HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT SUBJECT: SET A PUBLIC HEARING FOR JUNE 19, 2007 PURSUANT TO THE REQUIREMENTS OF PROPOSITION 218 TO CONSIDER THE ESTABLISHMENT OF SOLID WASTE RATES AND PLACING RESIDENTIAL SOLID WASTE RATES ON THE FY 2007-2008 COUNTY PROPERTY TAX ROLL SUMMARY Pursuant to Proposition 218, a public protest hearing is required to set solid waste rates. Staff is requesting the City Council set a public hearing on June 19, 2007 at 7:00 P.M. to consider the residential and commercial rate adjustments and placement of the residential fees on the FY 2007-2008 property tax roll. RECOMMENDATION Set a public hearing for June 19, 2007 at 7:00 P.M. to consider rate adjustments for FY 07/08 and to place the residential solid waste fees on the County's Assessor's Tax Roll. FISCAL IMPACT Public noticing for this hearing will cost approximately $10,000 for preparation of the notice, property owner data and mailing. Staff has identified available funding in the Public Works Department operating budget BACKGROUND Pursuant to recent case law, the City Attorney has determined that the City must comply with the requirements of 1996's Proposition 218 in order to set solid waste rates. Proposition 218 requires the City to conduct a formal protest hearing so that all property owners will have the opportunity to comment or dissent on residential and commercial solid waste rates. Single family residential fees are currently placed on the Assessor's Tax Roll. This is the last year that residential rates will be placed on the property tax roll. The new contract requires a transition to hauler billing in 2008.
