HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: CITY BOUNDARY REORGANIZATION NO. RO-07-01 LOCATED NEAR EDINGER AVENUE AND SR-55 FREEWAY (PACIFIC CENTER EAST SPECIFIC PLAN AREA) SUMMARY The subject reorganization will transfer territory currently in the City of Santa Ana to the City of Tustin. The territory is generally east of SR-55 and south of Edinger Avenue. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 07-67 authorizing staff to submit an application to and requesting the Local Agency Formation Commission of Orange County ("LAFCO") to initiate proceedings pursuant to the Cortese-Knox-Hertzberg Local Reorganization Act of 2000, Division 3, commencing with Section 56000 of the Government Code, for the reorganization of territory currently in the City of Santa Ana within the Pacific Center East Specific Plan Area. FISCAL IMPACT No gain or loss of revenue is anticipated for the recommended action. An application filing fee of $7900 with LAFCO is required. Funds are currently budgeted in the Newport Avenue Extension/SR-55 Ramp Reconfiguration Project (CIP No. 7130) for this expense. BACKGROUND The Newport Avenue/SR-55 Ramp Reconstruction Project (CIP No. 7130) and the Edinger Avenue (Smart Street) Widening Project (CIP No. 7147 in the City of Tustin and CIP No. 2505 in the City of Santa Ana) are currently under construction. The Smart Street project is a cooperative project with the City of Santa Ana under an agreement between the two cities dated April 15, 2002. Both projects were bid under one contract for economy of scale. During the planning process for the projects, it was the intent of both cities to reorganize the boundary just east of SR-55 at Edinger Avenue. The reorganization will revise the boundary between the two cities such that all property east of SR-55 and south of Edinger Avenue would be within the City of Tustin's city limits. The majority of the land area to be reorganized is owned by Caltrans and serves as the existing on ramp and former offramp to the northbound SR-55 freeway. The remainder is Edinger Avenue street right-of-way within the City of Santa Ana. The at d Exhibit B shows the subject area. City Boundary Reorganization No. RO-07-01 December 4, 2007 Page 2 DISCUSSION In order to reorganize the boundary of both cities, approval from LAFCO is required. This necessitates filing an application to LAFCO. Resolution No. 07-67 will authorize staff to file the application to begin the reorganization process and to file the application fee of $7,900. Caltrans has submitted a property consent form stating that they consent to the reorganization. The City of Santa Ana is currently reviewing documentation pertaining to the reorganization. However, this process should not preclude the City of Tustin from filing the application for reorganization. The reorganization process typically takes 4-6 months to complete from the time the application is submitted to LAFCO and concurrence from the City of Santa Ana is expected within this timeframe. RO-07-01 WHEREAS, the City of Tustin ("CITY") desires to initiate proceedings pursuant to the Cortese-Knox-Hertzberg Local Reorganization Act of 2000, Division 3, commencing with Section 56000 of the Government Code, for the reorganization of territory from the City of Santa Ana to the City of Tustin; and WHEREAS, the City will file an application with the Local Agency Formation Commission of Orange County ("LAFCO") to reorganize territory as set forth in Exhibit A and Exhibit B, attached hereto and by this reference incorporated herein; and WHEREAS, this proposed reorganization be subject to the following terms and conditions: the reorganization shall be consistent with Government Code Section 56886 and other applicable law existing as of the date of the filing of this resolution; and WHEREAS, the reasons for this proposed reorganization are as follows: to increase the economy and efficiency of government services and to use the SR-55 Freeway as the defining boundary between the Cities of Tustin and Santa Ana south of Edinger Avenue; and WHEREAS, the proposed reorganization area is within the Pacific Center East Specific Plan area. NOW THEREFORE, BE IT RESOLVED, that the City. Council of the City of Tustin, California, resolves as follows: Section 1: Staff is hereby directed to submit application for Reorganization No. RO- 07-01 and request the Local Agency Formation Commission of Orange County to take proceedings for the reorganization of territory from the City of Santa Ana to the City of Tustin, as shown on Exhibit A and Exhibit B attached hereto and incorporated herein by this reference, according to the terms and conditions stated above and in the manner provided by the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000.
