SUBJECT: TUSTIN LEGACY FENCING
SUMMARY
Authorization is requested for purchase and installation of fencing of certain properties
at Tustin legacy.
RECOMMENDATION
It is recommended that the City Council authorize the City Manager or Assistant City
Manager to enter into a purchase and installation fencing contract with National
Construction Rentals in an amount not to exceed $97,100 subject to final contract
review and approval by the City Attorney. City Staff are also directed to at least request
Navy reimbursement of the portion of said fencing to be installed on the regional park
site.
FISCAL IMPACT
Funding of the proposed fencing will be from the following budgeted and previously
authorized accounts: $32,400 for the Tustin Legacy Community Park CIP account (CIP
2043); and $64,700 from the MCAS Tustin Enterprise Account.
BACKGROUND
The City is completing Phase I Tustin legacy Backbone Infrastructure shortly (Valencia
and Armstrong) and preparing to open newly constructed segments of Valencia Avenue
from Red Hill Avenue to Kensington Drive and Armstrong from Valencia Avenue to
Warner Avenue. Once these roadways are open, many areas at Tustin legacy that
have not been previously accessible to the general public will become directly
accessible creating potential liability concerns given the existing condition of much of
the property. In addition, the City is preparing to transition the caretaker and security
responsibilities for approximately 820 acres at Tustin Legacy to Tustin Legacy
Community Partners, also known as Master Developer Footprint. There are four (4)
parcels outside of the Master Developer's footprint currently maintained and secured
under City contracts with ACEPEX and Securitas, respectively, which are either owned
by or leased to the City of Tustin as follows:

In addition to the above properties, the Navy has not secured the northerly and westerly
boundaries of the proposed regional park site and the City has begun receiving
numerous complaints regarding the conditions on this site and the attractive nuisance
that abandoned buildings at this former military facility pose to children and the attractive
opportunity provided to potential vandals (already demonstrated by several crime
reports). It is, therefore recommended that the City install fencing on the properties as
identified in the attached fencing exhibits, including along the north and west right-of-way
lines of the Navy's regional park site. Approximately 9,890 linear feet of fence will be
needed to secure the sites.
Financinq Costs: Rent Versus Purchase
The most practical way to secure these sites until they are ultimately developed would be
to install chain-link fencing. Three (3) companies have submitted prevailing wage
estimates for renting and purchasing six (6) foot high chain-link fence, with posts driven
to a depth of approximately two (2) feet, with top and bottom tension wire, and one (1)
vehicle gate per site. Costs for either rental or purchase are shown below and do not
include any required State sales tax.

Based upon the estimates, the cost of purchasing versus renting fence would be
realized in less than three (3) years per National Construction Rentals' lowest informal
bid estimate. Since It would also be the City's intention to install windscreens and
marketing information on each site (through a future separate contract) on roadway
adjacent fencing, it may become necessary to add additional supports in strategic
locations as determined in the field after the fence is installed.
As a result, it is recommended that an additional approximately 50/0 contingency
authorization be added to deal with any necessary field modifications to the fencing for
a total contract authorization up to $97,100 which would also include any necessary
State sales tax. Approximately $20,000 of this expense would be directly related to the
fencing installed on Navy property. It would be our intention to at least request Navy
reimbursement of this expense given the potential liability exposure of all parties.

established, regionally recognized company.
