HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: BUilDING INDUSTRY ASSOCIATION DIRECTIONAL SIGN PROGRAM FOR NEW RESIDENTIAL DEVELOPMENTS IN THE CITY OF TUSTIN SUMMARY: On September 21, 2006, the Building Industry Association of Southern California Orange County Chapter (BIA/OC) met with City staff to discuss their proposed Directional Sign Program for new residential developments in the City of Tustin. The Sign Program proposes double post-mounted freestanding signs approximately 7.5 feet high at various locations through out the City of Tustin. These signs will be located within the City's right-of-way and these signs would substitute individual builder's directional signs. RECOMMENDATION: That the City Council direct the City Manager and/or designee to negotiate and execute an agreement with the BIA/OC. FISCAL IMPACT: BIA/OC has indicated that the proposed signs would be constructed and maintained by BIA/OC at no cost to the City. No impact to the General Fund is anticipated. BACKGROUND On September 21, 2006, City staff met with the BIAlOC staff to discuss their proposed Directional Sign Program tor new residential developments in the City of Tustin. The Sign Program proposes double post-mounted freestanding signs approximately 7.5 feet high at various locations through out the City of Tustin. These signs will be located within the City's right-ot-way and that these signs would substitute individual builder's directional signs. The BIA/OC has indicated that these signs would be constructed and maintained by the BIA/OC at no cost to the City. City Council Report BIA/OC Signs January 15, 2007 Page 2 While staff has reviewed the preliminary rendering of the proposed directional sign and the map showing possible signs' locations through out the City, staff proposes the following conditions should the City Council decide to enter into an agreement with the BIAlOC: . The proposed sign program would need to reflect 100 percent participation from all builders and no other builder signs could be located in the right-of-way. . The signs would need to be constructed and maintained by the BIAlOC at no charge to the City. . The signs can only advertise new residential developments within the City of Tustin boundary only. . The signs can only advertise the name of the new communities i.e. Columbus Square, Tustin Field, etc. but not builder(s) i.e. Lennar Homes, John Laing Homes, etc. . The signs would need to be made with durable materials such as recyclable materials to withstand weather conditions. . The maximum sign height would need to be six (6) feet. . Two panels on each sign would need to be set aside for City uses at no charge to the City. . The City reserves the rights to add City's logo, moniker, or special fonts to the header panel of all signs. . The proposed sign locations must conform to the sight distance requirements of City Standard No. 510. . The proposed signs shall not obstruct and/or encroach on any ex"isting traffic signs, traffic control devices, etc. that would result in any impacts to traffic operations or interfere with any existing or proposed bicycle, bus or pedestrian activities. . If any of the signs, after installation, are found to cause any significant impacts as determined by the Director of Public Works, the signs shall be removed immediately at the applicant's expense. Upon close out of each development, the BIAlOe at its sole cost and expense shall remove the respective community panel from the directional sign(s). Upon close-out of all developments, the BIAlOC at its sole cost and expense shall be responsible for the removal of all signs from the City's rig ht -of-way. . The BIAlOC shall agree, at its sole cost and expense, to defend, indemnify, and hold harmless the City, its officers, employees, agents, and consultants, from any claim, action, or proceeding brought by a third party against the City, its officers, agents, and employees, which seeks to attack, set aside, challenge, void, or annul an approval of the City Council, the Planning Commission, or any other decision-making body, including staff, concerning the proposed signs. The City agrees to promptly notify BIAlOC of any such claim or action filed against the City and to fully cooperate in the defense of any such action. The City may, at its sole cost and expense, elect to participate in defense of any such action under this condition. The proposed Sign Program would eliminate the need for individual builder's sign; therefore avoids signs clutter. The Sign Program would provide connectivity and continuity of residential development signage through out the City. The Sign Program would also provide opportunity for the City to provide directional signs to City's parks, community facilities, etc. For these reasons, staff recommends that the City Council direct the City Manager and/or designee to negotiate and execute agreement with the BIAlOC.
