HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENTIENGINEERING DIVISION SUBJECT: AMENDMENT N0.2 TO CONSULTANT SERVICES AGREEMENT WITH MOFFATT AND NICHOL FOR ADDITIONAL PRELIMINARY ENGINEERING/PLANNING FOR THE RED HILL AVENUE GRADE SEPARATION AT OCTA/SCRRA RAILWAYIEDINGERRVENUE (CIP No. 7175) SUMMARY Amendment No. 2 to the Consulting Services Agreement between the City and Moffatt and Nichol will provide for additional preliminary engineering/planning for the Red Hill Avenue Grade Separation at OCTA/SCRRA Railway/Edinger Avenue (CIP No. 7175}. RECOMMENDATION It is recommended that the City Council approve Amendment No. 2 to the Consultant Services Agreement with Moffatt and Nichol (M&N) to provide additional preliminary engineering/planning for the Red Hill Avenue Grade Separation at OCTA/SCRRA RailwaylEdingerRvenue (CIP No. 7175} and authorize the Mayor and City Clerk to execute the Amendment on behalf of the City subject to approval by the City Attorney. FISCAL IMPACT The original budget for the Red Hill Avenue Grade Separation at OCTAISCRRA Railway/Edinger Avenue (CIP No. 7175} provided $550,000 for preliminary engineeringlplanning services. The FY 200612007 Capital Improvement Program Budget provides carry-over project funding of $381,428. The budgeted funds consists of Measure "M" Turnback funds, Measure "M"Growth Management Area 7 funds, and Regional Surface Transportation Program funds (Federal Funds)/State Transportation Program funds. The current contract amount is $392,508. Amendment No. 2 is in the amount of $104,210 and there is sufficient funding to cover this cost. BACKGROUND On March 21, 2005, the City Council approved a Consultant Services Agreement (CSR) in the not to exceed amount of $379,908.00 with M&N for preliminary engineering/planning for the Red Hill Avenue Grade Separation at OCTA/SCRRA Railway/Edinger~Avenue (CIP No. 7175). The goal of the consultant services was to evaluate alternative designs for the future Amendment No. 2 to Consultant Services Agreement with Moffatt and Nichol for Additional Preliminary Engineering/Planning for the Red Hill Avenue Grade Separation at OCTA/SCRRA Railway/Edinger Avenue (CIP No. 7175) June 5, 2007 Page 2 construction of a grade separation for Red Hill Avenue at the OCTA/SCRRA Railway/Edinger Avenue area. A preferred design concept will ultimately be developed as part of the work effort. On September 13, 2006, Amendment No. 1 was approved in the amount of $12,600 to rovide additional Socio-Economic studies to support the Preliminary Environmental Study p (PES) for a current contract amount of $392,508. M&N has studied five (5) alternatives for the grade separation at the subject location includin a "No-Build" alternative (Alternative 1). Alternatives 2 through 4 propose that both ,9 . Red Hill Avenue and Edinger Avenue be rased approximately thirty (30) feet. The bridge structure over the OCTA/SCRRA right-of-way would be approximately thirty-seven (37) feet above existing grade. Each of these alternatives provides for full access between Red Hill Avenue and Edinger Avenue. However, some of the disadvantages of elevating both streets is (1) driveway access on both streets would be eliminated; (2) businesses adjacent to the intersection would not be visible to the traveling public; (3) utilities would need to be relocated re uirin additional ri ht-of-wa ;and (4) the dirt fill necessary to raise each q g 9 Y roadway would be retained by an approximate 30 foot high retaining wall. The fifth alternative studied by M&N proposed to lower. Red Hill Avenue to go under the railroad tracks as well as the flood control channel. This option was dropped from further consideration mostly due to conflicts with the flood control channel. Although the impacts to both Red Hill Avenue and Edinger Avenue would be less severe since the vertical clearance required for a roadway under the tracks is less than that required for a bridge over the tracks, the presence of the flood control channel as well as existing utilities makes this alternative not feasible. Providing a structure to support the flood control channel was considered not economically feasible. The channel would have to be rerouted in a horseshoe shape and that in turn requires right-of-way takes on both sides of Red Hill Avenue in the vicinity of the fire station and the Tustin Meadows neighborhood. Additionally, due to the high water, table, a pump station would be required to prevent flooding in the lowered roadway and adds significant capital cost to the project as well as on-going maintenance cost. DISCUSSION After reviewin the five alternatives with M&N, a sixth alternative was proposed. This g . alternative will elevate Red Hill Avenue but leave Edinger Avenue at its existing grade. This alternative would eliminate some of the disadvantages of Alternatives 2 through 4. Drivewa access to all businesses on Edinger Avenue would remain as is, right-of-way Y ., .. . would not be necessary for utility relocations, and a structural reta~n~ng wall is not required. The elevating of Red Hill Avenue could be completed via a bridge structure. Amendment No. 2 to Consultant Services Agreement with Moffatt and Nichol for Additional Preliminary Engineering/Planning for the Red Hill Avenue Grade Separation at OCTA/SCRRA Railway/Edinger Avenue (CIP No. 7175) June 5, 2007 Page 3 The disadvantages of this alternative would be limited access between Red Hill Avenue and Ellin er Avenue. Ellin er Avenue traffic would be able to access southbound Red Hill 9 9 Avenue but will not have a direct connection to northbound Red Hill Avenue. Northbound traffic on Red Hill Avenue will be able to access Edinger Avenue, however, southbound traffic on Red Hill Avenue will not have a direct connection to Edinger Avenue. For those movements that lack a direct connection, alternative routes will be necessary. Staff requested that M&N submit a proposal to study Alternative 6 to the same level of detail as Alternatives 2 through 4. The scope of work is outlined in their proposal dated April 23, 2007 (attached). This alternative will also include a detailed traffic analysis. Because of the prohibited movements described above, this alternative can potentially alter traffic circulation and atterns from the area bordered by Tustin Ranch Road to the east, Valencia Avenue to p the south, SR-55 to the west and Walnut Avenue to the north. The proposed traffic analysis will study this entire area. Staff anticipates that the Alternative 6 study will be completed by October 2007 and that the City Council will be requested to select a preferred alternative in early 2008. Once a preferred alternative is selected the environmental process can then be completed. From that point design is anticipated to be complete for outside agency review by June 2010 and for bid purposes by December 2011. Based on sufficient funding, construction could begin mid to late 2012 and would last approximately two years. Staff has reviewed M&N's proposal and found it to be fair and reasonable to investigate Alternative 6. It is, therefore, recommended that the City Council approve Amendment No. 2 to the Consultant Services Agreement with Moffatt and Nichol for the additional preliminary engineering/planning for the Red Hill Avenue Grade Separation at OCTA/SCRRA RailwaylEdingerRvenue (CI P No. 7175. RECITALS WHEREAS, City and Consultant entered into the Consultant Services Agreement dated March 21, 2005, (the "Agreement") for Preliminary Engineering/Planning for the Red Hill Avenue Grade. Separation at OCTAISCRRA Railway/Edinger Avenue (CIP No. 7175) in the amount of $379,908.00; and WHEREAS, Amendment No. 1 in the amount of $12,600.00 was approved on September 13, 2006 to provide additional Socio-Economic studies to support the Preliminary Environmental Study (PES); and WHEREAS, City and Consultant desire to amend .Section 4 of the Agreement to include additional Professional EngineeringlPlanning for the Red Hill Avenue Grade Separation at OCTAISCRRA Railway/Edinger Avenue (CIP No. 7175) in the amount of $104,210.00. NOW, THEREFORE, in consideration of the mutual promises, covenants, and conditions contained herein, and upon the terms and conditions hereinafter set forth, the parties agree as follows: AGREEMENT 1. Section 4, Compensation, of the Agreement is hereby amended in its entirety to read as follows: A. The compensation to be paid under this Agreement shall be as set forth in Exhibit "B" to the Agreement dated March 21, 2005 and the proposal from Moffatt and Nichol, dated April 23, 2007, attached hereto, which combined shall not exceed a total cost of $496,718.00. B. Consultant shall submit detailed invoices, based upon the actual work performed, accompanied by backup documentation as requested by the City. C. Progress payments for work completed shall be paid by the City as the work progresses, within thirty (30}days of receipt of Consultant's invoice. D. Consultant shall provide City with a monthly itemization of all work performed, and the fees accrued thereon, in complete and sufficient detail to fully apprise City thereof. E. City shall notify Consultant within ten (10) business days after receipt of an invoice if it disputes all or some element of the invoice. City and Consultant shall promptly attempt to effect a resolution of any dispute. Not withstanding the foregoing, City shall pay the undisputed portion of any invoice. 2. Except as expressly amended herein, all other provisions of the Agreement remain in full force and effect. The assumed completion of this task is June 30, 2007. The billing rates used in our cost proposal are based on the original 2005 rates with a one time 4% escalation. Nichol, PE Project Manager Enclosures cc: file RED HILL GRADE SEPARATION -ALTERNATIVE 6 SCOPE REQUlREDTASKS INTRODUCTION The City of Tustin is requesting that an additional alternative be evaluated for the Red Hill Grade Separation Project. This work will include a preliminary design concept, traffic analysis, preliminary environmental studies (PESO, and revisions of the Preliminary Engineering Study report. A City Council presentation consisting of a power point presentation with a visual simulation is also included as part of this scope of work. Stakeholder outreach, however; is listed as an optional service. The proposed design concept will be adhering to the Regional Surface Transportation procedures required by OCTA and Caltrans. This will ensure compliance with the requirements for using Federal, State and Measure M funds. This scope is an amendment to the original contract dated March 21, 2005. 1. PROJECT MANAGEMENT AND COORDINATION Our project manager will continue to monitor and coordinate the performance of the project team to ensure that all aspects of the scope of work are addressed and that the schedule and budgetary requirements are met in accordance with the contract. The M&N team will attend and chair project team meetings (assumed 4}with the City of Tustin to discuss work objectives and progress. M&N will prepare and distribute announcements, agendas, and minutes of project meetings. It is assumed that this work will be completed by June 30, 2007. 