HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE ANNUAL MAJOR PAVEMENT MAINTENANCE PROJECT, FY 2006-2007 (CIP NO. 7001) AND THE ANNUAL SIDEWALK REPAIR PROJECT, FY 2006-2007 (PROJECT NO. 402-6235) SUMMARY Construction of the Annual Major Pavement Maintenance Project, FY 2006-2007 (CIP No. 7001) and the Annual Sidewalk Repair Project, FY 2006-2007 (Project No. 402-6235) have been completed to the satisfaction of the City Engineer and are now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 07-72 accepting the Annual Major Pavement Maintenance Project, FY 2006-2007 (CIP No. 7001), and the Annual Sidewalk Repair Project,. FY 2006-2007 (Project No. 402-6235), and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop payment notices are filed, it is further recommended that thirty- five (35) days after the date of recordation of the Notice of Completion, the City Council authorize payment of the final 10% retention in the amount of $64,890.06 to All American Asphalt. The total final construction contract cost for the project, including contract change orders, is $648,900.64. FISCAL IMPACT The final construction contract cost for the Annual Major Pavement Maintenance Project (CIP No. 7001) is $463,299.69, which was funded by the City's Capital Improvement Program. The final construction contract cost for the Annual Sidewalk Repair Project (Project No. 402-6235) is $185,600.95, which was funded by the Engineering Division's Annual Sidewalk Repair Operating Budget. The total final construction cost is $648,900.64. Acceptance of Public Improvements and Authorization to File the Notice of Completion for the Annual Major Pavement Maintenance Project, FY 2006-2007 (CIP No. 7001) and the Annual Sidewalk Repair Project, FY 2006-2007 (Project No. 402-6235) September 4, 2007 Page 2 Project construction, along with design and construction management, has increased the City's infrastructure assets by approximately $785,923. Any increased infrastructure valuation amount will be added to the City's infrastructure inventory after final project accounting by the Finance Department as required by Statement 34 of the Government Accounting Standards Board (GASB 34). Draft final cost information is currently shown on the attached GASB 34 Infrastructure Inventory Valuation Forms. BACKGROUND AND DISCUSSION The construction of the Annual Major Pavement Maintenance Project and the Annual Sidewalk Repair Project was completed on August 22, 2007. Both projects are part of the City's ongoing Maintenance of Effort (MOE) requirement to maintain eligibility for Measure M funding. The Annual Major Pavement Maintenance Project generally consisted of asphalt concrete repair and resurfacing; crack routing and sealing; and traffic striping and markings within Zone 2 of the City's Pavement Management System. The majority of streets in Zone 2 are in good condition. Asphalt resurfacing was performed on Centennial Way from Main Street to First Street, and on Tustin Avenue at First Street. Work was also performed on Tustin Ranch Road at Pioneer Way to repair failed pavement in a left turn lane. The Annual Sidewalk Repair Project generally consisted of removal and replacement of sidewalk at various locations throughout the City, with some trees being removed and replaced as necessary to protect curbs and sidewalks from future damage. Additionally, curb ramps were installed in compliance with the federal Americans with Disabilities Act (ADA). All of the work for these projects has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. . (.~~ ~/ ~~ Tim D. Kasdan Engineering Services Manager Attachments: Resolution No. 07-72 Location Exhibit GASB 34 Infrastructure Inventory Valuation Forms S:\City Council Items\2007 Council Items\NOC Annual Pvmt Maint Sidewalk Repair 06-07 & Reso 07-72.doc RESOLUTION NO. 07-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE CONSTRUCTION OF THE ANNUAL MAJOR PAVEMENT MAINTENANCE PROJECT, FY 2006-2007 (CIP NO. 7001) AND THE ANNUAL SIDEWALK REPAIR PROJECT, FY 2006-2007 (PROJECT N0.402-6235) WHEREAS, All American Asphalt, having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Annual Major Pavement Maintenance Project, FY 2006-2007 (CIP No. 7001) and Annual Sidewalk Repair Project, FY 2006-2007 (Project No. 402-6235) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 4th day of September 2007.
