HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION ~o SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE A NOTICE OF COMPLETION FOR THE PHASE I TUSTIN LEGACY BACKBONE INFRASTRUCTURE PROJECT (VALENCIA AVENUE, FORMERLY VALENCIA NORTH LOOP ROAD; ARMSTRONG AVENUE; LANSDOWNE ROAD; SEVERYNS ROAD; AND KENSINGTON PARK DRIVE, FORMERLY WEST CONNECTOR) (CIP 7139) SUMMARY Construction of the Phase I Tustin Legacy Backbone Infrastructure Project (Valencia Avenue, formerly Valencia North Loop Road; Armstrong Avenue; Lansdowne Road; Severyns Road; and Kensington Park Drive, formerly West Connector) (CIP 7139) has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 07-48 accepting the Phase I Tustin Legacy Backbone Infrastructure Project (Valencia Avenue, formerly Valencia North Loop Road; Armstrong Avenue; Lansdowne Road; Severyns Road; and Kensington Park Drive, formerly West Connector) (CIP 7139), authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop payment notices are filed by third parties, it is further recommended that thirty-five (35) days after the date of recordation of the Notice of Completion, the City Council authorize payment of the final retention in the amount of $650,000.00 to SEMA Construction, Inc. (SEMA). The total final construction contract cost for the project will be determined once all contract change orders and, claims are settled. Acceptance of Public Improvements and Authorization to File a Notice of Completion for the Phase I Tustin Legacy Backbone Infrastructure Project (Valencia Avenue, formerly Valencia North Loop Road; Armstrong Avenue; Lansdowne Road; Severyns Road; and Kensington Park Drive, formerly West Connector) (CIP 7139) June 19, 2007 Page 2 FISCAL IMPACT The final construction contract cost for the Phase I Tustin Legacy Backbone Infrastructure Project (Valencia Avenue, formerly Valencia North Loop Road; Armstrong Avenue; Lansdowne Road; Severyns Road; and Kensington Park Drive, formerly West Connector) (CIP 7139) will not be determined until settlement is reached on outstanding contract change orders and claims. The increased infrastructure valuation cannot be finalized until all outstanding contract change orders and claims are settled with SEMA. At that time, the final infrastructure valuation will be determined and added to the City's infrastructure inventory as required by Statement 34 of the Governmental Accounting Standards Board (GASB 34) BACKGROUND Construction of Phase I Tustin Legacy Backbone Infrastructure Project (Valencia Avenue, formerly Valencia North Loo Road; Armstron Avenue; Lansdowne Road; Severyns Road; and Kensington p 9 Park Drive, formerly West Connector) (CIP 7139) is complete. The Project constructed street, traffic signal, parkway, sidewalk, storm drain, domestic water reclaimed water, sewer, and dry utility backbone infrastructure improvements on Valencia Avenue from Red Hill Avenue to easterly of Kensington Park Drive; on Kensington Park Drive from Valencia Avenue to Edinger Avenue; and on Lansdowne Road from Valencia Avenue to the cul-de-sac north of Valencia Avenue. Construction on Severyns Road was limited to the intersection improvements at Valencia Avenue with the extension of Severyns Road to be constructed by Lennar Homes at a later date. The Project also included construction of the street, storm drain, water, sewer and reclaimed water line on Armstrong Avenue between Valencia Avenue and Warner Avenue, with only the sewer and water improvements constructed between Warner Avenue and Barranca Parkway. Backbone dry utilities,. including gas, electric, telephone and cable were also constructed underground in conjunction with all street improvements. All of the work for this project has been completed to the satisfaction of the City Engineer, and is now ready for City Council acceptance. However, SEMA has filed potential claims that will need to be addressed and work is still in process in finalizing contract change orders. The City Attorney has advised staff that the outstanding contractor claim issues do not prevent the City from accepting the project as complete and, therefore, is recommending that Staff move forward with the approval and recording of the Notice of Completion, which will start the thirty-day cut-off period for subcontractors and materials suppliers to file Stop Notice claims. Staff and the City Attorney will work with SEMA to attempt to informally resolve the remaining construction claims in the hope that litigation may be avoided. ----_.J Tim D. Serlet Director of Public Works/City Engineer Attachments: Resolution No. 07-48 Location Exhibit ~/ ~~~ Dana asd Engineering Services Manager TDS:DRK:ccg:NOC Phase I Legacy Backbone Infrastructure & Reso 07-48.doc RESOLUTION 07-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE CONSTRUCTION OF THE PHASE I TUSTIN LEGACY BACKBONE INFRASTRUCTURE PROJECT (VALENCIA AVENUE, FORMERLY VALENCIA NORTH LOOP ROAD; ARMSTRONG AVENUE; LANSDOWNE ROAD; SEVERYNS ROAD; AND KENSINGTON PARK DRIVE, FORMERLY WEST CONNECTOR) (CIP N0.7139) WHEREAS, SEMA Construction, Inc. having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said ublic improvement hereinafter mentioned in a manner satisfactory to the City Council of the City p of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public im rovement hereinafter more particularly described in accordance with the provisions of the p and contract documents and the Notice of Completion, and acceptance of said public works improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said pubic works and improvement is more particularly described as follows: PHASE I TUSTIN LEGACY BACKBONE INFRASTRUCTURE PROJECT (VALENCIA AVENUE, FORMERLY VALENCIA NORTH LOOP ROAD; ARMSTRONG AVENUE; LANSDOWNE ROAD; SEVERYNS ROAD; AND KENSINGTON PARK DRIVE, FORMERLY WEST CONNECTOR (CIP N0.7139) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said pubic works and improvement described herein as required bylaw.