2. CONCEPT DEVELOPMENT FOR ALTERNATIVE 6 (COMPLETED Prior to submitting this scope of work M&N developed a feasibility level exhibit for Alternative 6. This exhibit provided the City with information needed to make the decision if this alternative is feasible and should be studied further. Alternative 6 will be developed to the same level of detail as the other four alternatives currently described in the Preliminary Engineering Study dated August 28, 2006. Deliverable -concept plan and profile exhibit for Alternative 6, completed 3. SUPPORT SERVICES 3.1 Aerial Mapping Aerial photography and ground control surveys were completed prior to submitting the draft Preliminary Engineering Study report. Due to the change in the project footprint, additional survey is needed in order to develop horizontal and vertical geometry for Alternative 6. Since the Red Hill Avenue/Edinger Avenue intersection ~ improvements project was recently completed new right of way limits will need to be established. The following items of work will be performed under this task: • Updated survey research at the City of Tustin and the County of Orange for record maps, centerline ties, and other pertinent information • Field surveys to recover street centerline monumentation for Red Hill Avenue from Sycamore Avenue to Valencia Avenue and tie in to County of Orange horizontal control 1I April 23, 2007 RED HILL GRADE SEPARATION -ALTERNATIVE 6 SCOPE Centerline alignment of Red Hill Avenue from Sycamore Avenue to Valencia Avenue computation Design surveys consisting of cross sections every 50 feet on Red Hill Avenue from 200 feet NE of Sycamore Avenue southwesterly to Valencia Avenue, including on Sycamore Avenue 200 feet each way from Red Hill Avenue Design surveys in the field on Red Hill Avenue from 200 feet NE of Sycamore Avenue southwesterly to Valencia Avenue and on Sycamore Avenue 200 feet each way from Red Hill Avenue, cross-sectioning across the existing roadway every 50 feet and locating topographic features needed for design of the project Deliverable - AutoCAD dwg digital file and an ASCl1 text .txt file of all the survey points with point number, X, Y, Z and descriptor 3.2 Traffic Analysis This task will consist of forecasting turn movement volumes at study area intersections and determining the intersections' levels of service. Alternative 6 is more complicated than the previously analyzed alternatives because of the prohibited movements being proposed at Red Hill Avenue and Edinger Avenue intersection. This alternative can potentially alter traffic circulation and patterns at surrounding intersections including Edinger Avenues and Tustin Ranch Road to the east, Edinger Avenue and SR-55 to the west, Red Hill Avenue and Walnut Avenue to the north, and Red Hill Avenue and Valencia Avenue to the south. In order to assess the changes in traffic patterns in this area, the Irvine Transportation Analysis Model (ITAM) will be used as a basis to forecast the volumes and to determine the study area. Based on the results of the above described traffic analysis the stand-alone traffic report, which is used as an attachment to the Preliminary Engineering Study report, will be revised. AFA staff will attend up to two project team meetings as part of the analysis. Deliverable -revised stand-alone traffic report 3.3 Preliminary Environmental Studies (PES) -place holder The PES process, as defined in Chapter 6, "Environmental procedures" of the Caltrans' Local Assistance Procedures Manual, will continue to be used for this project. Deliverable -revised PES documentation including revised technical studies, CE documentation 3.4 Landscape Concepts This work includes developing roadway planting and streetscape as well as esthetic considerations for sound walls, retaining walls, bridges and bridge railings for Alternative 6. Deliverable -landscape concept for Alternative 6 3.5 Right-of Wa y Data Sheet This work includes development of Right of Way Data Sheet for Alternative 6 along with project coordination and teleconference meetings. It is assumed the information for the utility and railroad portion of the Data sheet will be provided by others. PRELIMINARY ENGINEERING STUDY REPORT M&N will develop the Alternative 6 concept at the same level of detail and matching criteria used in the alternatives included in the Preliminary Engineering Study. The alternative concept will include preliminary horizontal and vertical roadway geometry (plan, profile, and typical cross- sections}. It will also include preliminary bridge layouts and types, as well as retaining walls. The preliminary geometry will take into consideration requirements for horizontal and vertical clearances, site distance, design speed, traffic signalization, and intersection design. M&N will update the Preliminary Engineering Study report to incorporate comments from the reviewers as well as modifications made to the environmental documents that directly affect the report. If requested by the City, copies will be provided to a wider group of reviewers including Caltrans, OCTA, SCRRA, County of Orange, and other stakeholders. M&N will prepare the Final report for presentation to the Tustin City Council. If requested, a PDF file of the final report will be provided on CD for posting on the City's web site and as a master for producing copies of the document to meet all distribution and public information needs. Deliverable -final Preliminary Engineering Study report 5. CITY COUNCIL MEETING PRESENTATION MATERIALS M&N will assist the City staff in preparations for the City Council meeting. The following meetings and materials will be prepared: • Once the Del Amo Avenue improvements are in place, an overall isometric photograph will be obtained.
