HomeMy WebLinkAbout10 MCAS TUSTIN PLAN AMEND 05-15-07_. r AGENDA REPORT Agenda Item 10 Reviewed: City Manager Finance Director NIA MEETING DATE: MAY 15, 2007 TO: WILLIAM HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: MCAS TUSTIN SPECIFIC PLAN AMENDMENT (ZONE CHANGE 07-001) SUMMARY: MCAS Tustin Specific Plan Amendment (Zone Change 07-001) is proposed by Tustin Legacy Community Partners, LLC. (the developer), a Delaware limited liability company. If approved, Zone Change 07-001 would allow tandem parking in residential developments and compact spaces in non-residential developments and would specify their required dimensions. Zone Change 07-001 would not increase the overall development potential or residential capacity currently allowed by the MCAS Tustin Specific Plan. On March 27, 2007, the Planning Commission recommended that the City Council approve Zone Change 07-001. On April 3 and April 17, 2007, the City Council considered Zone Change 07-001 and continued the item to allow staff to address on- street parking issues brought forward during the public hearing. Applicant: Tustin Legacy Community Partners, LLC. (TLCP). RECOMMENDATION: That the City Council re-introduce and have first reading by title only of Ordinance No. 1335 approving Zone Change 07-001 and set for second reading at the Council's next scheduled meeting. FISCAL IMPACT: The proposed Zone Change is an applicant-initiated project. The applicant has paid applicable fees for the processing of this project. BACKGROUND At the meeting of the April 3, 2007, the City Council made inquiries regarding the proposed Specific Plan Amendment particularly related to on-street guest parking. At the April 17, 2007, City Council meeting, .staff provided a briefing on the matter and City Council Report ZC 07-001 May 15, 2007 Page 2 requested City Council direction. After discussion of the item, the City Council decided to continue the item for two (2} weeks or when feasible and directed staff to continue to work with the developer on the proposal. DISCUSSION On-street Guest Parking Following the Council meeting, staff met with TLCP to address the Council's concerns related to on-street guest parking. As a result, TLCP proposes the following: • Fifty (50) percent of the guest spaces required may be fulfilled with on-street parking on public or private local streets. (Local street is defined by the MCAS Tustin Specific Plan as street sections built to public street standard to be used for local circulation within each development parcel that connect to the backbone roadway system). • While arterial roadways may accommodate on-street parking for the convenience of the public to access the Linear Park or other public amenities, no required guest spaces will be located on any of the arterial roadways at Tustin Legacy. • TLCP anticipates on-street guest parking spaces to be implemented only within Neighborhoods D and G local streets identified on Attachment A. Based upon the above proposal, footnote 2 of Table 3-4 of the MCAS Tustin Specific Plan has been revised to read: ~2 Not more than fifty (50~ percent of the guest spaces required may be fulfilled with on-street parking on private and public local streets, except where adjoining apublicly accessible park. Clean-up Items Subsequent to the April 17, 2007, City Council consideration of Zone Change 07-001, staff determined to correct several minor typographical errors found in the Specific Plan. These items have been added to proposed Zone Change 07-001 as follows: • The shared parking study was amended as part of Zone Change 05-002 (approved in April 2006); however, the text in the Specific Plan was not updated to reflect the correct date of its latest amendment. Therefore, the last sentence of the first paragraph of Section 3.13.4 of the MCAS Tustin Specific Plan is proposed to be amended to read: The parking reduction shall be based on the parking demand analysis completed for anticipated development of this area as described in the Tustin Legacy Community Core Mixed Use Development -Phases 1 & 11 Shared Parking Study dated Ja~~ ("Community City Council Report ZC 07-001 May 15, 20.07 Page 3 Core Shared Parking Study"), as may be amended subject to review and approval by the Public Works Department, • Zone Change 05-002 also amended the On-site Average Daily Trip (ADT) Development Thresholds; however, Table 4-4 of the MCAS Tustin Specific Plan was not updated to reflect the approved traffic study that