SUBJECT: DESIGNATION OF CITY-OWNED TUSTIN WATER YARD PARKING
LOT AT 235 EAST MAIN STREET AS A PUBLIC PARKING AREA
SUMMARY:
The City of Tustin owns the Tustin Water Yard property located at 235 East Main Street,
which includes a parking area consisting of 67 parking spaces.
Pursuant to Ordinance No. 1323, which was adopted by the Tustin City Council on
January 15, 2007, the Council may by resolution designate available City-owned
property as a public -parking area to increase the availability of parking in certain areas
of the City.
The use of designated public parking areas for public parking shall be non-exclusive, and
the City Council shall retain the right to concurrently use the property for whatever
additional purposes the City Councilor its designee reasonably determines are necessary
or convenient and consistent with such parking use.
RECOMMENDATION:
That the City Council adopt Resolution No. 07-16.
FISCAL IMPACT:
There are no fiscal impacts anticipated as a result of adopting Resolution No. 07-16.
ENVIRONMENTAL:
The designation of the subject property as a public parki'ng area is a proposed action
that is not subject to the California Environmental Quality Act ("CEQA") pursuant to Title
14, California Code of Regulations, Section 15060 (c) (2) and 15060 (c) (3).

BACKGROUND AND DISCUSSION:
On December 4, 2006, the City Council introduced and had the first reading of
Ordinance No. 1323, which provides the authorization for designation of public parking
areas within the City by City Council Resolution and identifies a public hearing process
for either designation or alteration of any designation of public parking areas within the
City. The City Council also instructed staff to commence proceedings, provide a notice
consistent with Ordinance No. 1323, and prepare a resolution designating parking
spaces owned by the City of Tustin, located at the Tustin Water Yard parking lot, as a
public parking area. On January 15, 2007, the City Council adopted Ordinance No.
1323.
The City of Tustin owns the Tustin Water Yard property located at 235 East Main Street,
which includes a parking area consisting of 67 parking spaces. By adopting Resolution
No. 07-16, the City Council would officially designate the parking area as a public parking
area. The designation would become effective on February 14, 2007, which is the
effective date of Ordinance No. 1323.
It is anticipated that commercial proprietors in the area surrounding the subject property
will need the public parking area designation to satisfy the parking demand from future
development projects and to supplement on-site and on-street parking.
The use of designated public parking areas for public parking shall be non-exclusive, and
the City Council shall retain the right to concurrently use the property for whatever
additional purposes the City Councilor its designee reasonably determines are necessary
or convenient and consistent with such parking use.

RESOLUTION NO. 07-16
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DESIGNATING THE CITY-OWNED TUSTIN WATER YARD
PARKING LOT LOCATED AT 235 EAST MAIN STREET AS A PUBLIC
PARKING AREA.
The City Council of the City of Tustin resolves as follows:
WHEREAS, the City of Tustin owns the Tustin Water Yard property located at 235
East Main Street, which includes a parking area consisting of 67 parking spaces; and
WHEREAS, on January 15, 2007, the Tustin City Council adopted Ordinance
No. 1323, which adds Chapter 9 of Article 7 to the Tustin City Code to provide for a
process for the designation and de-designation of public parking areas in the City (the
"City's Public Parking Area Ordinance"); and
WHEREAS, the designation of the Tustin Water Yard property as a public parking
area will not be detrimental to the health, safety, peace, morals, comfort, and general
welfare of residents or businesses in the area of the designation in that sufficient off-
street parking will reduce the demand for on-street parking such that traffic flow will be
maximized and potential conflicts between pedestrians and motorists will be minimized;
and
WHEREAS, such designation will not interfere with the public safety or access to
the subject property, or with preexisting traffic patterns, as applicable in that the property
is presently used as a parking area and the use is not proposed to change following such
designation; and
WHEREAS, commercial proprietors in the area will need the property designated
as a public parking area to satisfy the parking demand from future development projects
and to supplement on-site and on-street parking; and
WHEREAS, the use of the property for public parking shall be non-exclusive, and
the City shall retain the right to concurrently use the property for whatever additional
purposes the City Manager reasonably determines are necessary or convenient and
consistent with such parking use; and
WHEREAS, pursuant to Tustin City Code Section 7900 et. seq., the property shall
be held open to the general public solely for the purpose of temporary parking of
automobiles, trucks, motorcycles, or other motor-driven forms of transportation not in
excess of 6,000 pounds gross weight, subject to those conditions, rules, and regulations
which may be established by the City Council, or the City Manager pursuant to this
Resolution; and

WHEREAS, a public hearing was duly noticed, called, and held on February 5,
2007, by the City Council; and .
WHEREAS, the designation of the subject property as a public parking area i~ a
proposed action that is not subject to the California Environmental Quality Act ("CEQA")
pursuant to Title 14, California Code of Regulations, Section 15060 (c) (2) and 15060
(c) (3).
NOW, THEREFORE, BE IT RESOLVED as follows:
SECTION 1: The City Council of the City of Tustin designates the City-owned
Tustin Water Yard parking lot located at 235 East Main Street as a public parking area as
of the effective date of Ordinance No. 1323 (which is February 14, 2007).
SECTION 2: In the event the City Manager determines, in his or her discretion,
that it is necessary or appropriate in order to assure proper and appropriate use of the
property as a public parking area and/or to prevent interference with the orderly and
efficient conduct of the City's business, the City Manager is authorized to implement
conditions, rules, or regulations that (i) prohibit overnight public parking on the property,
and/or (ii) limit, to a period not less than two (2) hours, the duration a vehicle may remain
parked in any particular parking space before it must be moved. Upon implementation of
any such conditions, rules, or regulations, the City Manager shall cause a written
statement or other graphic depiction of such conditions, rules, and regulations to be filed
with the City Clerk. As long as such conditions, rules, or regulations remain effective, the
City Clerk shall keep the written statements or other graphic depictions filed by the City
Manager pursuant to this Section on file and available for examination by all interested
persons.
SECTION 3: That this Resolution shall become effective at the same time and
date as Ordinance No. 1323.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on
the 5th day of February, 2007.
