SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION
TO FILE THE NOTICE OF COMPLETION FOR THE RED HILL AVENUE
/ OLWYN DRIVE PEDESTRIAN ENHANCEMENTS (CIP NO. 4067)
SUMMARY
Construction of the Red Hill AvenuelOlwyn Drive Pedestrian Enhancements (CIP No. 4067)
has been completed to the satisfaction of the City Engineer and is now ready for City
Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 07-03 accepting the Red Hill
AvenuelOlwyn Drive Pedestrian Enhancements (CIP No. 4067), and authorizing the
recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion.
Assuming no claims or stop payment notices are filed, it is further recommended that thirty-
five (35) days after the date of recordation of the Notice of Completion, the City Council
authorize payment of the final 10% retention in the amount of $18,361.91 to Elite Bobcat
Service, Inc. The total final construction contract cost for the project is $183,619.11.
FISCAL IMPACT
The final construction contract cost for the Red Hill AvenuelOlwyn Drive Pedestrian
Enhancements (CIP No. 4067) is $183,619.11 . The project was funded by a combination of
funds from the Motor Vehicle Registration Subvention Fund and the City's Capital
Improvement Program (CIP No. 4067) budget.

Project construction, along with design and construction management, has increased the City's
infrastructure assets by $196,543. The increased infrastructure valuation will be added to the
City's infrastructure inventory as required by Statement 34 of the Governmental Accounting
Standards Board (GASB 34). Detailed cost information is shown on the attached GASB 34
Infrastructure Inventory Valuation Form.
BACKGROUND AND DISCUSSION
The construction of the Red Hill Avenue / Olwyn Drive Pedestrian Enhancements (CIP No.
4067) was completed on October 23, 2006. This project provided for the installation of an in-
pavement lighted crosswalk at an existing school crosswalk across the south leg of Red Hill
Avenue at Olwyn Drive. The flashing lights are activated by pedestrians and serve to provide
additional warning to drivers that pedestrians are using the crosswalk.
All of the work for this project has been completed to the satisfaction of the City Engineer and is
now ready for City Council acceptance.

RESOLUTION NO. 07-03
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION. OF THE NOTICE OF
COMPLETION FOR THE CONSTRUCTION OF THE RED HILL AVENUE
/ OLWYN DRIVE PEDESTRIAN ENHANCEMENTS (CIP NO. 4067)
WHEREAS, Elite Bobcat Service, Inc., having a contract with the City of Tustin to
construct the hereinafter described publicworks and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor. has completed said public
improvement hereinafter. more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:
Red Hill Avenue/Olwyn Drive Pedestrian Enhancements (CIP No. 4067)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required bylaw.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 2nd day of January 2007.