was prepared in conjunction with Zone Change 05-002. City Council Report ZC 07-001 May 15, 2007 Page 4 Environmental Review The City Council adopted Resolution No. 07-33 at the April 3, 2007 meeting determining that the Zone Change 07-001 is within the scope of the previously approved Program FEISIFEIR and its Addendum and that pursuant to Title 14 California Code of Regulations Sections 15168 (c} and 15162, no new effects could occur and no new mitigation measures would be required. The City Council of the City of Tustin does hereby ordain as follows: SECTION 1. The City Council finds and determines as follows: A. That the Tustin Legacy Community Partners, LLC. (TLCP) proposes Amendments to the MCAS Tustin Specific Plan (Zone Change 07-001 }. Zone Change 07-001 does not "substantially amend" the Specific Plan. Instead, Zone Change 07-001 generally would allow tandem parking in residential developments and compact spaces in non-residential developments and would specify their required dimensions. Zone Change 07-001 would not increase the overall development potential or residential capacity allowed by the MCAS Tustin Specific Plan. B. That a public hearing was duly called, noticed, and held on said application on March 27, 2007, by the Planning Commission. Following the public hearing, the Planning Commission recommended approval of Zone Change 07-001. C. That a public hearing was duly called, noticed, and held on said application on April 3 and April 17, 2007, by the City Council. D. Zone Change 07-001 is consistent with the Tustin General Plan. The Land Use Element includes the following City goals and policies for the long-term growth, development, and revitalization of Tustin, including the MCAS Tustin Specific Plan area. 1. Achieve balanced development. 2. Ensure that compatible and complementary development occurs. 3. Improve city-wide urban design. 4. Promote economic expansion and diversification. 5. Implement a reuse plan for MCAS Tustin which maximizes the appeal of the site as a mixed-use, master-planned development. Ordinance No. 1335 Page 2 SECTION 2. Parking Stall Dimensions and Parking Lot Design: Except as otherwise provided herein, sparking space dimensions, compact car accommodations, and parking lot design shall be provided in accordance with the parking standards and guidelines on file in the City of Tustin or Irvine Community Development Department, as applicable. Within Planning Areas 7 through 15: • An enclosed garage parking space clear and unobstructed inside dimension shall be not less than 10 feet by 20 feet. All other standard spaces shall be not less than 9 feet by 18 feet, except that a parking space abutting a solid wall within a parking structure shall be not less than 10'-6" by 18 feet. A two (2) foot overhang area over low level landscapin_ shall be permitted. • The minimum width of any two-way drive aisle serving a parking_ space shall be not less than 24 feet. When parking spaces are located within a parking structure, any supporting column shall be set back two (2) feet from the drive aisle as measured from the centerline of the column. • Up to 20% of the parking spaces required for non-residential use may be designed and designated for compact cars. A compact parkingspace shall be not less than 8 feet by 16 feet. A two (2) foot overhang area over low level landscaping shall be permitted. Compact spaces may not be used to satisfy any_portion of the required number of covered/assigned spaces or ~ uq est spaces for residential developments. • Where authorized in Table 3-4, an enclosed tandem garage space clear and unobstructed inside dimension shall be not less than 10 feet by 40 feet. Where located in an open parking structure, a tandem space clear and unobstructed dimension shall be not less than 9 feet by 36 feet. 2. For all other Planning Areas: Each parking space shall be a rectangular area 9 feet by 20 feet. A 2~/z foot overhang area over low level landscaping shall be permitted. Parking accommodations for compact cars may be Ordinance No. 1335 Page 4 provided with such designated spaces being not less than 8 feet by 17 feet. If any provision of this part is held by a court to be invalid or unconstitutional, such .invalidity or unconstitutionality shall apply only to the particular facts, or if a provision is declared to be invalid or unconstitutional as applied to all facts, all of the remaining provisions of this ordinance shall continue to be fully effective.
