HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: SUBMITTAL OF CITY OF TUSTIN APPLICATIONS FOR THE TRANSPORTATION DEVELOPMENT ACT AND TRANSPORATION ENHANCEMENT ACTIVITY PROGRAMS, FISCAL YEARS 2008-2009 AND 2009-2010 SUMMARY City Council adoption of Resolution Nos. 07-82 and 07-84 will authorize the City's. two (2) applications for funds from the Transportation Development Act (TDA) and Transportation Enhancement Activity (TEA) Programs. The Orange County Transportation Authority (OCTA) requires City Council authorization as part of the application process. RECOMMENDATION It is recommended that the City Council adopt Resolution Nos. 07-82 and 07-84 requesting that the Orange County Transportation Authority (OCTA) include the City of Tustin's projects in the Fiscal Years 2008-2009 and 2009-2010 Transportation Development Act and Transportation Enhancement Activity Programs. FISCAL IMPACT If the two (2) proposed applications are approved by OCTA, the City's funding obligations for these projects in the Seven-Year Capital Improvement Program will be reduced by $500,000 each. BACKGROUND The TDA Program is a federal program that provides grants to local and state agencies to be used for bicycle and pedestrian facilities. The amount available countywide under the TDA Program is $7.5 Million. The TEA Program is a federal program that provides grants to local and state agencies to be used to better integrate transportation facilities into their surrounding communities, including landscape and aesthetic enhancement. The amount available countywide under the TEA Program is $6 Million. For each of the programs the City will be required to provide a minimum of 25 percent matching funds for an approved project. The total maximum amount of TDA and TEA Program funding available for the each project is $500,000. Staff has prepared a TDA Program application for the Newport Avenue Bicycle Trail Beautification Project between Main Street and Irvine Boulevard. The proposed work on Newport Avenue consists of bicycle trail, landscaping, irrigation, and drainage improvements along the Class I Bicycle Trail adjacent to the west side of Newport Avenue. Staff has also prepared a TEA Program application for the Edinger Avenue Beautification Project between east of Red Hill Avenue and west of Jamboree Road. The proposed work on Edinger Avenue consists of landscaping and irrigation installation along the north parkway of Edinger Avenue adjacent to the railway right-of-way. These projects were selected based upon review of past application submittals, current established criteria for funding, and evaluation of the project matching fund requirements. Submittal of City of Tustin Applications for Transportation Development Act (TDA) and Transportation Enhancement Activity (TEA) Programs, Fiscal Years 2008-2009 and 2009-2010 November 6, 2007 Page 2 Resolution Nos. 07-82 and 07-84 designate the projects to be submitted by the City for Fiscal Years 2008-2009 and 2009-2010 of the OCTA TDA and TEA Programs. The TDA and TEA Programs funding eligibility requires City Council authorization to apply for funding under these Programs. The applications for these projects were submitted to the OCTA by its deadline of September 28, 2007. Adopting resolutions after that date is acceptable to OCTA staff and serves to complete the administration process for receipt of the applications. ~ ~ ~. Tim D. WHEREAS, the United States Congress enacted the Safe, Accountable, Flexible, Efficient, Transportation Equity Act -Legacy for Users in August 2005, replacing the Transportation Equity Act for the 21st Century which make funds available to the Orange County Transportation Authority (OCTA) for transportation enhancement activities; and WHEREAS, the Orange County Transportation Authority (OCTA) has established the procedures and criteria for reviewing proposals; and WHEREAS, the City of Tustin possesses authority to nominate transportation enhancement activities and to finance, acquire, and construct the proposed project; and WHEREAS, by formal action the City Council of the City of Tustin authorizes the nomination of the Edinger Avenue Beautification Project between east of Red Hill Avenue and west of Jamboree Road, including all understanding and assurances contained therein, and authorizes the City of Tustin Director of Public Works/City Engineer as the official representative of the City of Tustin to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Tustin will maintain and operate the property acquired, developed, rehabilitated, or restored for the life of the resultant facility or activity; and WHEREAS, with the approval of the California Department of Transportation (Caltrans) and OCTA, the City of Tustin or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the City of Tustin will give Caltrans' and OCTA's representatives access to and the right to examine all records, books, papers or documents related to the transportation enhancement activity; and WHEREAS, the City of Tustin will cause work on the project to be commenced within a reasonable time after receipt of notification from the State that funds have been approved by the Federal Highway Administration and that the project will be carried to completion with reasonable diligence; and WHEREAS, the City of Tustin will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the Americans with Disabilities Act, and any other federal, state, and/or local laws, rules and/or regulations; Resolution No. 07-82 Page 2 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin, hereby authorizes the Director of Public Works/City Engineer as the official representative of the City of Tustin to apply for the Transportation Enhancement Activities Program under the Safe, Accountable, Flexible, Efficient Transportation Equity Act -Legacy for Users for the Edinger Avenue Beautification Project between east of Red Hill Avenue and west of Jamboree Road, Fiscal Year 2009-2010. BE IT FURTHER RESOLVED that the City of Tustin, agrees to fund its share of the project costs and any additional costs over the identified programmed amount.
