SUBJECT: AUTHORIZATION FOR REMOVAL AND DONATION OF THREE (3)
EXISTING PARKING LOT LIGHT STANDARDS AND DEMOLITION OF
BUILDING 172 AT TUSTIN LEGACY
SUMMARY
Authorization is requested for the removal and donation of three (3) existing parking lot
standards owned by the City of Tustin and the demolition of Building 172 at Tustin
Legacy.
RECOMMENDATION
It is recommended that the City Council:
1. Authorize the City Manager or Assistant City Manager to execute a Bill of Sale and
License Agreement by and between the City of Tustin and Orange County Rescue
Mission for the removal and donation of three (3) existing parking lot light standards
owned by the City of Tustin, subject to review and approval of said Bill of Sale and
License by the City Attorney; and,
2. Authorize the City Manager or Assistant City Manager to execute a License Agreement
by and between the City of Tustin and Tustin Legacy Community Partners, LLC for
demolition of Building 172, at no cost to the City and provided that any cost of demolition
would also not be a recoverable cost under the DDA by the Developer as part of the DDA
Business Plan, subject to review and approval of said License by the City Attorney.
FISCAL IMPACT
The fiscal impact of donation of the light standards is negligible. In addition, the proposed
demolition of Building 172 would be at no cost to the City of Tustin.

DISCUSSION
Light Standards
The Orange County Rescue Mission is requesting donation of three (3), twenty (20) foot
high existing parking lot standards located on a 18.49 acre City of Tustin owned parcel
for permanent use in the Village of Hope parking lot currently under construction at Tustin
Legacy.
The specific light standards proposed to be removed and relocated to the Village of
Hope site are located in the a former bachelor enlisted quarters parking lot to the east of
Bumblebee Road, generally between the Village of Hope site and Warner Avenue, as
shown on the attached Light Removal Plan. While the typical light standard has a
typical lifespan of 20 to 25 years, the City's Public Works Department has determined
that the existing light standards to be donated have exceeded their typical useful lifespan
and are only worth their salvage value. Staff has also determined that the light standards
are not appropriate for reuse by the City. The current value of a new parking light
standard would be approximately $250.
The Orange County Rescue Mission would perform the work between February 5 and
March 5, 2007 subject to execution of a license agreement with the City, as authorized
by the City Attorney and any necessary conditions that may be required by Community
Development for relocation of the light standards on the Village of Hope site.
Buildina 172
Tustin Legacy Community Partners, LLC (TLCP) has requested permission to demolish
Building 172 on a portion of an 18 acre City of Tustin owned parcel at Tustin Legacy. The
building is generally located in the vicinity of the northeast corner of Warner Avenue and
Red Hill Avenue and to the west of Building 524 (helicopter hangar) as shown in the
attached photographs. Previously used for bulk fuel storage, the building has been
vacant for some time and is surrounded by a chain-link fence. TLCP. received a
Demolition Permit in October, 2006 to demolish buildings within the Master Developer
footprint per the Disposition and Development Agreement and is preparing to demolish
the buildings near Building 172 shortly. Building 172 is listed to be demolished pursuant
to Appendix C, "Preliminary Building Condition Survey" in the MCAS Tustin Specific Plan,
and since Phase 1 of TLCP's Master Development Plan is located within the same
immediate area as Building 172, TLCP has offered to demolish the building at no cost to

the City of Tustin. Any cost of demolition would also not be a recoverable cost under the
DDA by the Developer as part of the DDA Business Plan.
Demolition of Building 172 is consistent with the City's goal of developing the former
MCAS Tustin and would occur subject to execution of a license agreement with the City-

Dear Matt,
We are moving closer to finishing the Village of Hope and have started our
parking lot. Our contractor identified light poles already on the Tustin Base that
would fit with what we needed for the Village of Hope parking lot. Most of the
light poles were on the A TEP site and they gave us permission to use these. The
remaining three light poles are located on City of Tustin property. We are
requesting a donation of these surplus light poles to the Orange County Rescue
Mission"

Re: Potential Conflict of Interest
Dear Mr. Huston:
It is my understanding that the City may be considering a contract with the Orange County
Rescue Mission for the donation of surplus street lights from the former Tustin MCAS facility.
I am the President of the Rescue Mission, a nonprofit corporation. As the President, an officer
and employee of the Orange County Rescue Mission, a nonprofit corporation and a member
of the Tustin City Council, I can not and will not participate in any way in the making of this
contract.
Please consider this letter my disclosure of a potential conflict of interest as required under
Government Code Section 109(b)(I). Please file this letter with the City Clerk and request
the City Clerk to make this letter a part of the City's official records regarding the proposed
contract.
