RESOLUTION NO. 91-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, PROVIDING FOR ADDITIONAL TEMPORARY,
PARTIALLY PAID MILITARY LEAVE FOR CITY EMPLOYEES
CALLED TO ACTIVE DUTY WITH THE ARMED FORCES AND
CONTINUATION OF BENEFITS FOR THEIR DEPENDENTS
WHEREAS, the city Council of the City of Tustin does
take the position of strong support for those employees
who may be called to serve our country in support of the
present crisis in the Middle East;
WHEREAS, a number of City employees may be called
into active military service in connection with the
present crisis in the Middle East; and
WHEREAS, City Rules and Regulations provide for
members of the National Guard or Military Reserve who are
ordered to annual military duty to receive full salary
for a period not to exceed thirty calendar days per year;
and
WHEREAS, the City Council wishes to alleviate
financial hardships which employees and their families
may experience as a result of being called into active
duty,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF TUSTIN
that:
Each full-time employee of the City who is a member
of the National Guard, or the Military Reserves,
and who is called to active military service with
the armed forces of the United States, in
conjunction with the current crisis in the Middle
East, shall be entitled to miliary leave with
partial pay for the period of absence of active
military service as provided by this Re~olution.
The amount of pay each such employee shall be
entitled to receive from the City for said
additional period of military leave shall be the
difference between the gross pay in allowances
actually received by the employee from the United
States for such service and the gross wages that
said employee would have received from the City of
Tustin if he or she had not been called to active
military duty, subject to all necessary and
appropriate deductions and withholdings.

The City shall provide continued health and dental
benefits to the employee's dependents provided the
dependents were covered for those benefits prior to
the employee being called to active duty.
The City shall not pay any wage or benefit provided
for in this Resolution until and unless the
employee who requests such payment provides
satisfactory proof and documentation of eligibility
to receive payment in accordance with procedures
established by the City Manager.
The City Manager shall provide administrative
regulations regarding provision of any benefit or
employee right during this time, provided such
regulations do not conflict with existing plan
documents, City regulations or State law.
The pay and benefits authorized by this Resolution
shall terminate on June 30, 1991, unless extended
by the City Council.
PASSED AND ADOPTED by the City Council of the City
of Tustin at a regular meeting held on the 4th day of
February 1991.

CERTIFICATION FOR RESOLUTION NO. 91-22
Mary E. Wynn, City Clerk and ex-officio Clerk of the City
Council of the City of Tustin, California, does hereby
certify that the whole number of the members of the City
Council is five; that the above and foregoing resolution
was duly and regularly passed and adopted at a regular
meeting of the City Council held on the 4th day of
February, 1991 by the following vote:
