RESOLUTION NO. 90-151
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, UPHOLDING CONDITION NO.
8.9 OF EXHIBIT A OF PLANNING COMMISSION
RESOLUTION NO. 2816 REQUIRING REMOVAL OF THE
EXISTING BILLBOARD AT 1501 NISSON ROAD.
The City Council of the City of Tustin does hereby
resolve as follows:
I. The City Council finds and determines as follows:
That a proper application has been filed on
behalf of Eugene Tutt of Tustin Auto Spa for
the purpose of appealing Condition No. 8.9 of
Exhibit A of Planning Commission Resolution
No. 2816, which allowed a car wash facility at
1501 Nisson Road and described as Assessor's
Parcel 432-402-02.
That a public hearing before the City Council
was duly called, noticed and held on September
17, 1990 and again on December 3, 1990.
That the denial of the request is appropriate
for the following reasons:
Section 9444-F of the City of Tustin Sign
Code states that any off-premise sign
installed for the purpose of advertising
a product, event, person or subject not
related to the premises on which the sign
is located is prohibited.
Billboards are not a sign type allowed by
the City of Tustin Sign Code as they have
been found to detract from the physical
environment in which they are located.
The billboard exceeds the 35-fo0t maximum
allowable height limit of the zoning
district.
II.
The City Council hereby upholds Condition No. 8.9
of Exhibit A of Planning Commission Resolution No.
2816.
