CALL TO ORDER — Meeting #2412 at 7:02 p.m. INVOCATION — Mayor Bernstein PLEDGE OF ALLEGIANCE — Councilmember Puckett PRESENTATION — Mayor Bernstein presented a Proclamation to Battalion Chief Jeff Hoey in honor of the Orange County Fire Authority Drowning Prevention Awareness Campaign. CLOSED SESSION REPORT — City Attorney David E. Kendig: The Council took no reportable action. ORAL COMMUNICATION/PUBLIC INPUT — 1. Darlene Alfuso CONSENT CALENDAR ITEMS 1-7 It was moved by Mayor Pro Tem Murray and seconded by Councilmember Puckett to move the balance as recommended by staff. Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD ON MAY 2, 2017. City Council May 16, 2017 Meeting Minutes Page 3 of 11 Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on May 2, 2017. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: That the City Council approve Payroll in the amount of $711,417.49; and Demands in the amount of $2,928,593.75. 4. QUARTERLY INVESTMENT REPORT FOR THE CITY OF TUSTIN AND THE SUCCESSOR AGENCY FOR THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY Government Code Section 53646 requires that the Treasurer make an Investment Report to the City Council at least quarterly showing balances by authorized investment and certifying its compliance with the adopted Investment Policy. Motion: That the City Council: Receive and file. 5. TRUSTEE'S SALE — AFFORDABLE HOME LOCATED AT 1345 SUN DIAL DRIVE The Tustin Housing Authority is seeking authorization to cure a homeowner default under the City's Affordable Housing Program in the Tustin Field II development. Motion: That the Tustin Housing Authority Commission authorize the Tustin Housing Authority to purchase the very low income affordable housing unit at 1345 Sun Dial Drive during the Trustee's Sale, and also authorize the Executive Director, or his designee, execute any required documents, as may be necessary to implement such action as recommended by the City Attorney. The price and terms will be discussed in Closed Session. 6. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS FOR THE MOFFETT DRIVE (CIP NO. 70230) AND LEGACY ROAD (CIP NO. 70231) EXTENSION ROADWAY CONSTRUCTION PROJECT The plans and specifications for the Moffett Drive (CIP No. 70230) and Legacy Road (CIP No. 70231) Extension Roadway Construction Project have been prepared and the project is ready to be bid. Adopt Resolution No. 17-08 approving the plans and specifications for the Moffett Drive (CIP No. 70230) and Legacy Road (CIP No. 70231) Extension Roadway Construction Project; and 2. Authorize the City Clerk to advertise to receive bids. RESOLUTION NO. 17-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE MOFFETT DRIVE (CIP NO. 70230) AND LEGACY ROAD (CIP NO. 70231) EXTENSION ROADWAY CONSTRUCTION PROJECT AND AUTHORIZING ADVERTISEMENT FOR BIDS 7. AUTHORIZE USE OF THE COUNTY OF ORANGE COOPERATIVE PURCHASING PROGRAM TO PURCHASE AND INSTALL WATER QUALITY DEVICES CIP 10074 Staff is requesting City Council authorization to use the County of Orange Cooperative Purchasing Program to purchase and install water quality devices for the irrigation retrofit portion of the Median Landscape Rehabilitation Project CIP 10074, pursuant to Tustin City Code Section 1625c Motion: That the City Council adopt Resolution No. 17-21 authorizing the City of Tustin to use the County of Orange Cooperative Purchasing Program, consistent with the effective date of Ordinance No. 1438 and the amended Tustin City Code Section 1625c, to contract with United Storm Water, Inc. to purchase and install 24 automatic retractable screens at various locations as part of the Median Landscape Rehabilitation Project CIP 10074. RESOLUTION NO. 17-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE USE OF THE COUNTY OF ORANGE'S COOPERATIVE PURCHASING PROGRAM TO PURCHASE AND INSTALL ATER QUALITY DEVICES FOR THE MEDIAN LANDSCAPE REHABILITATION PROJECT CIP 10074 8. SECOND READING AND ADOPTION OF ORDINANCE NO. 1481 Ordinance No. 1481 amends the Tustin City Code to establish four-year terms staggered every two years, and to establish term limits of two consecutive terms for each commissioner. It was moved by Councilmember Puckett and seconded by Councilmember Gomez. Substitute Motion: It was moved by Councilmember Gomez and seconded by City Council May 16, 2017 Meeting Minutes Page 5 of 11 Councilmember Clark to establish two-year terms and to establish term limits of three consecutive terms for each commissioner. Substitute motion failed: 2-3 (Mayor Bernstein, Mayor Pro Tem Murray and Councilmember Puckett dissented) It was moved by Mayor Pro Tem Murray and seconded Councilmember Puckett to have second reading by title only and adoption of Ordinance No. 1481. Motion carried: 4-1 (Councilmember Gomez dissented) ORDINANCE NO. 1481 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING AND RESTATING SECTION 1513 OF PART 1 OF CHAPTER 5 OF ARTICLE 1 OF THE TUSTIN CITY CODE RELATING TO CITY COMMISSION TERMS OF OFFICE. OTHER BUSINESS/COMMITTEE REPORTS Councilmember Puckett May 5 o Attended the 7 -Eleven Franchise Owners Association of Southern California (FOASC), scholarship award presentation at 7 -Eleven; two (2) three hundred (300) dollar scholarships were given to a student from Hillview High School and a student from Tustin High School; thanked 7 -Eleven for their generosity and their service to the community. o Attended the Cinco De Mayo Event at the Tustin Family Youth Center; was very well attended. May 7 Attended the Tustin Community Foundation (TCF) Patriots and Pioneers Program dedication ceremony held on Plumb Drive in honor of Ensign Ralph Plumb, who was in the United States Navy who lost his life during World War II; thanked Donna Marsh -Perry for initiating the Patriots and Pioneers Program honoring Tustin soldiers who have lost their lives during war. May 8 o Attended Transportation Corridor Agencies (TCA) budget -briefing meeting. o Attended the Tustin Chamber of Commerce Wally Karp Memorial Golf Tournament dinner at the Tustin Ranch Golf Course. May 10 Attended the Wally Karp Memorial ceremony held in front of the Tustin Police Department; very well done ceremony. May 11 City Council May 16, 2017 Meeting Minutes Page 6 of 11 o Attended Transportation Corridor Agencies (TCA) Board meeting. o Attended Tustin Night at Angel Stadium; Tustin was well represented. May 12 Attended the Association of California Cities of Orange County (ACCOC) Golden Hub of Innovation Awards. May 13 Distributed diplomas to the graduates at Hope International University; great to commemorate all the graduates. May 14 Celebrated Mother's Day. May 27 Will be having heart valve replacement and double bypass surgery; will be out of commission for a while; will miss a few events which will be occurring in June. Councilmember Gomez May 3 Attended the Orange County School Board Association Annual Dinner; honored past incoming boards; presented the Marian Bergeson Award for the outstanding school board member for 2017. May 4 Speaker at Tustin High School Connecting for Success event; encourages parent engagement and collaboration to improve the educational experience for the English Language Learners. May 5 o Was not able to attend the Cinco De Mayo Event at the Tustin Family Youth Center; heard it was a great event. o Attended an event at EI Sol Academy in Santa Ana. May 6 Attended the Tustin Historical Society's Home and Garden Tour; several new homes on the tour; very positive feedback from those that were new to the home tour. May 8 Announced the Association of California School Administrators for Region 17 held their 27th Annual Celebration of Excellence to honor the outstanding administrators o Honorees from Tustin Unified School District include: Cherrie Kuntz as the Special Education Administrator; Christine Matos was the Secondary Principal of the year; Superintendent, Gregory A. Franklin, Ed.D., received the Tracy Gaffey Award for overall excellence; congratulated TUSD on their awards. City Council May 16, 2017 Meeting Minutes Page 7 of 11 May 10 Attended the Wally Karp Memorial ceremony held in front of the Tustin Police Department; the ceremony continues to grow each year with new participants; a very nice ceremony. May 11 o Attended the full Orange County Library Advisory Board meeting; main discussion points included the annual budget, safety of the library and staff, and the formation of a task force to address the Irvine set aside which is very similar process to the Orange County Fire Authority (OCFA). o Attended the Tustin Night at Angel Stadium; thanked the Tustin Chamber of Commerce for setting -up and organizing the event. May 12 o Met with a Regency developer to see the progress of the Village at Tustin Legacy; the development on the corner of Tustin Ranch Road and Valencia. o Attended the Association of California Cities of Orange County (ACCOC) Golden Hub of Innovation Awards; congratulated Tustin city staff for receiving an award for the Veterans Outpost and City Manager Jeffrey C. Parker for receiving the City Manager of the Year Award. May 15 Attended the Senior Advisory Legislation meeting; a representative from the American Red Cross was the presenter; discussed legislation which impacts seniors, including personal allowance. Councilmember Clark May 4 Attended the Orange County Human Relations Annual Gala; Tustin resident TyRon Jackson was honored; great to be present and see him receive a standing ovation for his speech. May 5 Attended the Tustin Parks and Recreation Department Cinco De Mayo Event at the Tustin Family Youth Center; congratulated Recreation Supervisor Marilyn Buescher and her staff for organizing a great event. May 6 o Attended the Tustin Historical Society's Home and Garden Tour; great to see the interior of some of the historical churches and homes. o Was a jockey for the Tustin Dollars for Scholars Kentucky Derby Fundraiser; had fun raising scholarship money for Tustin High School seniors. May 8 o Met with the Tustin City Attorney, David E. Kendig; thanked David for giving a great overview on what he offers to the city; Tustin is very lucky to have David as their City Council May 16, 2017 Meeting Minutes Page 8 of 11 City Attorney. o Attended the Orange County Vector