared and the project is ready to be bid. RECOMMENDATION It is recommended that the City Council: Adopt Resolution No. 17-08 approving the plans and specifications for the Moffett Drive (CIP No. 70230) and Legacy Road (CIP No. 70231) Extension Roadway Construction Project; and 2. Authorize the City Clerk to advertise to receive bids. FISCAL IMPACT Sufficient funds have been budgeted and appropriated in this Fiscal Year 2016-2017 Capital Improvement Program for the Moffett Drive (CIP No. 70230) and Legacy Road (CIP No. 70231) Extension Roadway Construction Project. The engineer's estimate for the project is $9,500,000. Approximately $1,200,000 is estimated to be reimbursable from the Irvine Ranch Water District for installation of their capital facilities. The project is funded through a combination of Legacy Community Facility District Funds and Land Sale Proceeds. Also pursuant to the First Amendment to the Site Conveyance Agreement executed on October 18, 2016 between the City and Tustin Unified School District (TUSD) for the transfer and grading of a 40 -acre site upon which TUSD proposes to construct the 6-12 Legacy Magnet School, the City will be reimbursed, without interest, for the road construction and improvements provided funds are available for reimbursement. Reimbursement, if any, shall occur after the construction of the 6-12 Legacy Magnet School and after the expansion of the Heritage School. Reimbursement for Moffett Drive from the TUSD drive easement to Tustin Ranch Road shall be in the amount of 8.8% of the cost of construction representing the agreed upon price for the acquisition of a private drive easement and the pro rata share of the cost of construction based upon traffic impacts generated by the school project. Reimbursement for Legacy Road from Valencia Avenue to the TUSD 40 -acre southerly property line shall be in the amount of 9.8% assuming Legacy Road is extended further by the City as a public road southerly to Warner Plans and Specifications Approval for Moffett Drive and Legacy Road Extension May 16, 2017 Page 2 Avenue. If Legacy Road is not extended further as a public road then reimbursement shall be in the amount of 100% as it would serve the school project only. CORRELATION TO THE STRATEGIC PLAN The construction of Moffett Drive from future Legacy Road to Park Avenue and Legacy Road from Valencia Avenue to future Moffett Drive contributes to the fulfillment of the City's Strategic Plan Goal A: Economic and Neighborhood Development. Specifically, the project implementation of Strategy 1, which among other items, is to develop critical phases of Tustin Legacy. DISCUSSION AND BACKGROUND On August 25, 2015 the City of Tustin and TUSD entered into a Site Conveyance Agreement for the eventual construction of the Legacy Magnet School. On October 18, 2016 the First Amendment to that Site Conveyance Agreement was entered into by the parties which stipulated among other things that the Moffett Drive and Legacy Road extensions would be constructed including all utility connections and to provide construction access for TUSD by August 31, 2018 or such other time as agreed to by the parties. Pursuant to the requirements of the Site Conveyance Agreement, an as -graded certification and as -graded geotechnical report for the 40 -acre site were transmitted to TUSD on May 1, 2017. The Moffett Drive work from future Legacy Road to Park Avenue and Legacy Road work from Valencia Avenue to future Moffett Drive consist of clearing and grubbing, construction of underground utility work, roadway improvements and traffic signals installation. This work according to the tentative schedule below allows the City to continue to meet its obligations to TUSD for the Legacy Magnet School. On December 6, 2004, the City Council adopted Resolution No. 04- 76, approving a Supplement to the FEIS/EIR for the extension of Tustin Ranch Road between Walnut Avenue and the future alignment of Valencia North Loop Road. On April 3, 2006, the City Council adopted Resolution No. 06-43 approving an Addendum to the FEIS/EIR. On May 13, 2013, the City Council adopted Resolution No. 13-32 approving the 2nd Addendum to the FEIS/EIR. The FEIS/EIR along with its Addendums and Supplement is a program EIR under the California Environmental Quality Act (CEQA). The FEIS/EIR, Addendum and Supplement considered the potential environmental impacts associated with development on the former Marine Corps Air Station, Tustin; and WHEREAS, an environmental checklist was prepared and certified by the City Council through Resolution Nos. 15-16 and 16-35 for the proposed project that concluded no additional environmental impacts would occur from approval of the project. The Environmental Analysis Checklist concludes that it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment because all potentially significant effects 1) have been analyzed adequately in an earlier EIR pursuant to applicable standards, and 2) have avoided or mitigated pursuant to that earlier EIR, including revisions or mitigation measures that are imposed upon the proposed project; and NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by the City Engineer are hereby approved as the plans and specifications for: Moffett Drive (CIP No. 70230) and Legacy Road (CIP No. 70231) Extension Roadway Construction Project BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids or proposals for the performance of the work specified in the aforesaid plans and specifications; PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 16th day of May 2017.
