SUBJECT: TUSTIN POLICE OFFICERS ASSOCIATION
MEMORANDUM OF UNDERSTANDING - CONTRACT AMENDMENT
SUMMARY:
Adoption of the attached Resolution and Memorandum of Understanding Contract
Amendment will authorize an increase in the City's contribution to the Flexible Benefits
Plan, pursuant to previous Council direction, for employees within the Tustin Police
Officers Association (TPOA) bargaining unit.
RECOMMENDA TION:
Adopt Resolution No. 07-08 amending the City's Classification and Compensation plans
and approving a Memorandum of Understanding Contract Amendment for the Tustin
Police Officers Association encompassing the time period of January 1, 2007 through
June 30,2007.
FISCAL IMPACT: Approximately $53,000 for the contract amendment.
BACKGROUND AND DISCUSSION:
The Tustin Police Officers Association (TPOA) consists of approximately 69 employees
including our Police Officers and Police Recruits. The last TPOA contract which
became effective January 1, 2006 included a re-opener clause on Article 23 Flexible
Benefits Plan.
The City formally began discussions with TPOA to discuss the re-opener in November,
2006 pursuant to parameters established by the City Council.

TPOA is going through the ratification process, which due to the holidays will not
be completed until January 1, 2007. In the event TPOA membership does not
ratify the amendment then staff will recommend that this item be removed from
the Agenda.

RESOLUTION NO. 07-08
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING THE
CLASSIFICATION AND COMPENSATION PLAN FOR
THE CITY OF TUSTIN AND APPROVING THE
CONTRACT AMENDMENT TO TH'E MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF TUSTIN
AND THE TUSTIN POLICE OFFICERS ASSOCIATION,
CONCERNING ARTICLE 23. FLEXIBLE BENEFITS PLAN
AND ARTICLE 9. PAID LEAVE
WHEREAS, the City Council has authorized and directed, under the
provisions of the City of Tustin Personnel Rules and Regulations, Resolution No. 88-
103, the preparation of a Classification and Compensation plan for all employees in
the municipal service of the City of Tustin; and
WHEREAS, Resolution No. 88-103 requires that amendments or revisions to
the compensation plan be approved by Resolution of the City Council; and
WHEREAS, the City of Tustin, hereinafter referred to as "City" and the Tustin
Police Officers Association, hereinafter referred to as "TPOA", have met and
conferred in good faith in accordance with the requirements of the Meyers-Milias-
Brown Act; and
WHEREAS, the City and TPOA have reached agreement on an amendment
to Article 23 and Article 9 of the TPOA Memorandum of Understanding effective
January 1 , 2007 through June 30, 2007 as more particularly set forth in the attached
Contract Amendment; and
NOW, THEREFORE, the City Council of the City of Tustin, California does
hereby resolve as follows:
SECTION 1. The contract amendment, effective January 1, 2007, is
hereby approved and incorporated herein by reference as Exhibit "A" as though fully
set forth herein and staff is authorized to amend the City's classification and
compensation plans accordingly.
Passed and adopted by the City Council of the City of Tustin at a regular meeting
held on the 2nd day of January 2007.