Control Board budget presentation; board is currently going through the budget review process. May 10 Attended the Wally Karp Memorial ceremony held in front of the Tustin Police Department; first time attending memorial service; was deeply moved; extremely well put together by the Tustin Police Department; thanked Chief Charles F. Celano for a great ceremony put on by his department. May 11 Attended the Tustin Night at Angel Stadium; congratulated the Tustin Chamber of Commerce for organizing a great event. May 12 Attended the Association of California Cities of Orange County (ACCOC) Golden Hub of Innovation Awards; was very proud to be with the Tustin honorees who were recognized. Thanked City Clerk, Erica N. Rabe and staff for the great job they did with the Council Chamber renovation. Mayor Pro Tem Murray May 3.8 Attended the Southern California Association of Governments (SCAG) Regional Conference; had some really good presentations throughout the conference. May 8 Attended the Orange County Transportation Authority (OCTA) Board meeting; had the first review of the 2017/2018 budget. May 9 Attended the City of Irvine Council meeting with Third District Supervisor Todd Spitzer and Orange County Fire Authority (OCFA) staff; received donation for their support on this year's Orange County Drowning Prevention Taskforce campaign. May 10 o Attended the Tustin Chamber of Commerce Breakfast meeting; recognized Officer of the Month, Tustin Officer Ralph Casiello for his outstanding arrest. o Attended the Orange County Fire Authority (OCFA) Budget and Finance meeting; reviewed the 2017/2018 proposed budget. o Attended the Tustin Police Department's Wally Karp Memorial ceremony held in front of the Tustin Police Department; thanked the Karp Family for attending the ceremony; thanked Chief Charles F. Celano, Orange County Sheriff Sandra Hutchens, and Orange County Fire Authority (OCFA) Division IV Chief, Andy Kovacs for their attendance. City Council May 16, 2017 Meeting Minutes Page 9 of 11 May 11 o Attended the Orange County Transportation Authority (OCTA) Transit Committee meeting; received new recommendations for the Orange County Street Car project; reviewed the 2017/2018 proposed budget. o Attended the Association of California Cities of Orange County (ACCOC) infrastructure technology committee meeting; approved small cell site white paper and small cell ordinances; thanked Community Development Director Elizabeth Binsack for the information she provided for the ordinance. o Attended the Tustin Night at Angel Stadium. May 12 Attended the Association of California Cities of Orange County (ACCOC) Golden Hub of Innovation Awards; congratulated Tustin City Manager Jeffrey C. Parker for receiving the City Manager of the Year Award and Economic Development Acting Deputy Director Jerry Craig for receiving an award for the Tustin Veterans Outpost project for homeless veterans. May 15 Announced that May 15 is National Police Officers Memorial Day. May 14-20 National Police Officers Memorial Week; thanked all men and women officers for their service. Thanked City Clerk, Erica N. Rabe, Director of Public Works, Douglas S. Stack, and staff for the great job with the council chamber renovation. Mayor Bernstein May 3 Attended the Association of California Cities of Orange County (ACCOC) Water committee working group meeting; reviewed legislation on water usage, water storage, storm water, and government mandates. May 5 Attended the Orange County Sanitation District Water Advisory Committee meeting; discussed legislation taking place in Sacramento regarding infrastructure projects and funding. May 6 Attended the Tustin Historical Society's Home and Garden Tour; great time was had by all. May 7 Attended the Tustin Community Foundation (TCF) Patriots and Pioneers Program dedication ceremony held on Plumb Drive in honor of Ensign Ralph Plumb, who was in the United States Navy who was lost his life during World War II. May 10 o Attended the Local Agency Formation Committee meeting; discussed the budget and current projects for the 2017/2018 fiscal year. o Attended the Tustin Police Department's Wally Karp Memorial ceremony held in front of the Tustin Police Department; thanked the Karp Family and Wally Karp's best friend for attending the ceremony. May 11 Attended the Tustin Night at Angel Stadium; thanked the Tustin Chamber of Commerce for organizing the event. May 12 Attended the Association of California Cities of Orange County (ACCOC) Golden Hub of Innovation Awards; congratulated Tustin City Manager Jeffrey C. Parker for receiving the City Manager of the Year Award and Economic Development Acting Deputy Director Jerry Craig for receiving an award for the Tustin Veterans Outpost project for homeless veterans. Announced would like to see everyone wear red on Friday, May 25th in observance of Memorial Day on Monday, May 29th Announced the Tustin Chili Cook -Off event will be held on Sunday, June 4th in Old Town Tustin. Thanked City Clerk, Erica N. Rabe, Director of Public Works, Douglas S. Stack, and staff for the great job with the council chamber renovation.
