HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE CITY PROPERTY IMPROVEMENTS AT 450 EL CAMINO REAL (CIP NO. 1040) SUMMARY Construction of the City Property Improvements at 450 EI Camino Real (CIP No. 1040) has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 07-71 accepting the City Property Improvements at 450 EI Camino Real (CIP No. 1040), and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop payment notices are filed, it is further recommended that thirty- five (35) days after the date of recordation of the Notice of Completion, the City Council authorize payment of the final 10% retention in the amount of $8,338.43 to Green Giant Landscape, Inc. The total final construction contract cost for the project, including contract change orders, is $83,384.28. FISCAL IMPACT The final construction contract cost for the City Property Improvements at 450 EI Camino Real (CIP No. 1040) is $83,384.28. The project was funded by a combination of City Capital Improvement Program (CIP) funds and Federal Community Development Block Grant (CDBG) funds. Acceptance of the City Property Improvements at 450 EI Camino Real (CIP No. 1040) September 4, 2007 Page 2 Project construction, along with design and construction management, has increased the City's infrastructure assets by approximately $98,337. Any increased infrastructure valuation amount will be added to the City's infrastructure inventory after final project accounting by the Finance Department as required by Statement 34 of the Government Accounting Standards Board (GASB 34). Draft final cost information is currently shown on the attached GASB 34 Infrastructure Inventory Valuation Form. BACKGROUND AND DISCUSSION The construction of the City Property Improvements at 450 EI Camino Real (CIP No. 1040) was completed on August 22, 2007. Work consisted of installation of landscaping, irrigation and fencing within the easterly one third of the vacant city-owned lot at 450 EI Camino Real. Improvements included compacted decomposed granite (D.G.) within the landscaped area; installation of a wooden fence and gate across the lot to separate the landscaped area from the remaining unimproved portion of the lot to the west; park benches and trash receptacles; trees and flowering plants; and reproductions of historic citrus crate labels mounted on the fence commemorating Tustin's agricultural history. All of the work for this project has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. ,/ ā€¢ Tim D. Kasdan Engineering Services Manager S:\City Council Items\2007 Council Items\NOC 450 El Camino Real (CIP 1040) & Reso 07-71.doc RESOLUTION NO. 07-71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE CONSTRUCTION OF THE CITY PROPERTY IMPROVEMENTS AT 450 EL CAMINO REAL (CIP NO. 1040) WHEREAS, Green Giant Landscape, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: City Property Improvements at 450 EI Camino Real (CIP No. 1040) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
