SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION
TO FILE THE NOTICE OF COMPLETION FOR THE CONSTRUCTION
OF THE PASADENA AVENUE STORM DRAIN FROM MEDALLION
AVENUE TO SYCAIVIORE AVENUE (CIP NO. 5032)
SUMMARY
Construction of the Pasadena Avenue Storm Drain from Medallion Avenue to Sycamore
Avenue (CIP No. 5032) has been completed to the satisfaction of the City Engineer and is
now ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 07-76 accepting the Pasadena
Avenue Storm Drain from Medallion Avenue to Sycamore Avenue (CIP No. 5032), and
authorizing the recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion; and
Assuming no claims or stop payment notices are filed, it is further recommended that thirty-
five (35) days after the date of recordation of the Notice of Completion, the City Council
authorize payment of the final 10% retention in the amount of $82,717.91 to Sukut
Construction, Inc.
FISCAL IMPACT
The final construction contract cost for the Pasadena Avenue Storm Drain from Medallion
Avenue to Sycamore Avenue (CIP No. 5032) is $827,179.13. The project was funded by a
combination of City Capital Improvement Program (CIP) funds and Federal Community
Development Block Grant (CDBG) funds.
Acceptance of Public Improvements and Authorization to File the Notice of Completion for

Project construction, along with design and construction management has increased the City's
infrastructure assets by approximately $948,271. Any increased infrastructure valuation
amount will be added to the City's infrastructure inventory after final project accounting by the
Finance Department as required by Statement 34 of the Governmental Accounting Standards
Board (GASB 34). Draft final cost information is currently shown on the attached GASB 34
Infrastructure Inventory Valuation Form.
BACKGROUND AND DISCUSSION
The construction of the Pasadena Avenue Storm Drain from Medallion Avenue to Sycamore
Avenue (CIP No. 5032) was completed on September 6, 2007. Work consisted of replacement
of the existing on-street surface drainage conveyance system with the construction of
underground storm drain pipes along Pasadena Avenue, junction structures, and catch basins.
The work also included the construction of underground storm drain pipe along Altadena
Avenue and connection into the new Pasadena Avenue system. Upon completion of the
underground improvements, the streets were resurfaced.
All of the work for this project has been completed to the satisfaction of the City Engineer, and is
now ready for City Council acceptance.

RESOLUTION NO. 07-76
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE CONSTRUCTION OF THE PASADENA
AVENUE STORM DRAIN FROM MEDALLION AVENUE TO SYCAMORE
AVENUE (CIP NO. 5032)
WHEREAS, Sukut Construction, Inc., having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:
Pasadena Avenue Storm Drain from Medallion Avenue
to Sycamore Avenue (CIP No. 5032)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 6t" day of November 2007.
